      <title>Melbourne Motorcycle Accidents Contribute to Brevard County's Rising Traffic Death Toll</title>

One incident was a pedestrian death, while two others were <a class="extlink"  target="_blank"  rel="nofollow noopener" title="motorcycle accidents" href="http://www.sinclairlaw.com/for-bikers/">motorcycle accidents</a>.<br />

This continued a trend that many in local law enforcement have become concerned about. The numbers that have been compiled so far this year show that <a class="extlink"  target="_blank"  rel="nofollow noopener" title="traffic fatalities in Melbourne" href="http://www.sinclairlaw.com/practice-areas/">traffic fatalities in Melbourne</a> and the surrounding area have increased by a startling 25 percent over last year.<br />
<br />
Lt. Kim Montes, spokeswoman for the highway patrol, noted, "It&apos;s a combination of different things, a collection of driver errors. We really don&apos;t have an answer why. But drivers have to go back to basics and pay attention to the roadway. We&apos;re also seeing a lot more people driving tired."<br />
<br />
The first fatality occurred around 1 a.m., when Tyler Barkley, 24, of Rockledge was riding his motorcycle on Interstate 95 and failed to slow as he approached a tractor-trailer from the rear, striking it at a high rate of speed. Barkley was ejected from his bike in what was termed a classic high side crash and died shortly after authorities reached the scene.<br />
<br />
The second incident took place at U.S. 1 and Broadway Boulevard at approximately 3:30 a.m. Daniel Wheeler of Cocoa was initially struck by a Chevy Malibu and then subsequently hit by another vehicle that fled the scene. Wheeler was pronounced dead at the scene.<br />
<br />
At 4 p.m., troopers reported that 87-year-old Richard Basso rode his 2010 Honda through a stop sign just north of Cocoa and was struck by a pickup truck. The truck made contact flush on Basso&apos;s right side. Basso was transported to Wuesthoff Hospital where he later succumbed to his injuries.<br />
<br />
Less than an hour later, at approximately 4:45 p.m. near the entrance of A. Max Brewer Memorial Bridge, it was reported that Jonathan Scott Reuss of Titusville, riding a 2008 Kawasaki road cruiser, had been killed. Reuss was attempting to make a left-hand turn when he was struck by 44-year-old Craig Peterson of Orlando. Peterson had been traveling westbound in his 2014 Dodge Challenger when the incident occurred.<br />
<br />
As the latest reports have become available, it seems this week&apos;s numbers may not be much better. As the St. Patrick&apos;s Day weekend got underway, it had a very shaky start.<br />
<br />
On Thursday, two people were injured in a collision between their motorcycle and a truck at the intersection of Angela Lane and South Street in Titusville. Both the driver and his passenger were airlifted to the local hospital.<br />
<br />
Saturday at 1:15 p.m. another motorcycle accident was reported on New Haven Road in Melbourne.<br />
<br />
According to the Palm Bay Fire Department, a third motorcycle accident occurred on Furth Road in Palm Bay around 1:30 p.m. A female victim was reported thrown from her bike in the collision.<br />
<br />
Two other Melbourne collisions involving motorcycles were reported through Sunday morning, but details were not available as of this writing. All cases are currently under investigation by authorities.<br />

Now, a young startup company, Rubicon Technologies LLC, is working to make riding a motorcycle safer at night. They have developed a night vision device that can be mounted on the handlebars or windscreen of a bike, allowing riders to have a clear vision of the road ahead as easily as they would check their gauges.<br />

The company, co-founded by Robert Schindler and Joe Krizmanich, who is credited with the idea, is based out of Ohio, the state with the third-largest riding population in the country, after California and Florida. They are currently working out of LakeStart, a Lake County, Ohio, small business accelerator that was founded in 2016, and are very excited to have just received a $25,000 development grant from the Great Lakes Innovation and Development Enterprise.<br />

With this influx of capital, the partners have gained a great deal of confidence. "We&apos;re going to be developing this product, and hopefully this time next year, we&apos;ll be in production," Schindler stated in late February.<br />

Twelve months from drawing board to production may seem a bit ambitious to some, but Schindler and Krizmanich are not going it alone. They will be partnering with Virtec Enterprises, which Schindler once worked for.<br />

Foy came to the decision to raise money for the Humane Society and the Brevard Rescue Mission, two non-profit organizations that provide valuable services in Brevard County. John Foy is a Palm Beach resident, and a popular National Motorcycle racer. He consulted with G.P. Bikes, and allowed them to sell his overstock of parts. Foy also agreed to match the funds from the sale of the parts. His generosity made these donations to the Brevard Rescue Mission and the Humane Society a reality.<br />

Division competitions include: the 50-Plus Competition, the Novice Competition, Challenge Ride, and Skills Course Team Competition comprised of two riders. Each has relevance to automobiles specifically, although one applies across the board to any type of vehicle on the road. Sinclair Law has a vested interest in spreading knowledge of these new laws, as they impact current and potential clients in their personal injury suits.<br />

The first new law is a hit-and-run bill which provides a four year prison sentence for those who leave the scene of an accident. The bill was championed by Sen. Miguel Diaz de la Portilla, R-Miami, and was named after bicyclist Aaron Cohen who was killed in a 2012 hit and run in Miami-Dade County. The four year sentence would be mandatory for any conviction involving a hit and run resulting in death; in addition, the offender&apos;s driver&apos;s license is required to be revoked for three years.<br />

This particular law went into effect July 1st, so it is already relevant to current Sinclair Law cases. With this change in legislation, Sinclair Law has been carefully reviewing the specific repercussions. The second new piece of legislation is a bill which raises the minimum age for children to ride in vehicles without the use of a car seat or booster seat from three years old to five years old. This law will provide additional safety to children that have previously been left unprotected by the law. Many parents follow the law precisely; as such, they have allowed their children to ride without the aid of a car seat or booster seat once reaching age three. However, many deaths and injuries have occurred due to this inappropriate age limit, because children are simply too small to ride in an automobile without additional protection prior to age five.<br />
<br />
Sinclair Law supports this bill, as it may go a ways to saving more children from unnecessary pain or death. "Children need the added protection of a car seat or booster seat into the older childhood ages. Many other countries already have a minimum age of 5 years for car seat and booster seat use, so we are playing catch up now," says Sinclair. "It is a good change." <br />

The new car seat bill will go into effect January 1st, 2015, so it is not currently applicable. However, it is important to note this change and date to avoid potential injuries or run-ins with police in the future. After two men were injured in a recent airboat crash on the St. John&apos;s River in Brevard County, Sinclair Law wants to remind people of some safety tips to help avoid such accidents.<br />

"Airboats pose specific dangers other watercrafts do not, and it is imperative that people understand how to properly operate the machines before using them."<br />

The following tips can be useful for prospective airboaters to avoid a similar accident:<br />

1.Pay particular attention to the propeller. The force it generates can draw small items from the boat through the propeller, which could damage the boat or cause the operator to lose control. Use coolers or other waterproof containers to store any small items before heading out.<br />
<br />
2.Remember life jackets and other safety equipment. As with any other watercraft, the U.S. Coast Guard requires all airboat passengers to wear a personal floatation device while on board. Ear and eye protection is also recommended, as airboats are louder than other boats and can create flying debris.<br />
<br />
3.Safety checks are a must. Before heading out, complete a preoperational check of the airboat and its components. Make sure the propeller magneto and battery switches are off and the key is removed from the ignition before performing any checks on the propeller or engine. Check all fluids and hoses, then start the engine and let it run for a couple of minutes. If everything is working properly while the engine is running, turn it off and check the fluids and hoses again.<br />
<br />
4.Watch the weather. With any trip onto the water, knowing whether a storm is approaching is imperative. Because airboats can be more easily tossed around in rough seas, it is crucial that operators check the weather in advance and keep an eye on changing conditions while on the water.<br />
