Lam & Maloles, LLC Now Helping Clients with Estate Planning and Estate Administration Matters

Philadelphia, PA -- (SBWIRE) -- 11/20/2013 -- After almost two years of starting their trusts and estates practice, Lam & Maloles, LLC is pleased to announce that they continue to provide their clients with commitment, attention, and quality. In cases of death without a will, the decedent's assets and property pass through the intestacy statutes of the state with proper jurisdiction. One who dies "intestate," or without a valid will, will have his or her property distributed according to specific state rules. It is this reality that makes having a valid will all the more important, for it provides the individual making a will with control and direction over how his or her assets will be distributed upon death.

Provided the individual has the specific intent to devise a gift, has the mental and physical capacity to do so, and properly executes the document, the attorneys at Lam & Maloles can assist that individual in establishing a Will. With clear and specific language, an individual can designate beneficiaries, those receiving a benefit through a Will, and the specific gifts they shall receive upon death of the testator. As estate attorneys in Philadelphia, the attorneys at Lam & Maloles will work with their clients to make sure the estate planning process goes smoothly, providing their clients with the confidence they deserve. The attorneys at Lam & Maloles, LLC implement various techniques such as trusts, and legal disclaimers to ensure the property is distributed in accordance with the exact wishes of the client. The attorneys will review the different assets and valuables in their clients' possession and form an accurate plan to be executed in the event of a client's death or incapacity.

In addition to estate planning, the lawyers at Lam & Maloles shepherd their client's estates through the probate process. Generally speaking, probate is the process of filing a will within the appropriate jurisdiction, and establishing a court-approved Executor or Administrator, sometimes referred to as the "personal representative," of the estate. This representative is charged with the administration of the estate, which involves first paying any taxes or debts owed by the decedent, followed by proper distribution of bequests to the beneficiaries. The lawyers at Lam and Maloles work directly with the personal representative in creating an accounting which details the contents of the estate, how the estate has been managed, and assists them with the proper distribution of assets.

As these matters can be extremely complex, it is important to hire an attorney to set up estate planning which include the preparation of wills in Pennsylvania and to assist with estate administration matters. For more information on how the attorneys at Lam & Maloles, LLC can help or to set up a free initial consultation, please call 800-564-3872.

Lam & Maloles, LLC Announce Client Appreciation Event at New Location

Philadelphia, PA -- (SBWIRE) -- 10/14/2013 -- Lam & Maloles, LLC is pleased to announce that they will be co-hosting a client appreciation event on October 10, 2013 at their new office located in Center City, Philadelphia. Partners and Co-founders, Jeanna L. Lam, Esquire and Kathleen A. Maloles, Esquire are estate planning attorneys in Philadelphia who will lead a question and answer panel for guests of the event. For those ready to plan the distribution of assets in the event of death and incapacity, Lam & Maloles, LLC will ensure their clients' estates are handled in a professional manner and that no questions are left unanswered. Attorneys Lam and Maloles will bring to their clients' attention that not only does a will state whom the tangible and intangible assets of the client will pass to in the event of death, it also gives them the right to decide the next guardian for underage children and also appoint an executor.

The attorneys at Lam & Maloles will speak about how beneficial it is to set up a will as soon as possible in case of an accident or health problems that may arise unexpectedly. There is never a right time to plan, but most people will not want state law to dictate how to distribute their property. This could have a whirlwind effect on extended family, as a Judge can decide who is responsible for children if both parents are gone and which family members receive property.

Whether an individual's estate calls for simple or complex wills in Pennsylvania, Lam & Maloles, LLC will walk their clients through every step of the process to make sure they are completely satisfied with their decisions. Simple wills enable clients to plan for the distribution of property and name beneficiaries to the estate. Simple wills are created for individuals that simply wish to pass on their property and valuables to parties they wish to inherit their property. On the other hand, complex wills may involve planning for the passing of a business to the next generation, trust funds, or may contain language intended to minimize death taxes owed by an estate, etc.

Along with their estate planning services, the attorneys at Lam & Maloles, LLC will assist their clients with implementing beneficiary designations in accordance with their new estate plans.

To receive a free initial consultation or talk with the attorneys about estate planning needs, please call 800-564-3872 today.

Jeanna L. Lam, Esquire Speaks at SEAMAAC, Inc. Regarding Estate Planning for Philadelphia Area Refugees and Immigrants

Philadelphia, PA -- (SBWIRE) -- 09/06/2013 -- Lam & Maloles, LLC is pleased to announce that Co-Founder, Jeanna L. Lam was a guest speaker for the Southeast Asian Mutual Assistance Associations Coalition (SEAMAAC) on August 21, 2013. Ms. Lam spoke of the importance of having an estate plan in front of refugees, immigrants, and their families. Ms. Lam's speech was translated to both the Vietnamese and Cambodian languages. SEAMAAC was founded in 1984 by refugees and for 29 years has served and advocated for immigrants in the Philadelphia area. Their mission is to support refugees and immigrants as they seek access to opportunities which would advance the condition of their lives here in the United States. SEAMAAC maintains a variety of programs here in the Philadelphia area and Ms. Lam, an estate planning attorney in Philadelphia, spoke to further educate its members on how they can plan for the benefit of the intended beneficiaries of their estates.

Ms. Lam quoted, "For those ready to name beneficiaries and plan the distribution of their assets in the event of death or incapacity, the attorneys at Lam & Maloles, LLC will ensure that our client's estates are handled in an efficient and professional manner. Not only does a will provide for the passing of the estate and belongings of the testator, it also gives them the right to decide the next guardian for underage children and appoint an executor in charge of distributing the estate after death."

For many people, it can be tough to figure out the right time to set up a will however, death and incapacity can occur suddenly. If an individual fails to set up a will, then state law decides who receives the estate, which may make certain individuals uncomfortable with the default law. There are multiple forms of wills in Pennsylvania—from complex to simple—and the attorneys at Lam & Maloles, LLC will review the process in detail with each of their clients. Every person's finances and personal circumstances are different, and in order to ensure the client's belongings are distributed properly, the professional attorneys will put their client first and work until every need is met, which may include having a translator ready and available to ensure that the client understands the entire process.

Lam & Maloles, LLC will work with their clients to anticipate tax complications and set up trust funds if necessary. Serving the Southern New Jersey and greater Philadelphia area, clients can be assured their estate is in good hands with the professionals at Lam & Maloles, LLC. To receive a free initial consultation or talk with the attorneys about which route is right for their estate, please call 800-564-3872.

Lam & Maloles, LLC Announces Pennsylvania House Unanimously Votes to Eliminate the Pennsylvania Death Tax for Small Businesses

Philadelphia, PA -- (SBWIRE) -- 08/07/2013 -- Keeping their clients informed on all legal news regarding the Pennsylvania death tax, Lam & Maloles, LLC is pleased to announce that the Pennsylvania House of Representatives has voted unanimously to eliminate the inheritance tax for small businesses. This is good news for family-owned businesses that have been negatively affected by the existence of this tax in the past. Along with a unanimous decision to drop the tax from the House of Representatives, the elimination of the inheritance tax for small businesses has strong support in the beginning discussions between members of the Senate.

Legislation calling for the elimination of the inheritance tax for small businesses, known as Bill 48, is sponsored by Rep. Steve Bloom, R-Cumberland. The PA death tax is applied to real estate and all other business assets paid by children, siblings, and other descendants who inherent a business as part of an estate. Rep. Bloom was pleased that all democrats in the House of Representatives supported the bill. "This shows that small businesses are a priority for the House of Representatives," he said. Earlier in the year, similar legislation passed out of a Senate committee sponsored by Senate Majority Leader Dominic Pileggi, R-Delaware. Both Rep. Bloom and Senate Majority Leader Dominic Pileggi are hopeful lawmakers will act on the bill during the upcoming budget season.

Philadelphia Estate Planning Attorney Jeanna L. Lam, Esquire Speaks at the American Cancer Society Asian-Advisory Committee Meeting

Philadelphia, PA -- (SBWIRE) -- 07/23/2013 -- On June 14, 2013, Jeanna L. Lam, Esquire, Estate Planning Attorney in Philadelphia, presented on the topic titled "Planning for Death and Incapacity: What the Critically-Ill Patient Needs to Know?" at the American Cancer Society's Pennsylvania Division, Southeast Region's Asian Advisory Committee meeting. This year, the American Cancer Society celebrates its 100th year since its establishment by fifteen physicians and businessmen in New York City. In line with the American Cancer Society's goal of raising awareness about cancer and issues ancillary thereto, Ms. Lam spoke about the importance of the critically-ill cancer patient having a well-crafted estate plan addressing the following:

- A comprehensive estate plan does not have to be complex, but it should allow the cancer patient to dictate who will handle their affairs in the event of death or incapacity;
- Estate planning provides a cost-effective alternative to the appointment of a guardian in the event of incapacity, and also allows the individual to decide who will inherit their estate at death and the manner in which the estate will be distributed;
- Basic estate planning can greatly reduce costs and eliminate problems that may otherwise arise during incapacity or at death;
- An estate plan can provide peace-of-mind so that the patient knows that if anything happens, their wishes will be carried out.

As such, L & M Law, LLC continues to offer their assistance to those who are seeking to an estate plan prepared this July. Estate planning is not just for the wealthy, it is an essential part of any individual's financial planning and it should be done as soon as a person is able. However, unfortunately many people put it off until it is too late, and they either leave themselves or their loved ones in an unfortunate predicament. In addition, estate planning allows those who become incapacitated to have a plan in place for who will be taking care of them if they are unable to do so themselves. Last but not least, people will also be able to decide who receives theirs assets after they have passed away.

The benefits of having an estate plan put in place are endless, and those who are interested in hearing more about how they can get one created can visit L & M Law, LLC's website http://www.lmlawllc.com, or give them a call for a free consultation in regards to how they can help with estate planning.

L & M Law, LLC Now Offering Estate Planning and Administration Services in the Pocono Mountain Area of Pennsylvania

Philadelphia, PA -- (SBWIRE) -- 06/10/2013 -- The estate planning attorneys in Philadelphia, PA, at L&M Law LLC, have recently made themselves available for estate planning and estate administration legal services in the Pocono Mountain area of Pennsylvania. The areas they cover include but are not limited to, Wayne County, Lake Ariel and Scranton, PA.

This decision was made because Ms. Kathleen A. Maloles, co-founder and partner of L&M Law LLC, recently became a part-time resident of "The Hideout," a residential community in the Pocono Mountains, and saw the lack of legal services available for those that live and thrive either full time or part-time in the area. While this area is mainly a recreational community and people either come to vacation or to retire, they may find themselves at a loss when it comes to seeking out estate planning and estate administration services in the local area.

After someone purchases their vacation home, he or she will need to determine how to hold title to it. By utilizing the help of an estate planning attorney, homeowners will be informed on how to title a property properly before finalizing the home's purchase. Additionally, people may also want to be more careful if their vacation home is in a different state as there may be more hurdles, time, and money involved with administering the estate. However, whether or not the home is a vacation home, it is important that a person realizes their options when it comes to protecting their home and its assets from death taxes. With the help of the attorneys at the L&M Law LLC, people can guarantee that their estate and loved ones are better protected. To hear more about L&M Law LLC, and their estate planning and estate administration services now available in the Pocono Mountain area of Pennsylvania please visit www.lmlawllc.com.

L & M Law, LLC Now Helping Clients in Pennsylvania Negotiate with Creditors to Settle Debts of the Decedent This Spring

Philadelphia, PA -- (SBWIRE) -- 05/08/2013 -- Due to the economy these days, many people owe money to someone, and it's difficult to live in the current society without accumulating at least some form of debt. When someone passes away and has debt to be paid, most of the time the debt will not be forgiven by the creditor or debtor. In some cases the debt may be negotiated, but it all depends on what occurs when the decedent's estate goes through the probate process, and if the decedent has left enough money for their heirs to pay it off. To help people deal with this process, the attorneys at L & M Law, LLC, are now helping clients in Pennsylvania negotiate with creditors to settle the debts owed by the decedent as they are estate attorneys who can handle the probate process in Montgomery County, PA, Philadelphia, and the surrounding areas.

If someone passes away in Pennsylvania or New Jersey either with or without a will, creditors with valid claims will have priority over the heirs of the estate when it comes to its assets. In Pennsylvania, once Letters of Administration or Letters Testamentary are issued, the creditor has one year to bring a valid claim against the estate. This step is important to consider because if proper legal notice is given to the creditor, they may be barred from being paid from the assets of the estate.

At L & M Law, LLC, their estate attorneys can aid any clients who are faced with a creditor who has quickly filed a claim against a decedent's estate to settle their outstanding debts. Additionally, their lawyers can aid clients in properly providing the notices to creditors as required by Pennsylvania or New Jersey law.
L & M Law, LLC's Estate Planning Attorneys Are Now Currently Assisting Clients in the Preparation of Their Tax Returns

Philadelphia, PA -- (SBWIRE) -- 03/20/2013 -- L & M Law, LLC's estate planning attorneys in Montgomery County are now currently available to assist Executors and Administrators with the preparation of the state and federal tax returns that must be filed when administering a Pennsylvania or New Jersey Estate. Guaranteeing that proper estate planning is done will put a person in charge of his or her finances, and it will also make sure that a person's loved ones are spared from the burden of dealing with any unexpected expenses.

At L & M Law, LLC, estate administration attorneys work side by side with clients to offer personalized estate planning and tax help. A person works hard his or her entire life to save money and try to make good financial decisions so that he or she is able to have assets available after retiring, and able to leave an inheritance to loved ones after passing away. People who have large estates should consider what strategies are available to minimize how much they pay in estate and inheritance taxes. Therefore, the need to plan for the future is one of the many reasons why it is important to hire an estate planning attorney.

There is no denying that having a good estate plan in place will help guarantee that a person's assets are managed appropriately. Without a proper plan in place, a person's remaining assets may be distributed pursuant to the laws of intestacy, and this may make for unfavorable outcomes.
L & M Law, LLC Is Now Available to Assist with the Estate Administration Process in Montgomery County, PA

Philadelphia, PA -- (SBWIRE) -- 03/05/2013 -- Personal Representatives (i.e. Executors and Administrators) engage the estate attorneys in Montgomery County, PA at L & M Law, LLC to assist them with probate shortly after a person's death. Frequently, L & M Law's estate lawyers in Montgomery County are asked what to expect throughout the estate administration process. The attorneys at L & M Law are available to assist with the estate administration process in Montgomery County, PA. The following is also a brief overview of the probate process in Pennsylvania.

1. Filing for Letters of Administration or Letters Testamentary to have a Personal Representative appointed:

If the decedent dies with a Will, the person who is named Executor under the Will files a Petition for Letters Testamentary to become the appointed Executor of the Estate. If the decedent dies "intestate," meaning without a Will, the decedent's next of kin files a Petition for Letters of Administration with the Register of Wills to become the appointed Administrator of the Estate. However, if complications arise during this initial process, the estate attorney can counsel their client to accomplish their goal of being appointed as the Personal Representative.

2. Complying with Notice Requirements to the Beneficiaries and Interested Parties of the Estate:

The Executor or Administrator is legally required to notify beneficiaries and interested parties of the estate administration while it is in process. Pennsylvania Orphans' Court Rule5.6. outlines who must receive notice and when they must be notified.

3. Advertising the Estate:

The Personal Representative is also legally required to advertise the estate by requesting that all persons having claims against the estate make their claims known to the Personal Representative or his attorney, and that all persons indebted to the decedent make payment to the Personal Representative.

4. Marshalling the Decedent's Assets:

The Personal Representative has the legal authority to secure and collect the decedent's assets as well as ascertain the extent of the decedent's debts.

5. Inventory of the assets of the decedent's estate:

This document must be filed with the Register of Wills within nine (9) months from the date of death of the decedent. The inventory is a statement of the probate property and the value of such property on the date of the decedent's death.

6. Preparing and Filing the Appropriate Death and Income Tax Returns:

The following are the death and income tax returns prepared by L & M Law's estate planning attorneys in Montgomery County:

State Death Tax Returns

-The Pennsylvania Inheritance Tax Return (Rev-1500) is due within nine (9) months from the date of death of the decedent. This return reports the assets and debts of the decedent. Depending on the relationship of the decedent to the beneficiary, inheritance tax may be due to the Commonwealth. The Personal Representative is responsible for ensuring the filing of these returns, as well as the filing of the decedent's Final Income Tax Returns (IRS Form 1040 and PA-40) and if applicable, the Estate's Fiduciary Income Tax Returns (IRS Form 1041 and PA-41).
Federal Estate Tax Returns
-If the estate exceeds the Federal estate tax exemption amount, the estate must also file a Federal Estate Tax Return (IRS Form 706) and pay the associated tax, if any.
Estate Fiduciary Income Tax Returns
-The Personal Representative is responsible for ensuring the filing of these returns, as well as the filing of the decedent's Final Income Tax Returns (IRS Form 1040, and PA-40) and if applicable, the Estate's Fiduciary Income Tax Returns (IRS Form 1041 and PA-41).

7. Paying the Debts of the Estate:

Once the Personal Representative has an accurate accounting of the decedent's assets and debts, and provided the estate is not insolvent, he or she may pay the debts of the estate. If payments are made without knowing all assets and debts, the Administrator or Executor puts him or herself at risk for being personally liable to the interested parties of the estate. Furthermore, personal liability also exists if the estate is insolvent and the Personal Representative made payments contrary to what is required by law.

8. Settling the decedent's estate:

The estate may be settled informally by means of a Family Settlement Agreement between the personal representative and the beneficiaries of the estate. If the estate cannot be settled informally, a formal court proceeding, which includes filing of an account, proposed schedule of distribution and a Petition for Adjudication, may be necessary to settle the estate.

9. Distributing the Assets of the Estate to the Beneficiaries of the Estate:

After a Family Settlement Agreement is signed by the beneficiaries or an account is approved by the Orphans' Court, the estate is distributed to the beneficiaries of the Will or the intestate heirs of the estate.

Given the complexities and risk associated with administering a decedent's estate as required by law, it is best to consult with L & M Law, LLC's estate lawyers in Montgomery County to be counseled through the entire process. L & M Law, LLC also offers convenient meeting locations in Bala Cynwyd, King of Prussia and Plymouth Meeting to discuss any estate planning or estate administration matter.

Philadelphia, PA -- (SBWIRE) -- 01/30/2013 -- The new American Taxpayer Relief Act of 2012 helped to clear up the future of the federal transfer tax systems and estate planning. L&M Law LLC is now assisting people with the new federal estate laws in Montgomery County, PA, to help them understand the new changes that have been put in place.

The Act permanently established the estate tax, gift tax and generation-skipping transfer tax exemption at $5,000,000 per person (indexed for inflation). This means that in 2013, the exemption amounts adjusted for inflation) will increase to $5,250,000 per person. The maximum tax rate for transfers in excess of the exemption was also increased from the 2012 rate of 35% to 40%. The estate attorneys in Philadelphia at L&M Law LLC are well versed in these areas and are available to help those who have any questions with these changes.

In addition to the provisions affecting the federal transfer tax exemptions and tax rates, the Act made permanent the estate and gift tax portability rules applicable to married couples, as well as permanently eliminated the state death tax credit, which, if reinstated would have had the result of increasing state death taxes by a considerable amount. These changes can all be addressed by scheduling an appointment with the estate planning attorneys in Philadelphia at L&M Law LLC, their people will find a trust worthy law office to answer all of their questions.
