Seven plaintiffs will be allowed to make amendments to add Pinnacle Acetabular cup allegations without contesting the plaintiffs&apos; joint motion, as ruled by San Francisco Superior Court Judge Richard Kramer. This represents the first case in which both devices will be tried together.<br />

The Pinnacle device is another DePuy hip related implant that, while not yet recalled, is the subject of intense scrutiny. Like other metal-on-metal implants that have used the U.S. Food and Drug Administration 501(k) premarket process, the Pinnacle device skipped clinical trials. This fast tracking allowed the Pinnacle Metal-on-Metal Acetabular Cup Liner onto the market because it was "substantially equivalent" to similar models. <br />

Numerous metal-on-metal implants have been observed to have higher than average failure rates and cause health risks. This new judicial ruling in California could be a game changer in the ongoing legal battles DePuy has faced regarding the ASR implant. After being ordered to pay $8.3 million to former prison guard Loren Kransky earlier this year in California, DePuy continues to face scrutiny in the state. Inflammation of the joint lining is called synovitis. Synovitis  is such a common reaction in metal-on-metal implant patients that more than one FDA recall has been initiated with the devices.<br />

The new use of MRI technology might offer doctors an opportunity to find synovitis before a patient begins suffering from the worst symptoms. Ultimately, this may mean that an MRI can be used to detect implant failure before the tissue damage has become debilitating.<br />

The new studies that lead to the discovery were featured in The Journal of Bone &amp; Joint Surgery and involved measuring the synovitis damage around metal-on-metal hip implants. In a three party study, patients with unexplained joint pain surrounding an implant were found highly likely to suffer from the joint condition. Approximately 78% of patients examined for unexplained pain were diagnosed with synovitis, with a significant amount of inflamed joint tissue. In most cases,  the diagnosis suggested metal particles had abraded and caused the tissue damage.<br />

The MRI scans used in these studies continuously showed the levels of joint inflammation and tissue damage. The study concludes that using an MRI can give doctors early warning signs regarding synovitis and other joint inflammation surrounding an implant. This type of early warning could help doctors identify an implant as defective before soft tissue or bone damage becomes severe.<br />

For patients who are already suffering from a defective metal-on-metal implant, this study provides little immediate relief. Johnson &amp; Johnson (J&amp;J) biomedical arm DePuy had requested a new trial following the March trial in Los Angeles. In the original case, the jury found that the DePuy ASR hip implants were designed with defects and caused injuries to Kransky, a former Montana prison guard. DePuy announced in April that it would attempt to overturn the decision. DePuy had requested for a stay on the judgment and for the ability to file an appeal without bond. Judge J. Stephen Czuleger denied the request for a new trial and upheld the decision of the jury. Law360.com reports that the appeal was denied on the grounds that Kransky had provided sufficient evidence that the product were, in fact, defective.<br />

This phasing out of the metal on metal hip implants is systemic of the health industry trend that has more and more medical professionals avoiding metallic implants. In almost all circumstances this moving away from the metal on metal hip implants is due to extremely high early failure rates in many of the implants. <br />

In 2010 DePuy recalled the Articular Surface Replacement (A.S.R.) hip replacement system. The recall followed nearly 400 FDA complaints regarding the implant as well as a U.K. report that citing major failure rate in the metal-on-metal hip implant. The recall cited a potential for metal debris to break loose from the implant and cause metal toxicity in the implant patients. The second of nearly 11,000 cases regarding the recalled DePuy Articular Surface Replacement (ASR) hip replacement implant has come to an end in Chicago. On April 15, jurors heard the final arguments from Denman Heard for plaintiff Carol Strum, as well as the Johnson and Johnson legal team on behalf of DePuy. Heard asked the jury for upwards of $5 million in damages stemming from the recalled metal-on-metal implant. In an impassioned plea, Heard called for the jury to award Strum extra punitive damages to penalize the orthopedics giant.<br />

The jury recessed for just over a full day before delivering the surprising verdict. On the evening of April 16, he jury ruled on behalf of DePuy. The jury also rejected Heard&apos;s request for extra damages to be imposed against DePuy. The verdict in this Chicago DePuy ASR trial stands in stark contrast to the verdict in favor of former prison guard Loren Kransky, who received monies in excess of $8 million in his California DePuy ASR judgment in March.<br />
<br />
DePuy recalled 93,000 of the metal-on-metal implant in August 2010, following the Johnson and Johnson acknowledgement that the device had a higher than average failure rate. In this particular case, the Johnson and Johnson team argued that Strum had preexisting hypersensitivity. This condition caused problems for the implant, and the implant had not abraded and pushed chromium and cobalt into her body causing additional damages. While numerous metal-on-metal implants have led to build up of abraded metal particles, previous health issues prevented the jury from finding DePuy guilty of inappropriately marketing the recalled implant as safe.<br />
<br />
This case does represent a hurdle for patients suffering due to the recalled DePuy ASR implant, but the  legal battle for Johnson and Johnson and DePuy is far from over. Over 2,000 more DePuy ASR lawsuits have been filed in state court in California. It is currently estimated that three quarters of the total lawsuits will go to federal court in Toledo, Ohio.  The next DePuy ASR hip replacement trial is scheduled for federal court in Ohio in May.<br />

In Los Angeles Superior Court, a jury did find DePuy liable for approximately $8.3 million dollars in damages to former prison guard Loren Kransky. In the Los Angeles trial,  the jury found that design flaws inherent to the DePuy ASR hip replacement implant were responsible for pain and suffering caused to Kransky. They did not award additional $187 million in punitive damages sought out by Kransky&apos;s lawyer, Brian Panish. Even without punitive damages, the first case ending in a substantial reward on the side of the plaintiff created significant opportunities for other hip recall patients.<br />

In the second case, a Chicago jury rejected the claim that the DePuy arm of Johnson &amp; Johnson inappropriately marketed the device. In this second case, the particular physiology of plaintiff Carol Strum seems to have been a sticking point for the jury. They did not find sufficient evidence that the recalled DePuy implant was specifically responsible for many of the health issues Mrs. Strum face. DePuy lawyers suggested that some of these issues were, in fact, the reason the device needed to be recalled.<br />
<br />
While the debate on why the two trials have resulted so differently will likely continue for weeks, both trials have brought several pieces of less-than-flattering testimony against DePuy to the public eye. In the second of the DePuy ASR hip replacement lawsuits, one of the inventors of the device said he would not use it given the current information regarding failure rates. While Mrs. Strum was not awarded damages, the testimony from her trial could be potentially beneficial for future legal actions.<br />

      <title>In the Ongoing Chicago DePuy ASR Trial the Device Co-Inventor Testified He Would Not Use the Implant.</title>

      <title>A California Judge Reduced the DePuy ASR Hip Recall Judgment to Just over Eight Million Dollars</title>

Initially, Kransky and attorney Doug Saeltzer filed in excess of three hundred million in negligence and damages. Ultimately, the jury awarded Kransky the eight million in non-economic damages to Kransky, a former prison guard. While Kransky was awarded the eight million for his pain and suffering, Judge J. Stephen Czuleger issued a statement on March 22 that the both parties agreed the initial $338,136.12 awarded for medical expenses should be reduced under Montana law to account for amounts payable by a collateral source. While this does represent a significant differential between the amounts Kransky filed suit for, and the amount reward, Saeltzer says this verdict bodes well for future DePuy ASR hip recall patients seeking restitution from DePuy. "The message is that these cases are valid, that the injuries are real and severe, and Johnson &amp; Johnson and DePuy have to pay significant money for their mistakes" Saeltzer said recently.<br />

A jury in California Superior Court, based in Los Angeles, has awarded $8.3 million in compensatory damages to Loren "Bill" Kransky, a retired prison guard from Montana. The jury concluded that the design of the DePuy ASR Xl metal-on-metal hip replacement caused his injuries but that DePuy properly warned of the risks and didn&apos;t owe additional punitive damages. Johnson &amp; Johnson, largest seller of health care products on earth, recalled 93,000 of the defective implants in August of 2010.<br />

Johnson &amp; Johnson claimed in 2010 that twelve percent of the recalled DePuy ASR <a class="extlink"  target="_blank"  rel="nofollow noopener" title="metal-on-metal" href="http://www.csengerilaw.com/#&amp;panel1-2">metal-on-metal</a> implants failed within five years. Last year, forty-four percent failed in Australia inside of seven years.  Analysts have claimed the lawsuits could cost Johnson &amp; Johnson billions of dollars to resolve. In the closing arguments to the five week trial Kransky&apos;s attorney, Michael Kelly referred to the metal-on-metal implant. "This is not an imperfect hip; this is a public health disaster."<br />

Eric Gordon, a University of Michigan business professor has suggested that the verdict in this initial DePuy ASR Xl metal-on-metal hip recall trial is expected to set a "starting price" for other plaintiffs as far as settlement discussions. The overall verdict included $338,136 for Kransky&apos;s medical expenses and an additional $8 million for his physical pain and emotional suffering.<br />

This DePuy ASR hip replacement lawsuit is important as it will set a precedent for thousands of suits filed against DePuy. Professor Bobyn, of McGill University, testified that the device has multiple design defects. According to Bobyn these defects "alone or together cause it to fail at a much great rate than other hip implants." Bobyn also testified that when the hip fails it generates an "excessive amount of cobalt and chromium wear debris."<br />

Additional witnesses in the DePuy ASR hip replacement lawsuit include bioengineer James Anderson and orthopedic surgeon Dr. Peter Wendt. Anderson was a bioengineer inside the Johnson and Johnson DePuy unit who spent three years studying a redesign of the ASR metal hip. Anderson testified as to his frustration when the proposed redesign was shut down with no changes to the hip, and that a "small improvement" in the geometry of the hip would have created large improvement for patients. Dr. Wendt testified that a DePuy sales representative was the first to inform him that there were issues with the hip. Dr. Wendt also testified that he was initially shown the device under the auspices it had a 98% success rate, statistics that the New England journal of medicine have clearly contradicted.<br />

The information shared by Prof. Bobyn with the State Court of Los Angeles in the first of the major trials involving DePuy was significant. According to Prof. Bobyn, all 93,000 of the metal hip implants suffered from several defects. The defects stemmed from design flaws in the DePuy device which lead to much greater rate of failure than other similar devices. Professor Bobyn testified as an expert witness on behalf of plaintiff Loren Kransky, a former prison guard who filed suit due to his failed DePuy ASR hip replacement.<br />

According to Bobyn&apos;s testimony "any claimed benefits of the ASR were greatly outweighed by the risks of the implant." Bobyn also conferred with the opinion "causing it to fail, generating excessive amount of cobalt and chromium wear debris."  The initial design of the cup shaped DePuy ASR hip implant can cause it to warp and deform during implantation. According to Bobyn it&apos;s a matter of simple geometry. The Professor stated unequivocally "If I have a larger object that has to go into a smaller hole, something has to move." This warping of the implant cup leads to excessive cobalt and chromium wear, leading to debris collection.<br />
<br />
At the time of the recall, DePuy claimed that 12% of the ASR devices failed within five years, requiring a revision surgery. Attorney Michael Kelly expanded on this data, adding information from an Australian national registry that showed the DePuy ASR failure rate at higher than 40%. Paul Voorhorst, a DePuy statistician, said the company showed that 28% of ASR hips failed at a hospital in Finland. He also mentioned data form the United Kingdom national joint registry showing 27% of the hips failed inside of seven years. Independent analysts are estimating DePuy will pay billions to settle these suits.<br />
