Insurance Companies May Be Cracking Down on Old Roofs

According to a recent article, some homeowners in Tampa Bay have been sent letters from their insurance companies stating that they must repair their roof or risk losing coverage.

Miami, FL -- (SBWIRE) -- 03/10/2021 -- The letters are raising concern among homeowners, especially those who may not be able to afford a new roof. According to the article, homeowners say that an insurance agent should at least come to the property to inspect the roof to see whether it has to be replaced.

To make matters worse, two Tampa Bay State Senators are sponsoring bills that will allow insurance companies to provide policies that change roof premiums to the actual cash value if the roof is older than ten years.

While this trend appears to be limited to the Tampa Bay area, there is always the possibility the practice may eventually extend to South Florida.
Hurricane Season Is on the Horizon

February is already here, and only a few months remain before the official start of hurricane season. The home, as well as the homeowners’ insurance policy, should be examined soon to ensure everything is working and correct.

Miami, FL -- (SBWIRE) -- 02/18/2021 -- Review the home inventory and, as required, make the appropriate tweaks. Since the last time the inventory was created, homeowners could have acquired new high-end items. Unforeseen accidents can arise at any moment, and homeowners may find that if it's time to make an insurance claim, by providing a record of what was lost or damaged, the claims procedure may prove to be immeasurably simpler.

Determine the last time a home inspection was done. A leak or break can pass through unnoticed, but it can be incredibly expensive to see the consequences of such a leak. A roof leak, for instance, will silently and seriously harm the wood over the long-term.

Pay careful attention to the terminology outlined in the insurance contract for homeowners and see what adjustments will need to be made. A lot can change in a year, and coverage may need to be upgraded.

Smart Tech May Help Avoid Pricey Insurance Claims

In many households, smart home technology has become popular, making the home possibly safer, possible privacy issues aside. In principle, alarms and smoke detectors are more integrated than ever, avoiding a situation from being worse or contributing to disaster thanks to their robust technology.

Miami, FL -- (SBWIRE) -- 01/20/2021 -- Insurance companies have noted what smart home systems can do in keeping homes safe. As a result of high-resolution cameras and cutting-edge sensors, the technology helps reduce the likelihood that a small issue can lead to a big payout. Burglars, fire, and even earthquakes are a couple of examples of how this technology can aid. As smart software offers near-instant warnings, the damages are small, meaning lawsuits do not need to be just as high because of minimal injury as compared to significant damage. In exchange, insurance companies win and homeowners may avoid likely long lawsuits or, worse, a denial of claims.

There may be a situation in which a homeowner may have to deal with insurance companies denying a claim or failing to provide adequate funds for damages. If issues arise with an insurer or support in dealing with a claim is needed, the law firm of Alonso Perez LLP can help.

A Basic Introduction to Homeowners Insurance

As the year begins to wind down, one of the 2021 resolutions people may have is becoming homeowners. Most people will likely need to apply for a mortgage, which means a homeowners insurance policy will be required by the lender.

Miami, FL -- (SBWIRE) -- 12/11/2020 -- Insurance for homeowners is a type of coverage that includes money if your house or personal property is affected by anything like an accident, fire, or a natural disaster. Personal liability compensation may also be included, which acts as insurance should a physical injury or collateral harm case be brought against you.

Depending on your location, coverage requirements, and home and property values, insurance premiums for homeowners can be costly. Coverage is optional if your home doesn't have a mortgage attached, and some policyholders may decide to have their coverage expire after their mortgage obligation has been met. Despite this, about one in twenty homes have to file an insurance claim. Even though premiums are expensive, the repair costs may be worse without insurance.

A simple or no-frills homeowners' insurance can be inadequate to sufficiently protect a home from certain hazards in particular circumstances or locations. Most specific policies provide damage coverage if, for example, tornadoes and hurricanes happen. Losses from wildfires are typically covered for homeowners by a standard policy. In areas that are extremely vulnerable to wildfires, however, insurance, at least from regular insurers, can be a costly and complex process to obtain. In some states, Florida among them, there are state-backed insurance companies that sell policies that cover wildfire risks.

Home Insurance Inspections and Home Inspection Differences

Home insurance inspections vary from a regular home inspection since the latter is usually so that the homeowner knows the home is in sound condition. For example, homeowners would want to be sure that the house has no major structural flaws, such as defective wiring. A home insurance inspection, conversely, allows the insurance company to gauge the home's cost of repairs. That is also how the insurance company assesses risk to measure the probability that the homeowner may need to file a claim for damages and find out the amount of the premium.

Miami, FL -- (SBWIRE) -- 11/24/2020 -- Each inspection has its unique aspects, but the inspector will usually take a closer look at factors such as the age and quality of the structure, external risks, ventilation, flooring and wall surfaces, any anti-theft steps, and, the quality of the HVAC system, for example. With that in mind, homeowners may want to be prepared for the inspection, which includes inspecting the roof for loose shingles, removing leaves from gutters, overhanging trees, examining walls, siding, and doors for gaps or exposure to water, and even checking pipes for leaks.

With the utmost preparation, the less likely the chances are that a homeowner's insurance claim will be denied by the insurance company.

The Rise of the Hurricane Deducible

Most homeowners are aware of the insurance deductible but there may also be a hurricane deductible. These hurricane deductibles have some deviations from those of a conventional home insurance policy. They are meant to address storm destruction, as the name suggests, and they correspond to a percentage of a home's worth. Homeowners may wish to look into their policy to see if such a deductible exists.

Miami, FL -- (SBWIRE) -- 10/15/2020 -- The two major kinds of damage from hurricanes are wind and flooding. With more people residing in coastal areas and larger and more frequent storms, insurers have experienced rising expenses, and homeowners were faced with alarmingly elevated home insurance rates. Hurricane insurance was provided as a way for homeowners to overcome increasing risks and costly insurance rates. Requiring a distinct hurricane deductible allows insurers to better accurately measure hurricane risk. By distinguishing damage incurred by weather which is and is not catastrophic, such as a windstorm compared to a category five hurricane, insurers can also have competitive homeowner insurance premiums.

Understanding Hazard Insurance

Hazard insurance and homeowners insurance are may seem confusingly similar. Notwithstanding its name, hazard insurance is not an entirely different policy, it is an integral part of the policy of a standard homeowners’. This is the part that will take care to rebuild a home's foundation and contents should there be a natural disaster.

Miami, FL -- (SBWIRE) -- 09/23/2020 -- The rest of the homeowners' insurance will protect you from injury, loss, or thieves. Homeowner insurance also addresses medical bills if a person happens to be injured and/or suffers an accident in your home, along with legal expenses if they want to seek legal action as a result of the accident sustained.

Each insurer has its list of "approved" natural disasters. Those happen to usually be weather events such as tornadoes and floods, for example. If a natural disaster damages the home or personal belongings, a claim is submitted and filed and the homeowner seeks reimbursement for the repairs. These repair costs would likely be up to the homeowner without the hazard coverage of the homeowners' policy if, for example, a freak windstorm or fire has caused catastrophic damage to the home. The homeowners would also need to take care of the repair of the appliances, plumbing, flooring, and roof.

Avoiding Common Pitfalls with Home Insurance

Hurricane Sally is one of the many storms that have contributed to an especially active 2020 hurricane season. With the emergence of more storms, it's crucial to be prepared in regards to home insurance and that means being aware of common pitfalls that may lead to expensive repairs.

Miami, FL -- (SBWIRE) -- 09/23/2020 -- Think hard about flood insurance. Flood insurance is a separate, discretionary purchase for many homeowners though it may be needed if the home is mortgaged. Remembering that typical insurance plans for homeowners do not cover flooding, it's a strong consideration to take into account. A mere inch of water can result in thousands of dollars worth of damage.

Have a clear awareness of the deductible and how it works. New homeowners could make the mistaken assumption that it's better to pay the lowest possible premium to keep expenses low. Although it may seem logical, homeowners should remember that a decreased premium tends to result in a higher deductible. This means requiring more out of pocket expenses before the insurance will provide coverage, and if the home is damaged, it might prove expensive.

Protect the Roof During Hurricane Season

Florida is notorious for being affected by hurricanes and major storms. Because hurricane season doesn’t come to an until November is over, homeowners may wish to use the downtime to ensure the roof is in the best shape to withstand a storm or damage.

Miami, FL -- (SBWIRE) -- 08/24/2020 -- Whether the roof is new or if it's one that has endured many weather conditions, there are ways to protect it without spending a ton of money. One way is to take a close look at the gutters and clean them out about twice a year at least. Clearing the gutters of leaves reduces odds of clogging which means fewer chances of wall or siding damage.
Doing a bit of tree trimming can do wonders. Aside from cutting down on branches damaging the home and leaves gathering, the removal of branches that may overhang reduces the chances that animals such as possums will enter the home or the roof. These animals are known for chewing on wires and other objects, causing damage internally.

Shingles may come off or they may become loose, especially on older roofs. Using binoculars is one way to safely spot for them instead of climbing onto the roof and putting one's safety at risk.

Preparing for a Hurricane

Hurricane season has arrived and weather analysts believe it may be an especially active one. In case a big storm wants to pay a visit to South Florida, homeowners will likely want to start planning. The following tips may seem familiar but worth discussing, particularly for first-time homeowners who have yet to experience a hurricane's destructive force.

Miami, FL -- (SBWIRE) -- 07/06/2020 -- Find a safe place to stay in the event evacuation becomes necessary. FEMA has an app with information regarding emergency shelters nearby. For personal vehicles, ensure there is at least half a gas tank in them whenever possible. Homeowners may want to look into keeping supplies like a flashlight, first aid kit, batteries, and backup phone charging batteries available. Keep a comfortable bag packed with clothing and any drugs that need to be brought along. Any friends or family from out of town could be used as contacts to keep everyone current regarding what's going on.

Keep an eye on windows and doors, and make sure there is strong reinforcement or that they are strongly secured. Take a look at the drains and gutters to wipe out debris. If any trees are near the home, it may be wise to trim them down. Bring any lightweight objects inside, tie down those that cannot be taken indoors.

Gather all the relevant papers. Find a waterproof container and ensure that inside it are documents such as the homeowners' insurance policy, medical records, and passports.

Preparing the Home for Hurricane Season

Hurricane season begins in just a few days and homeowners should consider being ready. Making a few changes to a home may help with being able to weather the storm, and they may also lead to insurance policy discounts.

Miami, FL -- (SBWIRE) -- 05/22/2020 -- The roof is a fundamental component of the home, especially during hurricane season. Besides evaluating how old the roof is, homeowners should also examine what type of roof they have. For example, the process of tying down has gained favor. Roofing has grown quite a bit and nowadays the use of "straps" to ensure a stable roof is common.

A window's resistance to impact is important but shutters are also important as they may also lead to discounts. The majority of home inspectors will examine the materials that cover a window but they may also take a closer look to ensure the construction has been done correctly.

The direction in which a door plays an important factor. Doors can be opened much faster in a hurricane by heavy winds if they open inward. Be sure to apply safety to any glass that may be on the front door, as an extra measure of security.

Financial Changes for Homeowners in 2020

Miami, FL -- (SBWIRE) -- 02/28/2020 -- A homeowner may spend approximately $2,000 a year or so on home maintenance, including performing common tasks such as mowing and lawn maintenance or repairing small things here and there. This does not take into consideration major issues such as replacing a water heater or replacing a whole roof. Consider making a fund that can be contributed to periodically so that in the event of a major problem, there is no need to scramble for money.

Homeowners should be aware of how much they're spending on insurance. If it's been some time since policies were changed or examined, homeowners may be missing the chance to save hundreds of dollars. Evaluate the options before renewing and see if there are any insurers providing discounts. Homeowners may wish to consider a higher deductible possibility to bring down the policy premium.

The Complexity of HOA Insurance Policies

Miami, FL -- (SBWIRE) -- 02/26/2020 -- If a claim is made by the HOA, the fine print that occurs in an insurance policy may result in delays or denials in financial recovery, simply because providing compensation is easier and not as expensive for the insurance company than issuing a damage check. Insurance companies have years of experience manipulating the language of policy terms that may be to its advantage.

It is commonly because multiple condos, units, roofs or common areas have endured sizeable damage when associations file a property damage claim. Should the insurer deny an otherwise valid claim, disputes may arise between HOAs and the insurance company, and they may do so without a statement or valid reason.

Because the damages incurred in these situations can also impact the structural integrity of the building in certain cases, the system of litigation can prove to be difficult. The convoluted nature of all insured damages being charged, substantiated, and mitigated is the same when the damage is severe.

Insurance companies may use the intricacies of these insurance claims against the policyholder, which can have a major impact on the swiftness and result of a claim settlement.

Common Myths Associated with Insurance

Miami, FL – 02/18/2020 – Examining and understanding an insurance policy is an effective way for homeowners to know what their policy covers and what it doesn’t. Many homeowners may experience an unwanted surprise when they realize their coverage is insufficient. One reason for this may be common myths associated with insurance.

Miami, FL -- (SBWIRE) -- 02/18/2020 -- Insurance policies do not necessarily provide coverage for all valuables. Think of possessions like artwork, jewelry, or pleasure vehicles. A pricey piece of art, for example, may need a separate policy. Homeowners should make sure all of their important possessions are properly covered before a major disaster happens.

Insurance premiums don't have many ties to a home's market value. One of the major factors that affect the premiums is its replacement value, which takes into account the materials and labor cost. Older homes typically require more expensive insurance than newer ones because of the materials used.

With flooding, homeowners should remember that most policies do not include coverage for this type of damage. In the majority of cases, homeowners will need to purchase a separate flood insurance policy.

Be Aware of Flooding Risks Before Buying a Home

Miami, FL – When buying a home, it is important to have full disclosure regarding potential issues the property may have. Hence, a home inspection is a highly recommended suggestion before proceeding further with a home purchase. However, what happens when a new homeowner finds out the home is a major flood risk after it’s bought?

Miami, FL -- (SBWIRE) -- 11/19/2019 -- A Tampa Bay Times article tells the story of a Florida homeowner who bought a home unaware of its long history of flooding. After Hurricane Irma made its way through Florida, flooding forced the insurance company to pay for more than $100,000 in damage. Soon afterward, the homeowner's insurance company told the homeowner that it was the fourth time that the home sustained thousands of dollars of flood damage and was put in a category among homes deemed extreme repetitive losses. The choices available to the homeowner were limited and included raising the home's elevation, selling it, or destroying it.

Florida is one of a handful of states in which sellers are not forced to report the flooding history of a home, despite Florida's penchant for being a higher flood risk. Floridians may wish to review a voluntary Florida seller disclosure form provided by the Florida Realtors Association when disclosing floods. A website called MyFloodRisk.org also provides helpful information showing the flood risk of a property using data such as the elevation and flood areas of FEMA.

Being Prepared for Storm Damage

Hurricane season officially comes to an end on November 30 which means there is still a possible risk of a storm emerging and hitting Florida. Being prepared can be hugely beneficial should a storm cause to a home or property.

Miami, FL -- (SBWIRE) -- 10/11/2019 -- One way to take preventative measures early is by making a video or photo inventory of belonging in and outside of the home, preferably with a timestamp or date showing when the pictures were taken or the video was filmed. A spreadsheet can help with keeping track of details like an item's purchase date and cost, model number, and any warranty information, particularly useful for major appliances. A cloud storage solution such as Google Drive can be used to keep the information safely stored or a weatherproof box can work too. By doing a home inventory, it will be much simpler to request cash or replacement value from the insurance provider.

After a storm, documenting the damage extensively is important. As soon as it is safe to do so, take pictures or video of every square inch of the property, including the roof. Make a note of any damage no matter how small it may be. Do not dispose of any damaged property as this may prove useful for the insurance company to inspect and it can also be used as proof of loss.

What to Do After a Major Storm Has Passed

Hurricane Dorian changed its path, sparing Florida from devastating damage. However, hurricane season remains in effect until November. Homeowners should know the proper steps to take in the event a storm does cause significant damage to their property.

Miami, FL -- (SBWIRE) -- 09/16/2019 -- One way to start is to figure out whether the damage was a result of flooding, wind, or rain. This step is vital since flood insurance in Florida is not covered under most homeowner's insurance policies and requires having a separate policy.

After determining what caused the damage, temporary repairs should be made to prevent further damage to the property. All receipts should be kept so that it easier for the insurance company to provide reimbursement. Homeowners that choose to work with a contractor should be wary of providing all of the money up front or an estimate seems like it's a little too low. Extensive repairs should be made once an insurance adjuster has thoroughly examined and recorded the damage.

In regards to receipts, it is wise to keep them if relocation is necessary. The majority of insurance policies have coverage to cover living expenses in the event the home is extensively damaged as a result of a storm..

Keep the Roof Protected During Storm Season

Miami, FL – 09/05/2019 – Florida’s subtropical climate means there is always a risk of a storm making its way through a part of the state. Homeowners should take the time to examine their roofs during hurricane season.

Miami, FL -- (SBWIRE) -- 09/06/2019 -- Regardless of the age of the roof, there are steps a homeowner can take that may lessen the damage of a storm or potentially prevent having to make an expensive roof replacement. For starters, take some time out at least twice a year to examine and clean gutters. Leaves should be removed as they will result in clogging. By not cleaning the gutters, damage may occur to sidings and walls.

While on the subject leaves, homeowners may wish to do a bit of tree trimming. In addition to cutting down on dead leaves and reducing the odds of a branch damaging the home, removal of overhanging reduces the chances of an animal like a possum getting into the roof. These animals are known for gnawing on pieces of the roof, which may cause damage or even leaks.

Be aware of any shingles that may have come loose or are missing. Consider using binoculars to spot for these shingles instead of climbing on the roof and creating a safety risk.

Preparing for the Effects of a Hurricane

Miami, FL -- (SBWIRE) -- 07/19/2019 -- Florida managed to escape the damage of Hurricane Barry, but months remain before the end of hurricane season. Considering how unpredictable Mother Nature can be, homeowners should always be prepared beyond having canned goods, sufficient water, candles, and batteries in the event of a power failure.

NFC and debit card chip technology have spurred many to pass less with cash. However, if a hurricane knocks out power, it can take potentially weeks to restore the damage. Having cash available is imperative as an ATM will not be functional if there is no power.

Homeowners should always keep recent pictures of personal possessions, from televisions to computers, or expensive art they are. If the effects of a storm ruin these possessions, pictures may expedite the process of dealing with an insurance company to have the items replaced. With that in mind, vital documents such as the title of the home should remain in a container that can weather the elements such as water.

Roof leaks may occur during or after a storm, but the second floor can also prove to be useful should flooding occur. Consider moving any important items to the second floor to reduce the chances of them becoming damaged if flooding occurs.

Florida Insurance Reform Is on the Way

After years of efforts to come up with a solution, Florida legislators have agreed on a bill intended to reform property insurance while also addressing the issue of assignment of benefits (AOB). AOB has frequently been mentioned as a major reason for the massive hike homeowners have faced in their insurance premiums.

Miami, FL -- (SBWIRE) -- 05/24/2019 -- The Florida Senate passed SB 122 back in April focusing on the abuse of post-loss AOBs for residential or commercial property insurance claims, among other things. Some of the provisions found in the bill would prohibit certain fees and make changes to policy provisions related to managed repairs in an assignment agreement. Service providers would also be obligated to give an insurer and the consumer at least ten days of prior written notice before filing a claim lawsuit.

All signs point to Florida Governor Ron DeSantis signing the insurance reform bill, which is expected to become Florida law on July 1st.

What to Do After a Hurricane

The start of hurricane season is right around the corner which serves as a reminder of how important it is to know what steps to take should a major storm strike South Florida.

Miami, FL -- (SBWIRE) -- 04/26/2019 -- If a major storm causes damage to several homes, homeowners can expect insurance companies to become inundated with claims. The longer a person waits to file a claim, the longer the wait for an adjuster to visit the property, survey the damage and have the home repaired. It is not unusual for the entire process to take several months.

An adjuster may visit a home and only conduct a short, superficial inspection of the damaged home. There is also the possibility that they won't closely examine the damage, such as by taking a closer look at the roof to check for any issues. Make sure the adjuster inspects all damage and if they overlook something, jot down everything that the person may have missed.

Many homeowners are under the false impression that they are required to accept an insurance company's estimate. Though it is not always the case, insurers try and close as many claims as possible within a short timeframe, which means the true cost of repairs may result in the repairs being undervalued. If the homeowner feels the estimate is not justified, there may be the option of disputing it.

Florida Considers AOB Reform

Two insurance reform bills intended to modify Florida’s assignment of benefits (AOB) law may soon become law. If the bills ultimately pass, it will be the first time in several years that an AOB bill has reached the Senate.

Miami, FL -- (SBWIRE) -- 03/29/2019 -- Among the two bills, one of them is receiving wide discussion during hearings involving insurance carriers, regulators and homeowners that are against AOB agreements versus home restoration contractors, attorneys, and homeowners that support AOB.

Florida's current laws allow homeowners to sign over their insurance benefits to a contractor after a loss in order to pursue payment from insurers for work performed. AOB agreements expedite repairs by guaranteeing payment for "up front" work performed. The part of Florida's AOB statute that has remained a point of contention is the "one-way" attorney fee provision, which requires an insurance company to pay the legal costs even if a court rules in their favor. Those that oppose the one-way fee is something of an incentive for attorneys to pursue AOB lawsuits.

Alonso Perez Discusses Recent AOB Bill

Miami, FL -- (SBWIRE) -- 02/08/2019 -- A recent Senate Bill 122 has been introduced with the intention of fixing the one-way attorney fee provision currently found in Florida's assignment of benefits (AOB) law. Attorney fees would be awarded solely to the policyholders that win the litigated claims instead of "vendors" that have been assigned benefits in the AOB agreement.

Currently, Florida allows landowners to transfer insurance benefits to contractors with the intention of pursuing payment from insurers for upfront work that is done.

Attempts to change AOB go as far back as 2013 but there has yet to a viable bill that has lead to genuine reform. In 2018, an AOB bill successfully made its way through the House but was halted when it went under review by the Senate Insurance and Banking Committee.
