During a hearing on 26, Judge Casarow of the Mid-Salem Municipal Court dismissed the DWI, reckless driving, and Possession of a controlled dangerous substance in a motor vehicle charges against his client, P.P. Mr. Lukach successfully challenged the operation of the motor vehicle in this case, which is one of the elements of proving a DWI, reckless driving, and possession of CDS in a motor vehicle.<br />

To do this, the state will typically ask for the individual to be urine or blood tested. Back at the station, the Drug Recognition Evaluator (DRE) will ask the individual to do additional testing. With testing, the officer will try to draw a link between the drugs that were in the person&apos;s system, with their ability to operate a vehicle. <br />

Also, the less-experienced DRE is performing scientific testing on the individual after only 144 hours of training. A Pharmacologist performs the same task after approximately 7 years of training. This difference becomes important if an overzealous DRE is looking to make a bust on insufficient evidence. He may be more inclined to "recognize" symptoms on signs that may not really be present. This puts the Court on notice from the beginning that the defendant is demanding a speedy trial. In determining if a defendant&apos;s right to speedy trial has been violated, there are 4 factors the Court must consider. The first is "when did the Defendant assert their right to a speedy trial". The second is "how long was the delay". The third factor is "what was the reason for the delay." And the fourth factor is "what prejudice has the defendant suffered.<br />

The length of delay doesn&apos;t mean the case has to drag on forever.  Courts have dismissed cases after three months.  Other courts have dismissed after 16 months, as seen in the case summary above.  But there is no doubt that the longer the delay, the more it&apos;s weighed against the State.<br />
<br />
Reason for the delay is an important prong.  A defendant cannot keep on postponing a case and then expect the court to grant a speedy trial motion.  Delays that are attributable to the State always help the defendant.  This is important in DWI cases where many prosecutors will drag their feet in turning over discovery.  Any evidentiary delays are attributable to the State.<br />

Finally, the Court&apos;s must consider the prejudice to the defendant that the delay has caused. If the delay caused a defense witness to be unavailable or caused a piece of evidence to be destroyed, the Court in State v. Cahill said that would weigh greatly against the State. One of the most important rights a DWI defendant has is their right to a speedy trial.
