The J&J request for a new trial was shot down in California.

Torrance, CA -- (SBWIRE) -- 05/30/2013 -- In the ongoing saga of the recalled DePuy ASR hip replacement lawsuits, a California judge has ruled that the March ruling that awarded of $8.3 million to Loren Kransky will hold. Johnson & Johnson (J&J) biomedical arm DePuy had requested a new trial following the March trial in Los Angeles. In the original case, the jury found that the DePuy ASR hip implants were designed with defects and caused injuries to Kransky, a former Montana prison guard. DePuy announced in April that it would attempt to overturn the decision. DePuy had requested for a stay on the judgment and for the ability to file an appeal without bond. Judge J. Stephen Czuleger denied the request for a new trial and upheld the decision of the jury. Johnson and Johnson legal department avoids paying damages in latest Chicago DePuy ASR Trial, Csengeri Law takes valuable notes.

Torrance, CA -- (SBWIRE) -- 04/24/2013 -- The latest Chicago DePuy ASR Trial is over. The second of nearly 11,000 cases regarding the recalled DePuy Articular Surface Replacement (ASR) hip replacement implant has come to an end in Chicago. On April 15, jurors heard the final arguments from Denman Heard for plaintiff Carol Strum, as well as the Johnson and Johnson legal team on behalf of DePuy. Heard asked the jury for upwards of $5 million in damages stemming from the recalled metal-on-metal implant. In an impassioned plea, Heard called for the jury to award Strum extra punitive damages to penalize the orthopedics giant.

The jury recessed for just over a full day before delivering the surprising verdict. On the evening of April 16, he jury ruled on behalf of DePuy. The jury also rejected Heard's request for extra damages to be imposed against DePuy. The verdict in this Chicago DePuy ASR trial stands in stark contrast to the verdict in favor of former prison guard Loren Kransky, who received monies in excess of $8 million in his California DePuy ASR judgment in March.

DePuy recalled 93,000 of the metal-on-metal implant in August 2010, following the Johnson and Johnson acknowledgement that the device had a higher than average failure rate. In this particular case, the Johnson and Johnson team argued that Strum had preexisting hypersensitivity. This condition caused problems for the implant, and the implant had not abraded and pushed chromium and cobalt into her body causing additional damages. In Los Angeles Superior Court, a jury did find DePuy liable for approximately $8.3 million dollars in damages to former prison guard Loren Kransky. In the Los Angeles trial, the jury found that design flaws inherent to the DePuy ASR hip replacement implant were responsible for pain and suffering caused to Kransky. They did not award additional $187 million in punitive damages sought out by Kransky's lawyer, Brian Panish. Even without punitive damages, the first case ending in a substantial reward on the side of the plaintiff created significant opportunities for other hip recall patients.

In the second case, a Chicago jury rejected the claim that the DePuy arm of Johnson & Johnson inappropriately marketed the device. In this second case, the particular physiology of plaintiff Carol Strum seems to have been a sticking point for the jury. They did not find sufficient evidence that the recalled DePuy implant was specifically responsible for many of the health issues Mrs. Strum face. DePuy lawyers suggested that some of these issues were, in fact, the reason the device needed to be recalled.

While the debate on why the two trials have resulted so differently will likely continue for weeks, both trials have brought several pieces of less-than-flattering testimony against DePuy to the public eye. In the first of the DePuy ASR hip recall trial, Loren Kransky was awarded just over eight million dollars.

Torrance, CA -- (SBWIRE) -- 04/08/2013 -- In the final judgment of the first lawsuit in the DePuy ASR hip recall lawsuit, plaintiff Loren Kransky was awarded $8,260,790.85, primarily by the jury. Initially, Kransky and attorney Doug Saeltzer filed in excess of three hundred million in negligence and damages. A jury in California Superior Court, based in Los Angeles, has awarded $8.3 million in compensatory damages to Loren "Bill" Kransky, a retired prison guard from Montana. The jury concluded that the design of the DePuy ASR Xl metal-on-metal hip replacement caused his injuries but that DePuy properly warned of the risks and didn't owe additional punitive damages. Johnson & Johnson, largest seller of health care products on earth, recalled 93,000 of the defective implants in August of 2010.

Johnson & Johnson claimed in 2010 that twelve percent of the recalled DePuy ASR metal-on-metal implants failed within five years. Last year, forty-four percent failed in Australia inside of seven years. Analysts have claimed the lawsuits could cost Johnson & Johnson billions of dollars to resolve. Torrance, CA -- (SBWIRE) -- 03/11/2013 -- The first of thousands of lawsuits regarding Johnson & Johnson subsidiary DePuy and the recalled DePuy ASR Hip Replacement system is currently ongoing in California Superior Court, in Los Angeles. Paul Voorhorst, a DePuy statistician, said the company showed that 28% of ASR hips failed at a hospital in Finland. He also mentioned data form the United Kingdom national joint registry showing 27% of the hips failed inside of seven years. Csengeri Law is aggressively monitoring the new DePuy ASR lawsuits.

Torrance, CA -- (SBWIRE) -- 01/24/2013 -- Csengeri Law is aggressively monitoring the first of the nations' DePuy ASR hip replacement lawsuit, which is scheduled to begin on January 23rd in Los Angeles Superior Court. The lawsuit revolves around the DePuy ASR recall that began in August of 2010. The 2010 recall was nearly a year and a half after the initial lawsuits we filed against DePuy involving defects and health risks associated with the metal-on-metal ASR implants. In 2009, the Food and Drug Administration (FDA) informed DePuy that a similar artificial hip device that was marketed abroad would not be saleable in the United States. Shortly after receiving the FDA information, DePuy began phasing out two all-metal implants that were sold in the US.

These two implants, the Articular Surface Replacement (ASR) Acetebular Hip System and the ASR Hip Resurfacing System were recalled in 2010. DePuy stated "higher than expected revision rates" were the cause of the recall. In 2011, the FDA warned DePuy regarding selling artificial joint systems without proper removal and cites ineffective quality controls. As of 2013 the FDA has received thousands of metal-on-metal and all metal hip replacement. According to the New York Times nearly three-quarters of these complaints have been related to DePuy or their parent company Johnson & Johnson.

The first lawsuit surrounding the DePuy ASR begins on January 23 in Los Angeles, and Csengeri Law will be extensively monitoring it, and the federal cases slated to begin in May and July 2013.
