She is now appealing the law to the Nevada Supreme Court, arguing it is unconstitutional.&amp;lt;br /&amp;gt;

The law, enacted last year, was intended to reduce incarceration for minor traffic infractions by lessening penalties. But in practice, it has stripped away defendants&amp;#039; rights while doing nothing to address the burden of fines on lower-income residents. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
&amp;quot;This complete lack of due process goes against everything our justice system stands for,&amp;quot; said Rosenblum of The Rosenblum Allen Law Firm. &amp;quot;Even in small claims court over a few hundred dollars, plaintiffs must show up and prove their case. Shayne recounted, &amp;quot;A few hours later, detectives had tracked my car to my home, and a small drone buzzed around and surveilled my office. Shayne was told she had to accompany officers in their police car to a remote Bomb Squad Command Center RV that had been set up to deactivate her prop bomb.  She called out to her co-producer, Max, who had been hiding out in the kitchen, to join her.  At the Bomb Squad remote site, Homeland Security and a member of the Arson Team questioned her and then explained that they had tested the prop device in a bomb disposal containment vessel and determined it was not active.  A Bomb Squad officer noted how real the prop looked.  Shayne was surprised, as when she first saw the prop, she thought it looked a bit &amp;quot;cheesy&amp;quot;, but the officer assured her it looked very real. Almost all of the hate crimes in Washington over that period were aggravated assaults. These incidents increased even more in Seattle. Only two other cities in the nation experienced higher increases. Observers speculate that many other hate crimes may go unreported, especially property crimes.&amp;lt;br /&amp;gt;

Note that age is not on this list. &amp;quot;Sexual orientation&amp;quot; usually includes gender identity. This offense is a Class C felony, which could mean up to five years in prison and/or a $10,000 fine.&amp;lt;br /&amp;gt;

Additionally, the defendant must &amp;quot;maliciously and intentionally&amp;quot; commit the act. In other words, the defendant must target the individual because of a protected status. So, if a person robs women because he believes women are weak and cannot fight back, that&amp;#039;s probably not a hate crime in Washington State. But it may be a hate crime elsewhere.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The enhanced mental state makes these offenses difficult to prove in court. Essentially, prosecutors must either establish that the defendant belonged to a hate group or used racial or other slurs immediately before, during, or immediately after the incident.&amp;lt;br /&amp;gt;

If the evidence is weak, attorneys can often get charges reduced to ordinary assault, or perhaps aggravated assault. Using internal government emails obtained through the Freedom of Information Act, Stern alleges that MDHHS personnel disabled a federally approved computer program designed to monitor home health services and prevent fraud. He writes that the computer program was intentionally disabled by MDHHS insiders to &amp;quot;to ease the burden&amp;quot; on staff.&amp;lt;br /&amp;gt;

Stern adds that Michigan failed to bring the state into compliance with federal rules that would expand home health care to more Michigan residents, at great taxpayer savings. &amp;quot;There is no way of telling how many people have been forced out of their homes and into institutional facilities because of the state&amp;#039;s failure to promulgate Washington&amp;#039;s new rules,&amp;quot; he writes.&amp;lt;br /&amp;gt;

Now, prison management, who claims they are financially and operationally constrained by staffing shortages, are taking more time from visiting families and children by subjecting them to intrusive and intimidating search procedures. &amp;lt;br /&amp;gt;

About 25 correctional officers along with local police stationed outside the Florence prison complex, mobilized outside the federal prison camp visiting room equipped with a mobile command center and drug-sniffing dogs to conduct intensive searches of vehicles, wallets, and purses of visiting families. The dogs are even permitted to walk on the seats inside of the vehicles and it has been reported the dogs have left scratches on or in vehicles. Correctional officers remove visitors from their cars, telling them to leave their purses, wallets, and cell phones inside the car while they rummage through their personal belongings that include money, jewelry and other valuables that could potentially be stolen by BOP staff. The elderly and disabled are forced to stand outside, sometimes in oppressive heat, while indifferent correctional officers violate them and their Fourth Amendment rights.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
&amp;quot;These types of searches at both federal and local prisons are unprecedented and to the best of my knowledge have never occurred, especially at a minimum security, out-custody federal prison camp housing non-violent offenders,&amp;quot; says Lamont Banks, Executive Director of A Just Cause. &amp;quot;It&amp;#039;s disgraceful of Florence Warden&amp;#039;s Matevousian, Stancil, and Goetz to abuse visiting families and their children by treating them like common criminals,&amp;quot; add Banks.&amp;lt;br /&amp;gt;

A Just Cause would like to understand the Florence Wardens&amp;#039; decision to suddenly eliminate Friday evening visits when BOP visiting regulation policy (Program Statement 5267.09, section 540.40) says it &amp;quot;encourages visiting by family, friends, and community groups to maintain the morale of the inmate and develop closer relationships between the inmate and family members and others in the community.&amp;quot;&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
&amp;quot;Eliminating Friday evening visits shows a lack of humanity and compassion by the Wardens towards the many innocent wives and children who have to make great financial sacrifices and travel great distances just to see their husbands and fathers for a single weekend,&amp;quot; says Banks. &amp;quot;The Florence Wardens certainly can&amp;#039;t say that staffing shortages or financial issues are the reasons they canceled Friday visits when they&amp;#039;re spending thousands of dollars to pay overtime to 20 plus correctional officers and administrative staff to shakedown and conduct intrusive searched of visiting families. Unfortunately, the BOP has a colorful history of abusing both inmates and their families,&amp;quot; contends Banks.&amp;lt;br /&amp;gt;

In the summer of 2015 a non-violent inmate at the Florence federal prison camp named Anthony Anderson was thrown into solitary confinement and allegedly killed by Florence correctional officers after being accused of receiving tobacco in the visiting room, which was never found. Florence officials claimed that Mr. Anderson committed suicide and soon cremated his body after the coroner examination. But according to Anderson&amp;#039;s mother who recently appeared on A Just Cause&amp;#039;s Blog Talk radio program, the coroner told her to hire an attorney because her son did not take his own life. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
In the early 2000s a three-year government investigation found that there was a vast conspiracy by correctional officers and management to abuse inmates and falsify records to cover up that abuse at the Florence federal prison complex. More than a dozen Florence correctional officers and their supervisors (infamously known as &amp;quot;the Cowboys&amp;quot;) were indicted and convicted for conspiring to physically assault inmates as a form of vigilante discipline. &amp;quot;The arbitrary canceling of Friday visits and bullying of visiting families is symptomatic of an ingrained abusive culture that has existed for many years at the Florence federal prison,&amp;quot; says Banks. I have addressed these concerns with Warden Goetz and Matevousian but, not surprisingly, they don&amp;#039;t appear concerned at all about these abuses. The matter has been escalated to the BOP Director&amp;#039;s office and we are in the process of notifying members of Congress in hopes of putting a stop to these abuses,&amp;quot; concludes Banks.&amp;lt;br /&amp;gt;

The preliminary test that the Courts use to determine whether a CPL should be removed was set out in the British Columbia Court of Appeal decision, Youyi Group Holdings (Canada) Ltd. v. Brentwood Lanes Canada Ltd., 2014 BCCA 388 (CanLII):&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
As a preliminary matter the applicant must show that it is experiencing or likely to experience &amp;quot;hardship and inconvenience&amp;quot; as a result of the registration of the CPL. It appears that the degree of hardship required is the subject of disagreement in the Supreme Court of British Columbia. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
[28] While some judges have proceeded on the basis that the hardship need not be &amp;quot;significant&amp;quot; (see, e.g., Enigma Investments Corp. v. Henderson Land Holdings (Canada) Ltd. 2007 BCSC 1379 (CanLII), and 0966349 B.C. Ltd. v. Shell Canada Limited, Reasons dated February 28, 2014, New Westminster Docket S151234), others have required &amp;quot;severe suffering&amp;quot; (see, e.g., the lower court decision in Liquor Barn Income Fund v. Mather 2009 BCSC 1092 (CanLII), at para. 7.) The Shorter Oxford Dictionary (6th ed., 2007) defines &amp;quot;hardship&amp;quot; to mean &amp;quot;the quality of being hard to bear&amp;quot; or &amp;quot;severe suffering or privation&amp;quot;; &amp;quot;significant&amp;quot; to mean &amp;quot;important, notable; consequential&amp;quot;; and &amp;quot;insignificant&amp;quot; to mean &amp;quot;of no importance; trivial, trifling&amp;quot; or &amp;quot;meaningless&amp;quot;. People who are fighting against the current system and would like to see bail reform argue that the rich have what is essentially a get out of jail free card, while the poor are often detained for months before they even get to trial, costing them their jobs, homes, and cars.&amp;lt;br /&amp;gt;

There are some problems with bail reform, however, that aren&amp;#039;t mentioned nearly enough and should a central part of the conversation. Those who are against reforming the current rules say not charging bail eliminates accountability for the crimes committed.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Every person who is in jail has, at the very least, been accused of a crime. In the vast majority of cases, there is substantial evidence against that individual, which is why they are being charged in the first place. Without bail holding these individuals financially accountable for their actions, we could be eliminating one of the most powerful crime deterrents: financial ruin.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Another thing to consider is the potential victims of a crime. Zero regard for any victims is shown when releasing a suspect without any type of accountability. The friends and family of victims must also live with the idea that the accused can return to public life without any immediate repercussions.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
A recent case from New Mexico highlights the potential for problems with bail reform. In Albuquerque, 30-year-old Steven Deskin was behind the wheel of a speeding vehicle when it ran a red light and collided with another car, killing its occupant. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
At the time of the crash, Deskin had his two young children in the vehicle with him and failed a field sobriety test. He is charged with a slew of offences, including vehicular manslaughter and child abuse, but is out of jail without having to pay any bail whatsoever.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The reason Deskin is out of jail, despite the evidence against him, is that he doesn&amp;#039;t have a criminal history and no blood evidence was available at the time. Therefore, he was released on his own recognizance and the family of his victim must suffer, knowing he is out of jail and in their community.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Many states, including New Mexico, currently use the Public Safety Assessment algorithm created by the Laura and John Arnold Foundation. This algorithm takes the information available on the suspect and creates a risk profile. If the accused has a risk assessment that falls behind a certain threshold, he or she is free to go without paying any sort of bail bonds.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
One thing to keep in mind is that the Laura and John Arnold Foundation has already been sued because of a major mistake that was made in New Jersey. In this situation, a suspect with a felony weapons charge was released from custody based on the algorithm&amp;#039;s findings. This individual then murdered a man days later while out on &amp;quot;free bail&amp;quot;.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Clearly, this isn&amp;#039;t a situation we want to repeat in Orange County, as just one dangerous criminal being released prematurely is one too many. The offender in New Jersey would have remained in jail if it wasn&amp;#039;t for bail reform laws in that state.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
When looking at John Arnold&amp;#039;s history, we see a man who frequently gets involved in public policy, seemingly to aid his own financial interests. Arnold has spent as much as $50 million of his own money lobbying against police officers, firefighters, paramedics, and librarians receiving pensions. His anti-union, anti-pension rhetoric shows he isn&amp;#039;t interested in the rights and well-being of the vast majority of Americans.&amp;lt;br /&amp;gt;

From afar, it seems as though Arnold is more interested in selling the computer systems that run his algorithm and having significant influence over the criminal justice system. One thing for sure is that Arnold isn&amp;#039;t to be trusted because he isn&amp;#039;t concerned with making America a safer country.&amp;lt;br /&amp;gt;

Another aspect we aren&amp;#039;t hearing too much about is the money involved. Looking at the situation in New Jersey, once again, we see that the system relies on the court fees collected to function. The problem is that there simply isn&amp;#039;t enough money being created through court fees and the entire program is expected to be in serious financial trouble by 2019.&amp;lt;br /&amp;gt;

In Orange Country and the rest of California, we&amp;#039;ll see bail reform costing the state&amp;#039;s taxpayers between $3.5 and $5 billion annually, just to fund the pre-trial release program. This doesn&amp;#039;t even begin to cover the costs associated with having more criminals out on the streets and the police resources that will have to go towards the problem.&amp;lt;br /&amp;gt;

Unless something drastically changes, complete bail reform will go through in California and those with insight into the situation are certain that problems will follow. We could be headed towards a first-time offender&amp;#039;s utopia, where individuals can commit nearly any crime they want and will likely be released without having to be financially accountable for their actions.&amp;lt;br /&amp;gt;

San Francisco was recently home to the Humphrey decision in which a judge ruled that the state&amp;#039;s current bail system is unfair to low income offenders. As a result judges in California must now incorporate the income levels of the accused when setting bail amounts. &amp;quot;I was seated on a toilet stall and &amp;quot;looked down below my right side and observed a mirror extend into the stall,&amp;quot; the inmate wrote in the grievance. &amp;quot;I said to (correctional officer) Gregory, are you trying to look at me?&amp;quot; &amp;quot;Gregory responded, &amp;#039;Yes,&amp;quot; the inmate added.&amp;lt;br /&amp;gt;

Bureau of Prisons (BOP) Program Statement 5324.12 discusses PREA and defines voyeurism as a staff member &amp;quot;peering at an inmate who is using the toilet&amp;hellip; to perform bodily functions; requiring an inmate to expose his or her buttocks, genitals, or breasts.&amp;quot;&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The complaint went on to discuss how &amp;quot;numerous other inmates have been victimized&amp;quot; by Officer Gregory. The matter was referred to Lieutenant Hill of the Florence Special Investigation Service (SIS), who, the inmate says casually dismissed Gregory&amp;#039;s alleged conduct as &amp;quot;unfounded&amp;quot; and dismissed Gregory&amp;#039;s actions as a search for contraband even though the inmate wrote that two other inmates witnessed the incident. &amp;quot;Correctional officers have the option to stop, frisk, and strip search an inmate at any time in prison,&amp;quot; says Cliff Stewart of A Just Cause. &amp;quot;If Gregory was so concerned about contraband he could have waited until the inmate exited the stall and searched him,&amp;quot; adds Stewart. A Just Cause is told by sources at the prison that Gregory&amp;#039;s voyeurism has been discussed by dozens of inmates. &amp;lt;br /&amp;gt;

The grievance further discusses Program Statement 5324.12 which cites that the BOP has &amp;quot;zero tolerance&amp;quot; for sexually abusive behavior and that perpetrators &amp;quot;will be disciplined and, when appropriate prosecuted&amp;hellip;&amp;quot; &amp;quot;It is my understanding that Gregory has not been placed on administrative leave and continues to work at the institution where the alleged sexual abuse occurred,&amp;quot; says Stewart. &amp;quot;Apparently, the BOP doesn&amp;#039;t take allegations of sexual abuse seriously of they would have conducted a thorough investigation by interviewing other inmates to determine if they had been subjected to the alleged sexual abuse,&amp;quot; contends Stewart. &amp;quot;Failure to deal with sexual abuse seems to be a common problem throughout the BOP,&amp;quot; says Stewart.&amp;lt;br /&amp;gt;
