H and C applications can be made from within Canada as well as from outside of Canada. However, the H and C statutory provisions exclude certain applicants, specifically persons found to be inadmissible to Canada pursuant to ss. 34, 35 and 37 of the Immigration and Refugee Protection Act (IRPA) on security grounds. If an applicant has been found inadmissible to Canada on one of these grounds, what are possible options to overcome such a finding and either remain in or come to Canada?&amp;lt;br /&amp;gt;

The process for overcoming an inadmissibility finding pursuant to ss. 34, 35 and 37 of IRPA is called an application for Ministerial Relief. S. 42(1) provides that a person can make an application for Ministerial Relief, which is a declaration from the Minister of Public Safety and Emergency Preparedness (the Minister) that the matters that gave rise to their determination do not constitute inadmissibility in the circumstances of their case.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
However, persons found to be inadmissible pursuant to s. 35(1)(a) of IRPA for commission of or complicity in genocide, war crimes or crimes against humanity, are precluded from making an application for Ministerial Relief.&amp;lt;br /&amp;gt;

As of March 10, 2017, there is a statutory framework for making such an application and a formal process, including an application form. Once an application is received, it will be assessed for being both eligible and complete and put in the queue for assessment based on the year of receipt. The Ministerial Relief Unit (MRU) of CBSA will review the application and submissions and make a &amp;quot;recommendation&amp;quot; to the Minister. CBSA&amp;#039;s recommendation will be provided to the applicant prior to being sent to the Minister. This will allow the applicant (and their counsel) to respond to any concerns and provide further documentation and submissions in support of the application before going to the Minister for determination.&amp;lt;br /&amp;gt;

A Ministerial Relief application can only be determined by the Minister &amp;ndash; it can not be delegated to an officer. Given that only the Minster can make the final decision, application processing times tend to be very lengthy. Recent statistics as of October 21, 2022, indicate processing times as fast as 2 years and as lengthy as 22 years with an inventory of over 300 cases. Processing times of 7 &amp;ndash; 10 years for Ministerial Relief applications are common.&amp;lt;br /&amp;gt;

Speaking to reporters, the Minister acknowledged that there may be unintended consequences from the increase in financial requirements, which are more than doubling from $10,000 to $20,635 to cover the first year of living expenses in Canada. Still, he felt it was necessary so students would not feel forced to work to make ends meet. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
International students have always been required to demonstrate they have enough financial resources to afford studying in Canada. Before the Minister&amp;#039;s announcement, students needed to demonstrate that they could afford the first year of expenses in Canada, including $10,000 for living expenses for a single person and additional funds for tuition and travel costs to come to Canada. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
However, given the current cost-of-living crisis, the Minister determined that the $10,000 amount requires updating to match current realities and to ensure that international students who come to Canada have realistic expectations about what it will cost to live here to complete their studies.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
As Canadian immigration lawyers, it is unlikely that increasing financial requirements will dissuade international students from applying for student visas. Families typically find a way to raise the needed funds to achieve an immigration goal, even if it means taking some extreme measures. For example, the Minister noted that it&amp;#039;s possible for several people to pool funds to send a student to Canada or that individuals will find ways to move money around to the prospective student&amp;#039;s bank account to make it appear they have enough funding.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
However, the Minister&amp;#039;s announcement will likely cause some far-reaching consequences. Lawyers at Sas and Ing have frequently met international students who have been refused student visas not because they did not have sufficient funds but because immigration visa officers found it unreasonable to spend so much on an education in Canada when there were possibly cheaper alternatives closer to home. In other words, even prospective international students who meet the higher threshold of having $20,635 or more for living expenses may experience higher rates of refusal because the overall cost of an education in Canada now represents a more significant percentage of their net worth or their family&amp;#039;s net worth. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Ultimately, based on the experience representing international students, the overall interest in coming to Canada to study will not likely wane until the root problems are addressed. Primarily, the intense interest comes from the fact that many international students are led to believe by unscrupulous immigration agents and others that it is an easy pathway to obtaining Canadian permanent residence.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Even the Minister seemed to acknowledge this fact when he stated that some families will do what it takes to meet the increased financial requirements if they feel that the student will help the family&amp;#039;s future. This might occur, for instance, if they believed that the student could one day become a permanent resident and sponsor the family to come to Canada or that the student could have a much higher earning potential in Canada after acquiring permanent status and will be able to support family members back home financially.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Contrary to popular belief, it is rather difficult for international students to become permanent residents without a planned and executed strategy. Many international students are unaware that English and/or French proficiency is a significant factor when determining whether they will be able to acquire permanent resident status and will spend most of their time in Canada speaking their first language outside the classroom. Many do not know that it is doubtful they will qualify for permanent residency without having already earned some skilled work experience back home. They may also be unaware that the work experience they earn while still a student in Canada does not count towards qualifying for permanent residency or be misled into believing that their chosen program of study in Canada will allow them to get a work permit after graduation.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
These are just some examples of the misconceptions regarding Canada&amp;#039;s International Student Program, all observed during years of immigration law practice. &amp;lt;br /&amp;gt;

Only time will tell whether the Minister&amp;#039;s latest announcement will improve the quality of life for the average international student in Canada and whether there will be a noticeable decrease in the number of international students in Canada. &amp;lt;br /&amp;gt;

Misrepresentation is an incredibly broad legal provision that covers things most people aren&amp;#039;t aware of (but probably should be). S. 40 of the Immigration and Refugee Protection Act (IRPA) defines what constitutes misrepresentation.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
s. 40(1)(a), a foreign national or permanent resident is inadmissible for directly or indirectly misrepresenting or withholding material facts relating to a relevant matter that induces or could induce an error in the administration of this Act.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The penalty for misrepresentation is set out in subsection 2:&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
s.40(2) The following provisions govern subsection (1):&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
(a) the permanent resident or the foreign national continues to be inadmissible for misrepresentation for a period of five years following, in the case of a determination outside Canada, a final determination of inadmissibility under subsection (1) or, in the case of a determination in Canada, the date that the removal order is enforced;&amp;hellip;&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Essentially, for anyone outside of Canada, the five-year period commences from the time of the decision, whereas for people In Canada, the ban starts after leaving the country.&amp;lt;br /&amp;gt;

SEEKING JUDICIAL REVIEW IN FEDERAL COURT&amp;lt;br /&amp;gt;

As in all immigration decisions, one option is to challenge the finding. This is not easy and is generally very expensive. A Judicial Review application can only be filed by a lawyer (or a self-represented applicant, which is not recommended). This requires extensive written submissions and Court arguments if the case is granted leave. Chances of success are low. The law is broad&amp;mdash;misrepresentation can be direct or indirect&amp;ndash;it does not require intent. If there is information relevant to the application that was not disclosed, the finding will be valid. Legal action is not always the best course of action. According to the Minister&amp;#039;s June 27, 2023 announcement, the Department of Immigration, Refugees and Citizenship Canada will accept applications under this category for the next year or until 10,000 applications are received, whichever comes first, and open work permits valid for up to three years will be issued to eligible applicants.&amp;lt;br /&amp;gt;

The BC PNP has historically offered a pathway to attract healthcare professionals. Still, it was constrained because it only applied to physicians, nurses and allied health professionals with job offers from public health authorities like the Fraser Health Authority and Vancouver Coastal Health. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
In reality, this &amp;quot;Health Professional&amp;quot; category (now aptly re-branded as the &amp;quot;Health Authority&amp;quot; category) excluded many essential workers in BC&amp;#039;s healthcare economy, most notably those who work in the private sector, such as in senior long-term care and assisted living homes.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Recognizing that there is a crucial shortage of healthcare workers in BC who offer essential services to the province and its citizens, the BC PNP introduced sweeping changes to its system, including the following:&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
-	The BC PNP expanded its Health Authority category by eliminating all occupation restrictions. People with a job offer in any occupation from a public health authority can apply to the BC PNP for a nomination for permanent residence.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
-	Healthcare assistants, including nurse aides and orderlies, previously classified as unskilled workers under Canada&amp;#039;s National Occupational Classification (NOC) system, became eligible to apply for a BC provincial nomination.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Furthermore, as of November 16, 2022, healthcare assistants are now classified as skilled workers under the newly implemented NOC 2021 system and will have access to both the BC PNP skilled worker stream and Canada&amp;#039;s federal immigration programs, namely the Canadian Experience Class and Federal Skilled Worker Class.&amp;lt;br /&amp;gt;

Finally, and most importantly, the BC PNP began to hold targeted draws for workers with job offers in a wide range of healthcare occupations. No longer prioritizing only physicians, nurses, and the nebulous category of &amp;quot;allied health professionals,&amp;quot; the BC PNP now publishes a list of nearly 40 priority health occupations, including social workers and counselling therapists, leaving no doubt for the public as to who will qualify to receive targeted draws as healthcare workers.&amp;lt;br /&amp;gt;

By offering targeted draws, the BC PNP directly increased the number of healthcare workers who will qualify to immigrate to the province by lowering the overall points requirements needed to receive an invitation to apply. This places healthcare workers on an even stronger footing than other skilled workers who may have previously been more competitive due to differences in language proficiency, education level, or wages.&amp;lt;br /&amp;gt;

Since March 10, 2022, the BC PNP has followed through on its plans to hold targeted draws regularly. The path to permanent residence in Canada for the medical profession has undergone seismic shifts. Over thirty years ago, many medical professionals, including doctors, were precluded from applying for permanent residence. At the time, there was a negative occupations list where doctors, nurses, dentists, teachers, lawyers and many other professionals were ineligible to apply for permanent residence through Canada&amp;#039;s independent application category (a precursor to the current Federal Skilled Worker (FSW) program).  &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
All this changed on June 28, 2002, with the introduction of the Immigration and Refugee Protection Act (IRPA). The negative occupations list was eliminated. However, this did not open the door for medical and other professionals to apply directly for permanent residence &amp;ndash; they still had to demonstrate that they could obtain licensing from the respective provincial or territorial licensing bodies, and that requirement remains to this day. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Many doctors have come to Canada on work permits obtained for remote regions. They first need to apply for and get a provisional licence from their regulatory licensing body, which allows them to work under the supervision of other doctors while undergoing a standard licensing process that includes studying for and writing Canadian exams. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The process is necessary and appropriate to ensure that foreign professionals can demonstrate they have the education and ability to perform their profession to Canadian standards. Similar requirements apply to most foreign professionals seeking to work in Canada. The process of coming to Canada to work and then progressing to permanent residence is longstanding. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The challenge for doctors is how they receive payment with Canada&amp;#039;s fee-for-service remuneration model. Most doctors are not employed in a traditional employer-employee relationship. Doctors frequently work in clinics, whether self-employed or in association with other doctors. Payment for service comes from provincial or territorial governments in the respective area based on the services provided for each patient. However, the fee-for-service model is characterized as self-employment by Immigration, Refugees and Citizenship Canada.  &amp;lt;br /&amp;gt;

Canada&amp;#039;s primary economic immigration stream is the Express Entry selection program. However, Express Entry only recognizes Canadian work experience as an employee. Self-employed work experience is not counted towards the Comprehensive Ranking Score (CRS) points system, leaving doctors, if not most, unable to qualify for permanent residence to Canada under the Express Entry selection system.   &amp;lt;br /&amp;gt;

The Return of Express Entry&amp;lt;br /&amp;gt;
Back in April, during a speech in Saint John, New Brunswick, Minister Fraser announced that Express Entry draws will resume and new invitations to apply (ITA) will be issued under Canada&amp;#039;s Express Entry system in July. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
On July 4, 2022, the Minister officially confirmed that Express Entry draws will resume on July 6, 2022, for the following skilled worker streams: Canadian Experience Class (CEC), Federal Skilled Worker (FSW) and Federal Skilled Trades Program (FSTP). To put this in perspective, the government suspended draws for the FSW and FSTP streams during the second wave of COVID-19 at the end of 2020 and then extended the pause to CEC draws by September 2021, effectively putting a halt on the entire Express Entry system for the past 10 months. Details are still forthcoming, so stay tuned.&amp;lt;br /&amp;gt;

Extensions of Post-Graduation Work Permits (&amp;quot;PGWP&amp;quot;)&amp;lt;br /&amp;gt;

Citing significant labour shortages in Canada, Minister Fraser also announced that former international students who have expired or expiring PGWPs will be eligible to apply for a further 18-month extension as workers. This policy is intended to allow foreign workers who are already employed to continue their work in Canada and to allow expired PGWP holders to get back to work to alleviate labour shortage issues. Once again, many are still waiting for details about the process.&amp;lt;br /&amp;gt;

New Pathway to Permanent Residency?&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
If all this isn&amp;#039;t interesting enough, the Minister has also been teasing a new fast-track pathway to permanent residency for those already living in Canada as either international students or foreign workers. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The &amp;quot;Temporary Resident to Permanent Resident&amp;quot; (TR to PR) pathway was touted as a once-in-a-pandemic policy to address Canadian immigration needs during a time when immigration from outside the country was actively discouraged.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
In a recent CBC article on June 11, Minister Fraser shared plans to create a similar pathway to the TR to PR pathway but noted that it won&amp;#039;t be identical.&amp;lt;br /&amp;gt;
The TR to PR pathway was unveiled with virtually no notice, which caused pandemonium for applicants who scrambled to obtain official language test results, police certificates, certified translations, and other documents and who had to rush to complete medical examinations during a pandemic. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
New application forms were being released specifically for this TR to PR pathway days before the pathway launched on May 6, 2021. Applications have also been processed slowly, and the Minister has recently authorized open work permit extensions until 2024 for applicants who are waiting for decisions on their permanent residency applications.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Interested applicants for this new fast-track pathway should learn from the lessons of the past: prepare immigration documentation, including language test results, as soon as possible and seek assistance from immigration professionals if you have any doubts about the Canadian immigration application process.&amp;lt;br /&amp;gt;

Parents and Grandparents (PGP) Program&amp;lt;br /&amp;gt;

Despite the head-turning number of new policies announced in recent months, there has been one area that the Minister has been largely silent on the return of the PGP program. Every year, tens of thousands of families wait with anticipation for the Minister&amp;#039;s announcements about how the PGP program will be implemented in the current year. Things like timing, documentation requirements, and the number of applications that will be received for the year are all matters of interest.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Although the Minister has been silent on the PGP program, on June 7, 2022, he announced improvements to Canada&amp;#039;s super visa program, which allows parents and grandparents of Canadian citizens and permanent residents to remain in Canada for extended periods. Unlike regular visitors who are generally required to leave Canada after six months, super visa holders will now be able to stay in Canada for five years at a time without leaving and will also be eligible to apply for a further two-year extension for an unprecedented total of seven years in Canada.&amp;lt;br /&amp;gt;

On April 4, 2022, the Department of Employment and Social Development Canada (&amp;quot;ESDC&amp;quot;) announced new Temporary Foreign Worker Program policies that will make it easier to hire temporary foreign workers through the Labour Market Impact Assessment process. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
To fully appreciate the significance of EDSC&amp;#039;s new policies, it is helpful to look back to the years between 2012 and 2014 when there were commonly held perceptions that the government was not doing enough to ensure that Canadians were being considered for job openings and that it was too easy for employers to obtain LMIAs (previously called &amp;#039;Labour Market Opinions&amp;#039;) for permission to hire TFWs.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Due to these sentiments, ESDC implemented policies in 2014 that included, among other things, the introduction of a $1,000 LMIA application fee for each TFW that an employer wanted to hire and a &amp;#039;cap&amp;#039; on how many low-wage TFWs a company could hire in the workplace. These broad policies were put in place to send a clear message that Canadian employers should only hire TFWs on an exceptional basis where qualified Canadians are not available to fill a job opening.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Fast forward to 2022 and the tables have now turned in favour of facilitating the hiring of TFWs through the LMIA process. Below are some of the most significant changes: &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
1) Increasing the Cap on Low-Wage Workers&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Before the policy announcement, employers with 10 or more employees were subject to a cap that prohibited them from having a workplace that was made up of more than 10% of low-wage TFWs. For example, a workplace with 20 total workers could not employ three low-wage TFWs because they would proportionally represent 15% of the workers in that workplace.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Citing 2020 data that TFWs made up less than 0.4% of the overall Canadian workforce, effective immediately ESDC has increased the low-wage TFW cap to 20% for all employers hiring full-time TFWs. Canadian employers suffering from labour shortages can now apply to ESDC to hire more low-wage TFWs than before to fill these shortages.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
2) More time to Onboard Foreign Workers&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Before the pandemic, newly approved LMIAs, which authorize a Canadian employer to hire a TFW, expired in six (6) months. Practically speaking, this meant that employers had no more than six months from the time of approval to find a TFW to fill the position and that the TFW needed to apply to Immigration, Refugees and Citizenship Canada (IRCC) for their work permit before the LMIA expired.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
On April 4 ESDC announced that they will extend the validity period of all approved LMIAs to 18 months, which will give employers more time to interview, screen, and bring TFWs to Canada.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The new policies will benefit employers who have experienced challenges bringing TFWs to Canada even after an LMIA is approved. Specifically, there are instances where TFWs are refused work permits by IRCC. This may be for various reasons, including a lack of supporting documentation and a clear understanding of the eligibility requirements for a work permit. Extended periods to onboard TFWs will allow employers to make alternative hiring plans in the case of an unexpected work permit refusal.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
3) Increase in Employment Duration&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Before ESDC&amp;#039;s announcements, TFWs could not be approved under an LMIA to work in Canada for more than two years. This meant employers had to make repeat LMIA applications to keep the same TFW(s) employed every few years, which added to the cost of doing business but also greatly added to ESDC&amp;#039;s workload of processing new applications year after year, even when there was a demonstrated labour shortage.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The April 4 policies increase the maximum employment duration allowed under an LMIA from two (2) years to three (3) years for high-wage TFWs (currently defined in British Columbia as those earning more than $25 per hour) and those applying under ESDC&amp;#039;s Global Talent Stream, which will greatly benefit all parties involved&amp;mdash;employers, TFWs and ESDC.&amp;lt;br /&amp;gt;

Consider the circumstances of a business applicant recently assisted in coming to Canada. This individual had run his own business for nearly ten years with locations in India and Dubai. He travelled to Canada and the US for business purposes, demonstrating his legitimacy in seeking to establish in Canada. He had an ECA confirming his Master&amp;#039;s Degree and an IELTS test with scores of CLB 9 and 10. Even with a high level of education and language proficiency, he did not presently score sufficient CRS points to receive an ITA under Express Entry.&amp;lt;br /&amp;gt;

The strategy was to obtain an ICT work permit under NOC 0013 as the CEO/President of his Canadian company. After one year of working in Canada, he will garner 200 adaptability points, thereby meeting the Express Entry scores to obtain an ITA. &amp;lt;br /&amp;gt;

There are various reasons people feel compelled to misrepresent their case&amp;mdash;and these can be complicated. A small amount of misrepresent is because they want to take shortcuts and have no problem doing things like preparing fraudulent documents. However, the vast majority fall somewhere in between and will misrepresent (or consider it) because they believe there is no other choice.&amp;lt;br /&amp;gt;

The first common reason is that people have previously committed an immigration infraction, or they have a criminal record and they are afraid of the consequences. These might include:&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
- a previous criminal record.&amp;lt;br /&amp;gt;
- periods of illegal work or study.&amp;lt;br /&amp;gt;
- Staying in Canada without status.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
In such circumstances, an applicant may be tempted to withhold information. Ironically, not all immigration infractions are equally serious. Misrepresentation is the most serious offence. In fact, many immigration infractions and even criminal records can be overcome through different legal mechanisms, and this can sometimes occur simply by the passage of time.&amp;lt;br /&amp;gt;

The second most common reason people choose to misrepresent is they are told refusal rates are high for their country&amp;mdash;and the best way to move forward is getting into the country to improve their chances of staying. &amp;lt;br /&amp;gt;

Each of these cases can be, and often is treated as a misrepresentation.&amp;lt;br /&amp;gt;

It never pays to be inconsistent in an immigration application. A person who says one thing but does another is not trustworthy in the eyes of an immigration official who can and often does refer back to previous applications to see what was declared regarding their intentions in Canada.&amp;lt;br /&amp;gt;

Furthermore, eligibility for a temporary visa or for permanent residency doesn&amp;#039;t change for people inside or outside of Canada.&amp;lt;br /&amp;gt;

    <title type="text">Venue for New Mexico Civil Rights Act Lawsuits: Home Court Advantage for Counties Is Over</title>

The venue requirements have forced plaintiffs in personal injury and wrongful death claims against counties to file their lawsuits in the county itself. Fortunately, this often harsh venue requirement is absent from the New Mexico Civil Rights Act.&amp;lt;br /&amp;gt;

New Mexico Tort Claims Act Venue Requirement&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
It should be noted that there are different venue requirements for lawsuits against the State of New Mexico and its agencies, and the venue requirements for claims against a county. Venue for lawsuits against the State of New Mexico is always proper in Santa Fe. However, for lawsuits against New Mexico counites, the suits must be brought in the county itself as stated by N.M. Stat. Ann. &amp;sect; 41-4-18:  &amp;quot;Venue for all other claims pursuant to the Tort Claims Act, shall be in the county in which the principal offices of the governing body of the local public body are located.&amp;quot;&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
As one might imagine, and for good reason, filing suit against a county in the county itself can and does result in what some might call home-town advantage to the county. The problem is particularly problematic in some of the counties that border Texas which seem at times to have adopted Texas style justice which is not at all friendly to personal injury and wrongful death victims or their families. These courts can be particularly unfair to victims of police and jail abuse.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Venue Under the New Mexico Civil Rights Act&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
There is no such home-town advantage for counties under the New Mexico Civil Rights Act. Under House Bill 4 (not yet been codified into a New Mexico statute), the venue for a civil rights lawsuit under the New Mexico Civil Rights Act (H.B. 4) against any public entity is proper in any New Mexico District Court:&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
&amp;quot;B. A person who claims to have suffered a deprivation of any rights, privileges or immunities pursuant to the bill of rights of the constitution of New Mexico due to acts or omissions of a public body or person acting on behalf of, under color of or within the course and scope of the authority of a public body may maintain an action to establish liability and recover actual damages and equitable or injunctive relief in any New Mexico district court.&amp;quot;  NM LEGIS 119 (2021), 2021 New Mexico Laws Ch. 119 (H.B. 4)&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The language in H.B. 4, Paragraph B means that these cases can be brought anywhere in the State. Plaintiffs need no longer subject themselves to Texas style justice on the Texas border or anywhere else.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Unanswered Liability Caps Questions Regarding Venue&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
One interesting as of yet unanswered question regarding venue is the question of liability caps on these cases. Liability caps set a limit on the amount that a personal injury or wrongful death victim can obtain through court. Under the Tort Claims Act, the cap is $700,000 for personal injury claims but only $400,000 for wrongful death claims. This is due to the allowance of up to $300,000 past and future medical expenses that may not be present in a wrongful death lawsuit. Either way, the Tort Claims Act cap on liability for governmental entities is obscenely low.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The New Mexico Civil Rights Act raised the cap to $2 million per occurrence. In addition, the $2 million is not exclusive of other remedies or damages. In other words, a person injured by a governmental entity for civil rights abuses such as a police misconduct or jail misconduct can still seek the full cap under the Tort Claims Act above and beyond the $2 million caps under the Civil Rights Act.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The question that has yet to be answered is whether a plaintiff will be forced to file the Tort Claims separately in the subject county or whether the plaintiff will be able to file both the civil rights claims and tort claims in a county where home-court biases of local jurors and judges can be avoided and justice for the victim is possible.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Risks Associated with Filing Suit in Unfavorable Venues&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Like the federal courts, police and jail misconduct lawsuits are viewed with disfavor in some counties. There is a very real risk of getting home-towned in some counties if civil rights lawsuits under the New Mexico Civil Rights Act are filed there. It would be perhaps unwise to do so when an alternative more favorable venue is available. This is particularly so given the $2 million caps under the Civil Rights Act. The $400,000 cap on wrongful death claims under the Tort Claims Act would make it exceedingly unwise to proceed in a county unfriendly to victims of police or jail abuse unless this was the only possible venue.  Fortunately, this is no longer the case. Filing in a court more prone to do justice in these cases is now allowed and will soon become the norm.&amp;lt;br /&amp;gt;

The New Mexico Supreme Court drawing on prior law and what would seem to be basic common sense to find that indeed there is such a duty.  &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The basic facts are as follows.  Two intoxicated patrons entered a gas station. They arrived at the gas station without a vehicle or even a gas can to fill. Instead, in the presence of the clerk, they emptied a gallon of water so they could fill it with gas. Initially, knowing the two were intoxicated, the clerk refused to sell them anything but later relented selling them the gallon of gas with which they returned to their vehicle on foot. The two intoxicated individuals then returned to the same gas station and purchased additional gasoline. After dropping off his passenger, the driver then had a head-on collision with another vehicle killing the driver of that vehicle.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
A lawsuit was filed in federal court because the defendant was a tribally owned entity. The federal court recognized New Mexico&amp;#039;s doctrine on negligent entrustment of chattel property. Chattel property is simply property that is not land or real estate. Under negligent entrustment, an owner or controller of chattel has &amp;quot;a duty to others not to give control of a dangerous instrumentality to a person incapable of using it carefully.&amp;quot; The federal court recognized also that there was no clear New Mexico law on whether the sell of gasoline fell under the doctrine and sent the case to the New Mexico Supreme Court for a ruling on the issue.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
New Mexico has long recognized the doctrine of negligent entrustment of chattel as a viable legal claim. Thus, the key element is negligence, and it is clearly negligent to allow someone to use your property knowing that the person will use it negligently or recklessly creating an unreasonable risk of harm to others.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
There is a general doctrine of reasonable care which places a duty on individuals, entities and groups to exercise reasonable care in dealings and activities with the public. Until Morris v. Giant, there was no specific law or case-law finding a duty not to sell gasoline to intoxicated drivers. The Court In Morris v. Giant reiterated prior case-law recognizing that a duty of care should be found only when public policy considerations suggest the necessity of the duty. Moreover, the existence of a duty is not determined by foreseeability of harm which is a question for the jury. Instead, the existence of the duty must be determined as a matter of law which in turn is a matter of public policy.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
There are numerous cases expressing public policy on the matter of negligent entrustment. In automobile cases, it is negligent, and one may be held liable for any automobile accident allowing someone that the owner of the vehicle knows to be drunk, reckless or otherwise incompetent to operate a vehicle. Dram shop laws prohibit bar and restaurant staff from serving obviously intoxicated patrons. These same laws apply to homeowners hosting parties with alcohol. In fact, the cases go so far as to provide for claims by the drunk patron or guest himself if he gets in a car accident. New Mexico has clearly expressed a public policy of reducing DWI accidents in the State. In fact, dram shop laws are extremely broad allowing for numerous possible claims for service of drunk patron or guest.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
It is important to note that there is no duty to investigate whether a customer or patron is intoxicated. In other words, neither bar, restaurant, homeowners nor gas station attendants must test the customer&amp;#039;s blood alcohol or conduct field sobriety tests on the customer. However, it is pretty well established both by common sense and law that one need not be police officer or other professional to tell when someone is showing signs intoxication. Whether or not the gas station attendant, just like bartenders, wait staff or homeowners, knew or should have known the person was intoxicated will be a fact question for the jury. If a person is drunk and gets behind the wheel, it is beyond debate that this would present a foreseeable risks of harm to others.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
There has already been a bit of an uproar over the decision. Basic common sense and law suggests the outcome of the case is proper and justified. With the law as stated, it seems clear that the entrustment of gasoline which is chattel would be covered. Why should gas stations be immune from the doctrine of negligent entrustment? The burden is not great. It simply requires that an attendant not sell gasoline to an obviously drunk driver. The pushback will come primarily from the oil and gas industry along with its retail gasoline outlets. So perhaps, it is the sale of gasoline that is sacred and somehow immune from the rules that the rest of society must follow. In the case of gasoline, would it not be negligent and actionable to sell gasoline to a known arsonist?     <title type="text">Centurion Presence Coincidental in New Mexico Prison and Jail Deaths?</title>

What is the common denominator in all these deaths? Centurion Correctional Healthcare of New Mexico (Centurion) was the medical contractor providing medical care to those deceased inmates. The question is whether or not this is purely coincidental?&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Centurion Lawsuits&amp;lt;br /&amp;gt;
As of the writing of this article, &amp;lt;a href=&amp;quot;https://&amp;lt;a href=&amp;quot;http://www.collinsattorneys.com/&amp;quot; target=&amp;quot;_blank&amp;quot;&amp;gt;http://www.collinsattorneys.com/&amp;lt;/a&amp;gt;&amp;quot;&amp;gt;Collins &amp;amp; Collins, P.C.&amp;lt;/a&amp;gt; has filed 18 lawsuits against Centurion. Sadly, again according to the Albuquerque Journal, Samuel was one of six MDC inmates that died during detox.&amp;nbsp; One detox death is inexcusable.&amp;nbsp; Six approaches criminality.&amp;nbsp; Until that lawsuit, the firm had not filed any lawsuits against MDC. Rather, the lawsuits were limited to New Mexico Corrections Department (NMCD).&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Centurion according to the contract with MDC took over medical care at the facility on January 1, 2020 with a first year compensation base of $13 million. These 18 lawsuits will by no means be the last. It is expected that there will be additional lawsuits arising out of Centurion&amp;#039;s medical services at MDC. Likewise, there will likely be additional lawsuits arising out of NMCD medical care despite the fact that Centurion vacated the contract in November 2019.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Centurion Vacated NMCD Contract Early&amp;lt;br /&amp;gt;
The original contract between NMCD and Centurion was for 3 years. The term had been extended for one year so the contract should have ended around June of 2020. However, Centurion as mentioned above vacated early in November 2019.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Centurion Vacating MDC Contract Early&amp;lt;br /&amp;gt;

Assuming the press reports are accurate, Centurion will be leaving about 2.5 years early on its 4 year contract. It is not known yet why Centurion is leaving but that is certainly something that Collins &amp;amp; Collins, P.C. will be exploring in its most recent lawsuit against MDC and Centurion.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Centurion Cannot Exit New Mexico Soon Enough&amp;lt;br /&amp;gt;
Centurion&amp;#039;s performance in New Mexico prisons and jails is appalling to say the least. This can be judged purely on the basis of the number of deaths at NMCD and MDC under Centurion&amp;#039;s medical watch. However, it is much worse than that. The clients of Collins &amp;amp; Collins, P.C. have suffered severe and permanent injuries at best while a number have died under the care of Centurion. Keep in mind that Collins &amp;amp; Collins, P.C. is a small firm among many law firms in New Mexico. There have been many other suits filed by other firms with equally devastating and avoidable injuries arising out of the callous medical neglect of New Mexico inmates.&amp;nbsp; Likewise, there have been other deaths.&amp;nbsp; Worse still, the true toll of Centurion&amp;#039;s tenure in New Mexico is not known as few inmates actually file suits for many reasons which are beyond the scope of this article.&amp;nbsp; In addition, NMCD deaths resulting from Centurion&amp;#039;s gross incompetence are likely far higher than the 72 identified since deaths that occur outside NMCD premises do not show up in Office the Medical Investigator reports.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The toll on inmates and their families is incomprehensible.&amp;nbsp; The &amp;lt;a href=&amp;quot;https://&amp;lt;a href=&amp;quot;http://www.collinsattorneys.com/profit-margins-negligent-prison-medical-care-and-new-mexico-taxpayers/&amp;quot; target=&amp;quot;_blank&amp;quot;&amp;gt;http://www.collinsattorneys.com/profit-margins-negligent-prison-medical-care-and-new-mexico-taxpayers/&amp;lt;/a&amp;gt;&amp;quot;&amp;gt;toll on New Mexico taxpayers has not been measured but the costs associated with medical neglect in NMCD facilities is enormous&amp;lt;/a&amp;gt;.&amp;lt;br /&amp;gt;

Prison and Jail Medical Care Unlikely to Improve&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Even if Centurion leaves the state completely, the medical care for New Mexico prison and jail inmates will not improve as things stand now. With regard to the state&amp;#039;s prisons, the big problem is NMCD itself. NMCD is a renegade agency, chocked full of corruption, incompetence, and deliberate cruelty. NMCD simply does not care about constitutionally adequate medical care. If it did, why would it keep the same medical providers as the medical contractors come and go. That&amp;#039;s right, the individual medical providers, including doctors, physicians assistant, nurses and others, remain the same after one contractor leaves and the next takes over. It is not a change in medical care, it is simply a change in payee on the checks written by the taxpayers of New Mexico. Even worse, the contractors are on a revolving plan. One contractor gets fired or leaves, the next one steps in. This would not be so bad, but NMCD simply fills the slot with medical contractors that had already failed in the State. This will likely be the same with MDC which is illustrated by the fact that MDC hired Centurion to begin with despite the large number of suits filed against Centurion both in New Mexico and other states.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Centurion Involvement Coincidental?&amp;lt;br /&amp;gt;
Perhaps coincidental is not the right word. Centurion just happens to be the payee on the checks now written by MDC and formerly the checks written by NMCD. It is not coincidence. It is standard operating procedure on the part of New Mexico prison and jails. They rotate the same bad actor medical contractors from one contract term to the next.&amp;nbsp; At the same time, the same incompetent and too often deliberately cruel individual medical providers stay in place from one medical contractor to the next.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;

In short, the NMCD medical grievance system is corrupt and unconstitutional.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Many Lawsuits Filed Against NMCD and Its Medical Providers&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Collins &amp;amp; Collins, P.C. has filed numerous lawsuits against NMCD and its medical providers alleging grossly negligent, deliberately indifferent and intentionally cruel failure to provide medical care.  Evidence gathered through these lawsuits indicate that not a single inmate medical grievance was found in favor of an inmate by NMCD from June 2016 to November 2019.   The firm has been unable to obtain more recent data from NMCD. It is fully expected that the same level of absolute indifference to the medical neglect of NMCD inmates will be found. NMCD simply does not seem to care one way or the other whether inmates are provided constitutionally adequate healthcare.&amp;lt;br /&amp;gt;

Purpose of Abuse of Medical Grievance Process is to Deny Inmates Access to Courts&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Under both federal and New Mexico law, inmates must exhaust all administrative remedies prior to filing suit in either federal or state court. This is called exhaustion of administrative remedies (exhaustion). In the context of the prison medical grievance process, this means that the inmate must fully complete the medical grievance process. This in turn means filing the right paperwork within the deadlines set by NMCD. The prison medical grievance system is a maze of confusion and obfuscation. It is intentionally so. The point is to set traps for inmates who are rarely educated to the degree necessary to follow the byzantine and often contradictory grievance procedures. If an inmate fails to file all the right paperwork within the deadlines in the form mandated by NMCD, the inmate cannot file suit in court now matter how horrible the medical neglect and consequent injuries to the inmate.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The deliberately confusing and often contradictory grievance procedure requirements are alone sufficient to hold the medical grievance system unconstitutional. However, there is far more to it than that.&amp;lt;br /&amp;gt;

Retaliation for Filing Medical Grievance Process&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The abuses and obstructions of the medical grievance process are far too numerous to enumerate here. However, they have been enumerated in a lawsuit filed against NMCD by Collins &amp;amp; Collins, P.C. attacking the constitutionality of the medical grievance process. The list of abuses and obstruction is very lengthy though certainly not exhaustive. NMCD inmates have reported directly to Collins &amp;amp; Collins, P.C. the many abuses and obstructions of the grievance process. One of the most frequently reported abuses is retaliation for filing grievances. It seems that NMCD grievance officers often also serve as disciplinary officers. This is most definitely the case at a number of facilities including Central New Mexico Corrections Facility in Los Lunas, New Mexico. This fact alone suggests that the medical grievance process and procedures are unconstitutional.&amp;lt;br /&amp;gt;

Retaliation for Questioning the Constitutionality of NMCD Medical Grievance Process&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Collins &amp;amp; Collins, P.C. has significant direct experience with its own clients being retaliated for filing grievances (or for talking to Collins &amp;amp; Collins, P.C. generally). This is in fact what precipitated the PETITION. In fact, the high probability of retaliation for joining in the PETITION is conveyed to the inmates before allowing them to join in the lawsuit. This was done as a matter of both professional ethics and concern for inmates getting into something more than they expected. The inmates are extremely brave in joining the suit, each fully understanding the almost certain retaliation against them for doing so.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
In fact, many of the inmates were retaliated against prior to the suit even being filed. Inmates lost privileges, have lost good time and at least one was placed in solitary confinement after her legal mail from Collins &amp;amp; Collins, P.C. was opened and read. This in turn resulted in numerous meetings  involving inmates, NMCD and its prison management contractors warning inmates against contacting Collins &amp;amp; Collins, P.C.  Surprisingly, these meetings were held in open prison pods with numerous witnesses. NMCD and its contractor have taken to individual interrogation of inmates about their relationship and conversations with Collins &amp;amp; Collins, P.C. The end result of one such interrogation was  transfer from Western New Mexico Correctional Facility to Spring Correctional Facility which is facing closure due to its abhorrent conditions.  Even more shocking the inmate was placed in solitary confinement upon arrival at Springer.&amp;lt;br /&amp;gt;

NMCD Fraud on the Courts&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
In every case filed by Collins &amp;amp; Collins, P.C., NMCD has filed a Motion for Summary Judgment seeking dismissal of the lawsuits due to alleged failure of the inmates to exhaust administrative remedies. According to NMCD it seems, no inmate ever files a proper medical grievance. The allegations are clearly fraudulent and in fact NMCD has been caught in its attempted fraud on the courts. However, this is not enough. NMCD should be stopped in its tracks to prevent it from filing these fraudulent Motions for Summary Judgment against inmates. Failure to dismantle the NMCD medical grievance system will allow NMCD to continue its frauds on the court in every inmate lawsuit. Beyond its unconstitutionality, the medical grievance system along with the legal exhaustion requirements places an enormous and unnecessary burden on the Court.&amp;lt;br /&amp;gt;

Toss NMCD Medical Grievance System Completely&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
The entire NMCD medical grievance system must be thrown out. It is a case of the fox guarding the hen house. The entire system is geared toward denying NMCD inmates adequate medical care and then access to the courts when disaster strikes with permanently disabling injuries or death to the inmates. NMCD simply cannot be allowed to continue to control and manage the prison medical grievance process. NMCD&amp;#039;s control and management of the prison medical grievance system is an ongoing affront to the New Mexico Constitution, an embarrassment to the State, and an extraordinary burden on New Mexico taxpayers.&amp;lt;br /&amp;gt;

The new policies extend to temporary foreign workers in 40 health-care-related occupations, such as nurses, social workers, and doctors, as well as workers in 95 other occupations, which include a variety of essential occupations ranging from cashiers to caregivers to factory workers. Recognizing that the Covid-19 pandemic has compromised Canada&amp;#039;s economic growth, the new policies aim to appreciate those foreign nationals already in Canada who have been actively contributing to our economy during this challenging time. &amp;lt;br /&amp;gt;

In October 2020, IRCC announced the 2021-2023 Immigration Levels Plan to support our economic recovery through increasing immigration to Canada. IRCC announced a target of 401,000 foreign nationals would be granted Canadian Permanent Residence in 2021. These new policies are designed to assist in meeting these immigration targets.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Under the newly announced pathways for essential temporary workers and skilled international graduates, IRCC intends to grant permanent residency to 90,000 eligible applicants currently in Canada. Temporary workers wanting to take advantage of the new pathway are required to have a minimum of 1 year of full-time or equivalent part-time Canadian work experience within the previous three years.  Work experience must be in a recognized health care profession or other listed essential occupation. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
International graduates must show completion of an eligible Canadian post-secondary program within the previous 4 years, completed no earlier than January of 2017.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
Applicants will be able to submit their applications electronically to IRCC as of May 6, 2021, until November 5, 2021, or until the maximum intake caps have been reached. &amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
IRCC will be accepting 90,000 applications under the following categories:&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
1.	Temporary workers in health care: 20,000 applications will be accepted&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
2.	Temporary workers in other selected essential occupations: 30,000 applications will be accepted&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
3.	International graduate students: 40,000 students will be accepted.&amp;lt;br /&amp;gt;
&amp;lt;br /&amp;gt;
In addition to the 90,000 new immigrants under these pathways, the Minister is also is encouraging French-speaking nationals or bilingual candidates to apply under these streams as the intake limits will not apply to them. This initiative is in line with the Federal Government&amp;#039;s goal of supporting French-speaking communities and retaining French-speaking nationals who are living and working outside Quebec.&amp;lt;br /&amp;gt;
