      <title>Vancouver Estate Lawyers Discuss Suing an Estate for Child Support Payments</title>

This case is an example of the intersection between <a class="extlink"  target="_blank"  rel="nofollow noopener" title="Estate Law and Family Law" href="http://www.kushnerlaw.ca/">Estate Law and Family Law</a> and between the Wills Estates and Succession and Family Law Act. After reviewing the law, the Honourable Madame Justice Donegan made the following comments:<br />

[44] To repeat, Ms. Bouchard seeks an order that Mr. Bouchard pay her lump sum child support for the two children, pursuant to s. 170(g) of the FLA, in the full amount of the Trust Funds. She also seeks an order that Taylor &amp; Blair release those funds directly to her lawyer.<br />
<br />
[45] On the evidence adduced, the Trust Funds can only be seen as an asset of Mr. Bouchard&apos;s estate. Ms. Bouchard&apos;s attempt to obtain these funds using this approach really asks the court to circumvent the proper procedural and substantive law.<br />
<br />
[46] Procedurally, Ms. Bouchard is improperly attempting to obtain orders in the absence of any representation of Mr. Bouchard&apos;s estate. The orders she seeks could only be orders against his estate and no one has been appointed as a personal or litigation representative.<br />
<br />
58] Ms. Bouchard&apos;s belief that administration of Mr. Bouchard&apos;s estate is unnecessary is grounded primarily in two fundamental misunderstandings. First, she believes the Trust Funds are not an estate asset. On the evidence before this court, they certainly appear to be an asset of Mr. Bouchard&apos;s estate.<br />
<br />
[59] Second, she believes there are no other claims against Mr. Bouchard&apos;s estate. With respect, this is impossible for her to know. Ms. Bouchard was separated from Mr. Bouchard for about three years at the time of his death and was not privy to all of his activities during this time. The fact that Taylor &amp; Blair has received no claim to the Trust Funds is no comfort. Taylor &amp; Blair is not administering the estate. The fact that some of Mr. Bouchard&apos;s family members are "fine with it" is also of no comfort. No one is administering this estate. It is entirely possible that other debt claims to the estate may exist and it is also entirely possible that such claims may have priority over any child support debt the estate may owe if an award were made.<br />
<br />
[60] Finally, it must be said that circumventing the proper administration of Mr. Bouchard&apos;s estate fails to recognize or consider the legitimate direct interests of the children on an intestacy distribution. As Mr. Bouchard died without leaving a spouse, the children would have a direct claim to their father&apos;s net estate on such a distribution. Their interests need to be considered.<br />
<br />
Estate law is often complex, and in this case, the judge turned down the applicant&apos;s request to receive a childcare lump sum payment. Under the old common law, unless the parties had agreed or a court had ordered that support obligations would continue after death, support obligations ended upon the payor&apos;s death. Under the FLA, it remains the case that the parties can agree or a court can order that a payor&apos;s support obligation continues after death and is a debt of the estate: <br />

In part one of the two-part blog series, the family lawyers at Kushner Law Group discussed case 2018 BCSC 1728 where the Honourable Madame Justice Donegan ruled on an application by a former spouse of the deceased who sought payment of lump sum child support. The Court noted:<br />

[32] After a parent dies, their estate may be liable for outstanding and continuing child support payments. The personal representative of the estate plays a role in determining whether the estate is liable for these things. This role is summarized in the British Columbia Probate and Estate Administration Practice Manual, 2nd Ed. (Vancouver: The Continuing Legal Education Society of B.C., 2007) (loose-leaf updated 2018), 11.27:<br />
<br />
If the deceased was, immediately before death, liable for payment to an estranged spouse or child under a separation agreement or a court order, any arrears outstanding immediately before death will be a debt payable out of the estate. The personal representative will also have to determine whether the estate is liable for ongoing maintenance for the period following death. If so, the estranged spouse or child will rank as an ordinary creditor of the estate for the future installments, and the personal representative will be obliged to provide for that claim before distribution to beneficiaries. Failure to do so will render the personal representative personally liable for devastavit (see §11.12).<br />
<br />
[33] In the past, under the common law, a payor&apos;s child support obligation ended upon death (see Milne v. MacDonald Estate, 1986 CanLII 931 (B.C.C.A.) and R.M.R. v. H.V., 2005 BCSC 52 at paras. 16-22), unless the parties reached an agreement or there was a court order specifying that the payor&apos;s support obligations would continue beyond his or her death. If there was such an agreement or court order in existence at the time of death, these obligations could continue as a liability of the estate: Crain v. Crain, 1996 CarswellBC 1174 (S.C.) at paras. 11-15.<br />
<br />
[34] The common law I have just described has now been changed by the FLA. In the situation where a payor who has a duty to pay support under an agreement or order dies and the agreement or order is silent about whether that duty continues after the payor&apos;s death and is a debt of his/her estate, s. 171(3) of the FLA now allows the recipient of that support to apply for an order that the duty to pay support continues despite the death of the payor and is a debt of the estate, based on the factors in s. 171(1).<br />
<br />
[43] To reiterate, under the old common law, unless the parties had agreed or a court had ordered that support obligations would continue after death, support obligations ended upon the payor&apos;s death. Under the FLA, it remains the case that the parties can agree or a court can order that a payor&apos;s support obligation continues after death and is a debt of the estate: s. 170(g); however, the legislation now allows for a recipient of support to apply to have that support continue as a debt against the payor&apos;s estate, even if the original support agreement or order was silent about support continuing after death: s. 171(3).<br />

As a refresher, a personal representative of an estate is obligated by a fiduciary duty to act in the best interests of that estate. This fiduciary duty may sometimes conflict with the personal representative&apos;s individual interests as a beneficiary of the estate. <br />
<br />
The BC Supreme Court dealt with such an issue in the case of Jang v. Jang, 2018 BCSC 1649, wherein the personal representative and primary beneficiary of an estate was sued by the other beneficiaries under s. 151 of the <a class="extlink"  target="_blank"  rel="nofollow noopener" title="Wills, Estates and Succession Act" href="http://www.kushnerlaw.ca/category/wills-estate-planning-litigation/wills-estates-and-succession-act-wesa/">Wills, Estates and Succession Act</a>.<br />
<br />
The Court recognized several failures of the personal representative&apos;s duty, as Mr. Justice Basran stated:<br />
<br />
[29] Douglas is clearly in a conflict of interest.  He is the personal representative of the estate and also its primary beneficiary. By operation of the right of survivorship, he transferred the Turner Street Property to his name after Mrs. Jang died. Obviously, any claim against this asset by the other beneficiaries will directly affect his interest in this property.<br />
<br />
[30] Mrs. Jang died on May 22, 2016. The plaintiffs requested a copy of the Will by letter dated July 13, 2016. Douglas did not provide it to them until 15 months later on October 23, 2017. The Will clearly designates the plaintiffs as beneficiaries, and it was entirely unreasonable of Douglas not to advise the plaintiffs of this fact and not provide them with a copy of the Will when it was requested. By not providing the Will to the plaintiffs in a timely manner, Douglas did not act in accordance with his fiduciary responsibilities and obligations as the personal representative of the estate.<br />
<br />
[31] Douglas has also failed to provide an accounting of the estate&apos;s assets, notwithstanding the July 2016 request that he do so.<br />
<br />
Ultimately, the Court allowed the other beneficiaries to sue in the name of the personal representative, under s. 151 of WESA.<br />

In the case of Jang v. Jang, 2018 BCSC 1649, obtaining such leave was discussed in the case wherein the Honourable Mr. Justice Basran made the following statements:<br />

[23] Pursuant to subsection 151(1) of the WESA, the plaintiffs require leave to bring claims in resulting trust, undue influence, debt, breach of fiduciary duty, and an accounting in the name of and on behalf of Douglas as personal representative of the estate. That section states:<br />
<br />
(1) Despite s. 136, a beneficiary or an intestate successor may, with leave of the court, commence proceedings in the name and on behalf of the personal representative of the deceased person:<br />
<br />
(a) to recover property or to enforce a right, duty or obligation owed to the deceased person that could be recovered or enforced by the personal representative;<br />
<br />
(b) to obtain damages for breach of a right, duty or obligation owed to the deceased person.<br />
<br />
[25] Subsection 151(3) sets out the requirements that must be met for a court to grant this leave:<br />
<br />
(3) The court may grant leave under this section if:<br />
<br />
(a) the court determines the beneficiary or intestate successor seeking leave<br />
<br />
(i) has made reasonable efforts to cause the personal representative to commence or defend the proceeding,<br />
<br />
(ii) has given notice of the application for leave to<br />
<br />
(a) the personal representative,<br />
<br />
(b) any other beneficiaries or intestate successors, and<br />
<br />
1.	c) any additional person the court directs that notice is to be given, and<br />
(iii) is acting in good faith, and<br />
<br />
(b) it appears to the court that it is necessary or expedient for the protection of the estate or the interests of a beneficiary or an intestate successor for the proceeding to be brought or defended.<br />
<br />
[26] A proceeding may be "necessary" if the personal representative is unwilling or unable to proceed or it may be "expedient" if it is in the best interests of the estate.  That proposition is from Bunn v. Bunn Estate, 2016 BCSC 2146<br />

-	relationship between the testator and claimant, including abandonment, neglect and estrangement by one or the other;<br />

-	reasonably held expectations of the claimant;<br />
-	standard of living of the testator and claimant;<br />
-	gifts and benefits made by the testator outside the will;<br />
-	testator&apos;s reasons for disinheriting<br />
-	financial need and other personal circumstances, including disability, of the claimant;<br />
-	misconduct or poor character of the claimant;<br />
-	competing claimants and other beneficiaries:<br />

As mentioned, the residue of an Estate is all of the property (both real and personal) that is not gifted to a specific beneficiary. An example of this would be if a testator (will-maker) died with $100,000.00 in cash and made two gifts of $20,000.00 each to two friends and named his spouse as the residual beneficiary. In this case, the spouse would be entitled to the $60,000.00 residue. <br />
<br />
It is quite normal for the residue to be largest portion of the Estate. One interesting circumstance that can arise is if the will has no clause for a residual or if the residual beneficiary pre-deceases the testator. In this circumstance, we look to section 44 of WESA which provides the following:<br />

If a will does not give or otherwise dispose of all of the will-maker&apos;s property, the property that is not the subject of a gift or otherwise disposed of in the will<br />
<br />
(a) must be distributed to the persons who would be entitled if that property were an intestate estate, and<br />
<br />
(b) if there is no person who would be entitled under paragraph (a), passes to the government and is subject to the Escheat Act.<br />
<br />
This means that the residue will be distributed as if the testator had died without a will.<br />
<br />

43 (1) Unless a court otherwise declares under subsection (4), a gift in a will is void if it is to<br />
<br />
(a) a witness to the will-maker&apos;s signature or to the spouse of that witness,<br />
(b) a person signing the will by the will-maker&apos;s direction, or the spouse of the person signing, or<br />
(c) a person claiming under a person, other than the will-maker, referred to in paragraph (a) or (b).<br />
<br />
(2) For the purposes of subsection (1), the relevant time for determining whether one person is the spouse of another is the time when the will was made.<br />
<br />
(3) If a gift is void under subsection (1), the remainder of the will is not affected.<br />
<br />
(4) On application, the court may declare that a gift to a person referred to in subsection (1) is not void and is to take effect, if the court is satisfied that the will-maker intended to make the gift to the person even though the person or his or her spouse was a witness to the will.<br />
<br />
(5) Extrinsic evidence is admissible for the purposes of establishing the will-maker&apos;s intention under subsection (4).<br />
<br />
In other words, a beneficiary to a will who is also a witness can apply to the Court to have the gift recognized as valid by proving that the will-maker did intend to make the gift.<br />

(1) A will or part of a will is revoked only in one or more of the following circumstances:<br />
(a) by another will made by the will-maker in accordance with this Act;<br />
(b) by a written declaration of the will-maker that revokes all or part of a will made in accordance with section 37 [how to make a valid will];<br />
(c) by the will-maker, or a person in the presence of the will-maker and by the will-maker&apos;s direction, burning, tearing or destroying all or part of the will in some manner with the intention of revoking all or part of it;<br />
(d) by any other act of the will-maker, or another person in the presence of the will-maker and by the will-maker&apos;s direction, if the court determines under section 58 that<br />
(i) the consequence of the act of the will-maker or the other person is apparent on the face of the will, and<br />
(ii) the act was done with the intent of the will-maker to revoke the will in whole or in part.<br />
(2) A will is not revoked in whole or in part by presuming an intention to revoke it because of a change in circumstances.<br />

The article begins by exploring whether various handwritten alterations on the will of the Deceased was sufficient to constitute testamentary intent in the case of Estate of Palmer, 2017 BCSC 1430.<br />

This case was particularly interesting because the Application was being made in chambers, yet the Court determined that there was a bona fide issue that needed to be resolved at trial. In providing a decision, the Honourable Mr. Justice Kent made the following statements: <br />

[18] It appears from his affidavit that Mr. Homeniuk&apos;s only contact with Ms. Palmer was by way of telephone and he did not actually visit her in British Columbia. This may be the reason why he is unable to comment on her health but evidence on such matters could have been provided through medical or hospital records and/or any health professionals who might have looked after Ms. Palmer in the years before her death.<br />
<br />
[19] I wish to make it perfectly clear that my critique of the Homeniuk affidavit is not meant to be a negative reflection of Mr. Homeniuk&apos;s credibility or the truthfulness of his evidence. The difficulty arises only because of the affidavit testimony of Sean and Daryl Palmer who each in their own way cast aspersions on the credibility and reliability of Mr. Homeniuk&apos;s evidence.<br />
<br />
[30] I have attempted to explain above why the affidavit evidence tendered on this application respecting certain matters is insufficient to do justice to the testamentary intentions of Ms. Palmer. In my view, oral evidence from the three affiants is desirable including cross-examination of those affiants on certain aspects of their testimony. As well, evidence must be adduced respecting Ms. Palmer&apos;s physical and mental health and, in particular, her testamentary capacity at the time the changes to her will were made.<br />
<br />
[31] Furthermore, three of the potential beneficiaries under WESA have not been included in the proceedings to date. It appears that Ms. Perret has no interest in actively participating in the present proceeding, however the court is not satisfied that any meaningful effort has been invested by any of the parties in tracing and notifying each of Bradley Palmer, Grant Palmer and Dolores Palmer. Their legal interests are at stake in this proceeding and they cannot simply be ignored.<br />

The concept of notational separation is succinctly explained by the Honorable Mr. Justice N. Smith in the decision of Ciarniello v. James, 2016 BCSC 1699.<br />
<br />
[70] I think the plaintiff is correct that the approach in British Columbia following Tataryn has been to determine the legal obligations to a spouse by considering the spouse&apos;s entitlement in a notional separation immediately prior to the testator&apos;s death. See for example: Wong v. Soo, 2015 BCSC 1741 (CanLII) at paras. 70, 73-75, 114 115; Saugestad v. Saugestad, 2006 BCSC 1839 (CanLII) (varied but not on this point, 2008 BCCA 38 (CanLII)); Glanville v. Glanville (1998), 1998 CanLII 6031 (BC CA), 58 B.C.L.R. (3d) 240, at paras. 14 and 50; Erlichman v. Erlichman Estate, 2002 BCCA 160 (CanLII) at para. 49; Bridger v. Bridger Estate, 2006 BCCA 230 (CanLII) at para. 19.<br />

[71] In Saugestad, Justice Russell referred to these authorities for the proposition that this notional separation defines the minimum acceptable level of what is adequate, just and equitable. She added at para. 73 that "consistent with the family law decisions that establish the legal obligations of the testator, the length of the relationship and the contribution of the claimant spouse are relevant factors to a determination of what share of the estate a spouse will be entitled to."<br />

[72] As Mackenzie J.A. said in Bridger v. Bridger Estate at para. 20:<br />
<br />
[20] Tataryn followed Walker v. McDermott, 1930 CanLII 1 (SCC), [1931] S.C.R. 94, and confirmed the rejection of a purely need-maintenance approach to entitlement under the Act. Moral claims against the estate by spouses and children of the testator are entitled to recognition. McLachlin J. (at para. 28) described moral claims as "found in society&apos;s reasonable expectations of what a judicious person would do in the circumstances, by reference to contemporary community standards." Here the court is required to balance the competing moral claims on the estate of Mrs. Bridger and the daughters after the notional legal claim of Mrs. Bridger to a half share of family assets has been recognized. The will recognizes the moral claims of the appellant daughters but ignores any moral claim of Mrs. Bridger. Tataryn recognizes that there is no clear legal standard to judge moral claims and the test is more nebulous where the surviving spouse is not strictly speaking a dependent spouse and the children are all financially independent adults. While, as McLachlin J. observes in Tataryn, there may be a number of options for dividing assets by a testator which are adequate, just and equitable, I do not think they include a disposition that entirely prefers the moral claims of adult independent children to those of a loyal spouse who provided care for the testator over years of debilitating decline. I am satisfied that the trial judge was right to recognize unfulfilled legal and moral obligations of the testator to Mrs. Bridger, as those terms are understood in a wills variation context. The legal obligation can be quantified as above. The question then becomes the measure of the outstanding moral obligation.<br />
<br />
[73] The legal entitlement of the spouse immediately before the death of the testator is the relevant time, that is, the time of the notional separation, to determine the extent of the testator&apos;s legal duty.<br />
<br />
[74] As Dr. Ciarniello died on April 28, 2013, the Family Law Act, S.B.C. 2011, c. 25, should govern the analysis. Given the provision of the Divorce Act and the Family Law Act, I think that the plaintiff at a time just prior to the death of the testator would likely be entitled to an equal division of family property. While I doubt that a family law analysis would have resulted in an order for spousal support, given the condition of the testator at that time, the deceased&apos;s legal obligation would be to provide 50% of the family property.<br />

The case was concluded in a subsequent blog in which the Court made the following comments:<br />
[12] In considering whether a will has made adequate provision for a spouse, the court considers what the spouse would have been entitled to in a notional separation immediately prior to the testator&apos;s death. That notional separation defines the minimum acceptable level of what is adequate, just and equitable: Ciarniello v. James, 2016 BCSC 1699 (CanLII) at paras. 70 and 71.<br />
<br />
[13] The property that forms this estate was acquired by Ms. Boyd about six years before her marriage to the plaintiff, but they lived together there for more than 30 years until her death. In a notional separation, the Family Law Act, S.B.C. 2011, c. 25 would give the plaintiff a claim to half of the amount by which the property&apos;s value increased during their relationship. That would likely be more than what he has agreed to accept in the proposed settlement.<br />

The preliminary test that the Courts use to determine whether a CPL should be removed was set out in the British Columbia Court of Appeal decision, Youyi Group Holdings (Canada) Ltd. v. Brentwood Lanes Canada Ltd., 2014 BCCA 388 (CanLII):<br />

As a preliminary matter the applicant must show that it is experiencing or likely to experience "hardship and inconvenience" as a result of the registration of the CPL. It appears that the degree of hardship required is the subject of disagreement in the Supreme Court of British Columbia. <br />
<br />
[28] While some judges have proceeded on the basis that the hardship need not be "significant" (see, e.g., Enigma Investments Corp. v. Henderson Land Holdings (Canada) Ltd. 2007 BCSC 1379 (CanLII), and 0966349 B.C. Ltd. v. Shell Canada Limited, Reasons dated February 28, 2014, New Westminster Docket S151234), others have required "severe suffering" (see, e.g., the lower court decision in Liquor Barn Income Fund v. Mather 2009 BCSC 1092 (CanLII), at para. 7.) The Shorter Oxford Dictionary (6th ed., 2007) defines "hardship" to mean "the quality of being hard to bear" or "severe suffering or privation"; "significant" to mean "important, notable; consequential"; and "insignificant" to mean "of no importance; trivial, trifling" or "meaningless". To the extent that these or other decisions of the trial court suggest that "hardship" in s. 256(1) may be met by proof of hardship that is "insignificant" or "not significant", I would disagree. I doubt that the Legislature intended the threshold under s.256 to be surmounted by proof of hardship that is only "trifling". On the other hand, I agree that a court should not be "exacting" in its analysis of hardship and inconvenience.<br />

In other words, it&apos;s now possible to have the Court determine whether a written document that does not conform to the requirements of a will should be considered to be binding and representative of testamentary intent.<br />
<br />
In the decision of Skopyk Estate, 2017 BCSC 2335, the Honourable Madame Justice Forth was asked to determine whether an unsigned written document from the Deceased was sufficient to represent his intentions to replace or alter a valid will drafted in 1995. In considering whether the document provided sufficient testamentary intent, the Court set out the test in determining an application under s. 58 as follows:<br />

[18] Section 58 of WESA authorizes the court to order that a document that does not comply with the requirements of WESA be fully effective as though it had been made in compliance with those requirements. To make such an order, the court must be satisfied that the document represents the testamentary intentions of the deceased.<br />
<br />
[19] The Court of Appeal has interpreted s. 58 to require that the document must be "a deliberate or fixed and final expression of intention" as to the disposal of property upon death: see Hadley Estate (Re), 2017 BCCA 311 at para. 36 [Hadley]. The factors relevant to the determination of whether a document represents such an expression of intention are context specific: Re Lane Estate, 2015 BCSC 2162 at para. 33. Extrinsic evidence of testamentary intent is admissible on the inquiry as to whether a non-compliant document embodies a deceased&apos;s intent. This may well include extrinsic evidence of events that occurred before, when and after the document was created: Hadley, at para. 40.<br />

The Honourable Madame Justice Forth considered s. 58 of WEST before concluding that several relevant details supported the idea that the document, while unsigned and unwitnessed, represented sufficient testamentary intent:<br />

[22] There are several relevant details pertaining to the Document itself that support a finding that it represents such an expression of intention:<br />
<br />
The Document was pinned to a bulletin board hanging on the door in the Deceased&apos;s apartment where it could be easily found;<br />
<br />
The distribution set out in the Document is rational on its face in that the Deceased&apos;s sister, Mary Anne, who had been included in the 1995 Will, had since died;<br />
<br />
The Document clearly directs a division of the residue of the estate to certain named persons and in certain specific shares, with language that mirrors the language of the 1995 Will;<br />
<br />
Although the Document is not signed or witnessed, the word "witness" is written near the bottom;<br />
<br />
Although the Document is not dated, there is reference at the top to the Deceased&apos;s will dated November 16, 1995. It also purports to correct a typographical error in a specific paragraph of the 1995 Will; and<br />
<br />
The handwriting is reasonably similar to handwriting in a letter entered into evidence, which is dated December 10, 1995, and signed by the Deceased. This letter was found in a drawer in the Deceased&apos;s apartment next to the 1995 Will.<br />
<br />
The Court also considered other evidence, such as that the fact the Deceased had told a beneficiary prior to entering heart surgery that his 1995 will did not reflect his desires.<br />
