Robert Golan, PC of Golan & Masiakos, LLP Wins Two Important Workers Comp Cases

Robert Golan, PC of Golan & Masiakos, Wins Two New York Workers Compensation Benefits Cases

Plainview, NY -- (SBWIRE) -- 04/06/2018 -- Robert Golan, PC of Golan & Masiakos, LLP has won two important cases for his clients recently. As one of the best lawyers for workers compensation cases in Nassau, NY, Robert Golan fights the insurance companies to get the medical treatment and compensation needed for his clients and gets results, and these recent case rulings in his clients' favor confirm this.

The first case involved a woman who got injured volunteering for a religious institution. She assisted with religious observances by preparing and serving food, cleaning up afterwards, handing out programs and paperwork for congregants and more. She fractured her leg after a slip and fall, and the insurance company contested the case on the grounds that as a volunteer she was not entitled to workers compensation benefits.

Mr. Golan argued that because the employer derived a benefit from her voluntary services that they otherwise would have had to pay someone to perform, she was entitled to benefits. The judge agreed and she received medical treatment and compensation for her injury.

Another case involved a woman who fell on a waxy floor at the hospital where she worked and hit her head, which caused a detached retina in her eye. The insurance company contested the case claiming that her symptoms–seeing floaters and flashers in her field of vision–didn't appear until months later, so the head injury could not have caused the detached retina.

Mr. Golan won the case by obtaining the medical reports that proved that she did complain of seeing floaters and flashers in her vision right after the accident. A clear indication that the detached retina was a direct result of the fall at her workplace and she received workers compensation benefits. These benefits included having workers compensation pay for her medical treatment as well as receiving monetary compensation for her loss of vision as the result of the detached retina.

Preparing for a Worker's Compensation Independent Medical Exam – Tip Sheet

Provides 5 tips on how injured workers can prepare for an independent medical exam to determine the appropriate amount of worker’s compensation benefits.

Plainview, NY -- (SBWIRE) -- 12/21/2017 -- If a worker has been seriously injured at work, that worker may need an independent medical exam (IME) to determine worker's compensation benefits. If an IME has been scheduled, here are five ways to prepare, according to Robert Golan, PC of Golan & Masiakos, LLP:

1. Talk to an attorney

A worker's compensation disability attorney is the most valuable asset when navigating a worker's compensation claim. A good lawyer can help use the independent medical exam to benefit the injured worker. For example, the attorney may advise the injured worker to focus on a particular aspect of the injury and how it impacts his/her quality of life or provide specific information about the examiner assigned to the worker's case.

2. Bring a witness

The attorney may ask the injured worker to bring a witness to the IME. A witness can be useful if there are concerns about the fairness of the exam. When bringing a witness to an IME, select a trusted friend or family member to come along to the appointment. Ask the witness to take notes on the details of the exam, such as what questions the doctor asked, what tests he/she performed, and other relevant details. The witness should not actively participate in the IME by answering questions or adding details to the statements. Choose a witness who will quietly observe the examination.

3. Write notes

When entering the examiner's office, the injured worker might have a long list of symptoms in mind, but explaining these symptoms on command and in detail is another matter. Organize the thoughts beforehand by writing out a list of symptoms from the injury, the activities that no longer can be performed because of the injury, a list of activities that make the injury worse, and any treatments or medications that have been provided by other medical professionals.

4. Arrive early

Most medical examiners request that paperwork be completed before the appointment. Arrive 15 to 30 minutes early to keep the examination on schedule and make a good first impression.

5. Be honest

Although it is important that the examiner understands the full effects of the injury, don't exaggerate the symptoms during the IME. Be completely honest about the extent of the injury. If the treatment is improving the symptoms, inform the examiner.

Following these five tips can make an independent medical exam be less stressful and make sure that the injured worker gets the proper compensation for the work injury and assure that the injured worker can regain his/her health.

Tip-Sheet Featuring Questions to Ask a Workers Compensation Attorney After Receiving a Work Illness or Injury

Robert Golan, PC of Golan & Masiakos, releases a new tip sheet for clients seeking the services of a worker’s compensation attorney before hiring one.

Plainview, NY -- (SBWIRE) -- 10/02/2017 -- Robert Golan, PC of Golan & Masiakos, provides a tip sheet for the questions to ask a worker's compensation attorney during a free consultation. This consultation provides a chance to ask questions about a possible case and learn which lawyer is right for the case. This tip sheet provides four questions to ask during a legal consultation to help find the right workers compensation lawyer for a case.

What are the fees?

Most Queens workers' compensation attorneys are paid through a contingency fee. This fee depends on state laws, the lawyer, and the complexity of the case. In the state of New York, the client typically pays the lawyer 10 to 20 percent of the final settlement. Be wary of attorneys charging a much higher or much lower percentage. Those asking for more may be trying take more than their due, while those asking for less may not be qualified to handle the case.

Has this lawyer worked on workers' compensation cases before?

Not every lawyer will be a good fit for the case. Make sure to choose an attorney with significant experience working on workers' compensation cases.

How many other cases is the attorney working on?

Many attorneys do not take on an appropriate caseload. Some take on too many cases at once and neglect to spend enough time on any of them. Others take on too many cases and wait to file your case while they finish up others. Or, they may farm out other cases to inexperienced attorneys at the firm. At the case evaluation, make sure that the attorney will start work on the case right away, and that the attorney will be the one working on it.

What is the case worth?

A lawyer with experience in cases similar to yours will be able to provide a ranged estimate of what the case may be worth. Be wary of attorneys who guarantee a particular number or provide a number that seems unrealistically high.

Robert Golan, PC Provides Guidelines for Determining if a Workers Compensation Attorney Is Needed

Robert Golan, PC of Golan & Masiakos, provides guidelines on if you should contact a workers compensation attorney

Plainview, NY -- (SBWIRE) -- 06/28/2017 -- If you've been injured at work, you have to decide whether to hire a workers' compensation attorney or pursue a claim alone. If the case is fairly simple, legal assistance from a workers' compensation lawyer may not be necessary. For example, you may be able to pursue a claim alone if the following apply to you:

-The injury is minor
-The employer admits that the injury is work-related
-You missed little or no work due to the injury
-You have no pre-existing conditions or disabilities

Workplace injury cases, however, can become much more complicated. In these cases, a workers' compensation attorney can help you receive the entitled benefits. According to the National Law Review, workers who file a workers' comp claim without legal assistance usually receive only one-quarter of what their cases are actually worth. If any of the following are true, contact a workers' compensation attorney right away:

-The injury is moderate to severe, especially if it requires surgery

-The doctor believes that the injury will have a permanent effect on your health

-The employer denies the worker's claim

-The employer's settlement doesn't cover all lost wages or medical bills

-The injury prevents you from returning to the job or doing any work at all

-The boss has fired you, demoted you, or cut your hours/pay because you filed a workers' comp claim

-A third party contributed to the injury

-A pre-existing condition or disability

If at any point you feel unsure about the case, schedule a free consultation with a workers compensation disability attorney to identify any potential complications.

Long Island Workers Compensation Lawyer Wins Multiple Decisions for His Clients

Robert Golan, PC of Golan & Masiakos, LLP persuades appeal panels to rule in favor of his clients.

Plainview, NY -- (SBWIRE) -- 04/24/2017 -- Robert Golan, PC of Golan & Masiakos, LLP wins multiple rulings recently favorable to his clients. Mr. Golan, persuaded the appeal panel to overturn a lower court judge's decision that the client was 92% disabled, and agree that the client is 100% permanently and totally disabled–for life. This was crucial to the client because only injured workers with a 100% permanent disability are guaranteed lifetime benefits. If the 92% ruling stood, this would have ended her benefits after 9 years.

An insurance company appealed a lower court judge's opinion that his client lost 30% of the use of his arm, permanently, and argued that it was only 10%. Mr. Golan prevented this appeal by providing doctors to confirm that the client did indeed lose 30% use of the arm permanently, and the appeal panel agreed, affirming the lower court judge's opinion.

Mr. Golan also got another client's monetary benefits reinstated when a trial judge cut them off because the client missed a hearing. She missed this hearing because her 10 year-old son got sick at school and required an emergency doctor visit. Because of the missed hearing, the workers compensation judge stopped her payments, which was her only source of income. Mr. Golan convinced the supervising judge to grant her a new hearing–with a different judge–and her benefits were reinstated.
At trial, it was determined that the employee in this case, suffering from back injuries, had filed her case too late. Under New York State's Workers' Compensation Law, injured workers have up to two years to file claims.

In this case, the woman filed when she realized she had an injury due her activities at work, which consisted of repetitive bending, lifting and holding her body in a fixed position. But the judge in her case ruled she "knew, or should have know" back in 2010 that her injury was directly related to her job. She sought medical treatment for her back at the time, but was not told her injury was work-related.

According to her Long Island Workers' Compensation attorney, Robert Golan, the woman could not be held accountable for any earlier diagnosis or actions as a result of it.

"I argued the worker isn't a doctor and has no medical training," Golan said. "She can't be charged with 'knowing' that she has a work-related medical condition until her doctor tells her so."

Golan argued that his client did file a claim when she was finally told by a medical professional her condition was work related in 2015. Based on discovery, this time frame fell within the two-year deadline. The argument convinced the Appeal Bureau to reverse the trial judge's original decision that the case was not filed in a timely manner. The plaintiff won all her Workers' Compensation benefits, including those she should have been awarded over the original two-year period and all necessary medical treatment.

Robert Golan is a leading Long Island work injury compensation lawyer serving the greater New York area and Suffolk County. He opened his solo practice in 1999. He handles every case personally because he had seen how large firms always gave clients the impression experienced senior partners would manage their case, only to eventually discover a junior associate learning their craft at the client's expense, was representing them. In that regard, Golan manages all his cases beginning to end, providing every client with comfort knowing an experienced work accident compensation lawyer is defending them on Long Island.

Besides this current victory, Golan has argued and won several other high profile and publicized appeals, including Funke v.
Tip Sheet: What to Do if a Workers' Compensation Claim Is Denied

If a Long Island injured worker faces a denial, yet is out of work or has mounting bills, there is a chance to reverse the decision and win an appeal of the Workers’ Compensation case. Here’s a few reasons why cases are denied and what can be done.

Plainview, NY -- (ReleaseWire) -- 08/01/2016 -- Injured workers face a difficult task when they submit their claim for Long Island Workers' Compensation and it is denied. Injured workers are often denied compensation even while facing mounting bills with no way to repay these and no compensation granted to them. However, in an appeals case, there is often a technical detail or a piece of evidence that is considered and enough to grant the injured worker the compensation needed.

Reasons for Denied Cases and Tips to Appeal

1. Workers' Compensation cases are denied for many reasons. Insurance companies will often research a case, looking for any reason to deny the injured worker from compensation.

Denials can come from investigation around the injury being a pre-existing condition. If the previous condition was worsened after the injury, then the worker should receive compensation. Often, proving the worsened effect of the pre-existing condition takes the report and documentation from a doctor.

2. An injured worker will need to contact the insurance company to determine the reason behind the claim's denial. The reason may be as simple as a missing piece of paperwork or information from the file.

3. Many employers list employees as third-party providers instead of employees. In 2010, the New York State Construction Industry Fair Play Act law was enacted. This law states the definition of a third party contractor and an employee. There are also factors a judge will use to consider if an individual is an independent contractor in non-construction industries. The law presumes that a person who performs services for a contractor is officially an employee of them. The law lists the specific application and definition of the law in Workers' Compensation cases.

4. Other contested cases can involve minute details that try to incorporate different factors of the person's life like other reasons for the injury besides it being work-related, acceptance of retirement for reasons other than the injury, and faulty doctor reports. The judge presiding over the case could take these issues into consideration and deny the claim.

5. If the attempt to reverse the denial with the insurance company doesn't work, then the client needs to file an appeal. Either side can appeal a judge's decision within 30 days of the filing in New York. An appeal is filed through writing for the Board to review through an application of appeal. The panel, consisting of three Board Members, reviews the appeal request.

Long Island Workers Compensation lawyer, Robert Golan, PC, had success winning three appeals for contested Workers' Compensation cases in new recent decisions. The NYS Workers' Compensation Board, a court appointed administrative agency where the cases were held, issued a decision in favor of Robert Golan's clients after successfully convincing the appellate Judges of their serious injuries. Mr. Golan has had success arguing and winning several high profile case appeals, including Funke v. Eastern Suffolk Boces and Nickel v. Pilgrim Psychiatric Hospital. Mr. Golan won 3 appeals in contested Workers' Compensation cases.

Tip Sheet: 4 Tips for Injured Workers Expecting Employer Retaliation for Workers' Compensation Cases

Injured workers on Long Island who file for Workers’ Compensation may face retaliation from employers. Read these 4 tips to find out the rights of injured workers in New York.

Plainview, NY -- (ReleaseWire) -- 03/29/2016 -- Robert Golan, PC, a trusted Long Island Workers' Compensation attorney, has seen employers and insurance companies retaliate against employees' claims. The initial steps of submitting a claim may look easy, but looks can be deceiving. In this tip sheet, Golan helps injured workers understand what to expect during the process of receiving Workers' Compensation.

When a workplace accident takes place, the injured worker is faced with a lot of complications. Accidents can happen anywhere. New York state laws cover a number of workplace accidents that range from slips and falls, inadequate security, negligent conditions, mistakes, and more.

Injured workers can quickly find out their rights under the law and whether their injury is covered under the Long Island work accident compensation plan. However, when attempting to get a case started, employees often find their employers retaliate against them.

Tip # 1 – Injured Workers Cannot Be Fired for Filing a Claim

Under New York law, an employee cannot be fired for filing a compensation claim or testifying in a case proceeding. It is the right of the injured worker to receive compensation. The injured worker has up to two years to file the claim. If the employee believes they were harassed due to filing a Workers' Compensation claim, they can file a discrimination claim against the employer.

Tip # 2 – Be Prepared for a Dispute

After the case is filed, a judge is assigned to administer the proceeding of the case. Employers do have the right to dispute the employee's claim. They may attempt to deny the injury happened and the extent of the injury. Employers have tried to use pre-existing injury or illness to deny a claim.

Tip # 3 – Get a Third Party Doctor

If an employer determines that the injury does not keep a worker from performing certain job duties, benefits may be terminated. The employee then has to return to work. During certain situations, the issue may arise from a glitch in the paperwork. The injured worker can see a doctor for their opinion and to correct the paperwork.

If the doctor is a state employee, they may not have knowledge as to the extent of the injury or work performed. It is best to see a third party doctor that is not affiliated with the state.

Tip # 4 – Injured Workers Can Return to Work

In New York, employees can return to work and perform light duties. If the injured worker decides to return to work, the employer must permit them to return to the same or equivalent position. The return to work impacts benefits, depending on the amount currently received. If the amount an injured worker receives after returning to work is less than before, the benefits may make up for the decrease in wage earnings.

Tip Sheet: Tips on Appealing or Settling Workers' Compensation Cases

Find tips to appealing or settling a Workers’ Compensation cases from Long Island attorney Robert Golan, PC.

Plainview, NY -- (SBWIRE) -- 11/05/2015 -- One of the toughest things to hear is that an injured worker is denied Workers' Compensation benefits. Even though the evidence was presented to the court, there's often ways that insurance companies and employers can use to receive a denial ruling. However, all is not lost. Here's a few tips on how to appeal the decision.

1) File a petition – After a case is denied, the initial appeal process requires a petition to be filed for a judge to review the case within 30 days. A Workers' Compensation attorney in Long Island can help prepare the necessary documents and find any missing evidence to present for the case.

Denials in cases may have only been the result of not having a specific document or not describing the extent to which the injuries caused harm enough to show an impact to the judge or panel.

2) Get a medical decision – The attorney may decide the client needs to be re-evaluated to show the extent of which the injuries impact their function at work and life. Having another review of medical issues would present a report on the injured worker's medical condition.

Given time, the Workers' Compensation Long Island attorney may ask for the medical reviewer to give a testimony about the injured worker's extents to their injury. Otherwise, the judge would review the evidence that was used in the original case.

In settlement cases, an injured worker has a few things they need to look at to ensure they want to settle. One thing they need to review is whether the compensation will be enough for their injuries. Depending on the amount of time the injured worker is out of work and the costs of their injuries, the settlement should cover this amount and more.

Deciding to appeal or settle a case should be carefully considered during the process of claiming Workers' Compensation. A work injury lawyer in Long Island helps claimants begin the process of appeal or settlement.

Mr. Golan has extensive knowledge of the appeals process, winning cases for clients based on factual evidence presented, argued and won in highly publicized appeals in New York.

Tip Sheet: Seven Things to Do Following a Workplace Accident by Robert Golan, PC

Robert Golan, PC discusses the seven things an injured worker must do after a workplace accident to ensure a successful case resolution.

Plainview, NY -- (SBWIRE) -- 07/02/2015 -- A workplace accident can be a stressful and potentially expensive experience. So it's important to know what to do what that unfortunate event occurs. Robert Golan, PC helps injured workers receive Workers' Compensation benefits on Long Island. With extensive experience, Robert Golan, PC's goal is to ensure injured workers receive all the benefits and medical care to which they are entitled.

Here are the seven steps injured workers should take when a workplace accident occurs to ensure they are covered legally under the Long Island Workers' Compensation laws.

1. First, get medical attention. This is the first priority when a worker is injured on the job. Get any First Aid needed can before the ambulance arrives to keep the injury from getting worse.

2. Once the worker's medical condition has stabilized, the next thing an injured worker must do is hire a Long Island work injury lawyer. Workplace accidents are a serious legal matter and require the services of an attorney experienced in this field.

3. The third step a worker who has been injured at work should take is wait to discuss the case. Workers need to be careful about who they talk with about it. Injured workers should not talk with anyone except their Long Island Workmans' Compensation attorney.

4. Another issue that Robert Golan, PC has come across in Workers' Compensation cases is to warn workers not to sign anything without getting a consultation. This includes paperwork for medical care and expenses.

"Often," Mr. Golan said, "workers are asked to fill out paperwork that have clauses which release the company and medical provider of liability of injuries. This could apply to the work injury they suffered. It's important to consult their attorney prior to signing anything."

5. The fifth step following a workplace accident is tracking all your expenses, especially medical expenses. As the old saying goes, it isn't documented, it can't be proven that it happened. If a worker can't prove it happened, then it can't be compensated or reimbursed.

6. Next, the injured worker should stay in regular contact with the attorney. He or she is trying to get the full compensation deserved under Workers' Compensation laws.

"Everything needs to be reported even if it is remotely relevant to your case," Robert Golan, PC said. "It's better to have too much information than not enough, especially something that seems inconsequential but later could turn to be critical."

7. Finally, following a workplace accident, injured workers should respond to any inquiries promptly. Any litigation comes with a lot of paperwork. If it is not filed on time, not only could a worker with injuries owe penalties, but also the case might be compromised or even dismissed. A client needs to stay in regular touch with their attorney so all the relevant paperwork can be filed on time.

Tip Sheet: Legal Help for Those Seeking Workers' Compensation Benefits

Robert Golan, PC, a Queens Workers’ Compensation attorney, shares the top tips for helping injured workers know what to do after they sustain an injury on the job and are denied benefits.

Plainview, NY -- (ReleaseWire) -- 02/27/2015 -- The Workers' Compensation program is designed to provide financial assistance to those who experience workplace injuries or job-related illnesses. The denial of benefits can be frustrating, but individuals who encounter such a roadblock should realize that it is not the end of the road. Although such denials can be challenged, it will take the involvement of a Queens Workers' Compensation attorney to help you obtain the benefits to which you may be entitled.

Tip # 1: Timely Communication after Denial Letter

The letter of denial an injured worker receives should include an explanation of their legal rights in the event they wish to appeal the decision. It will also provide a deadline for filing an appeal.

Since Workers' Compensation is primarily administered by the states, this deadline may vary, although the normal time limit is between 30 and 90 days. Injured workers who miss the deadline will seriously jeopardize any hope of receiving compensation, which is why they should carefully review and fully understand the regulations in their state.

Tip # 2: Seeking to Appeal a Decision

Benefits may be both denied and challenged on different grounds. In one case, a client seeking assistance was found to be "attached to the labor market" because he was seeking employment within his medical restrictions. Due to the length of the appeals, the client was awarded retroactive compensation in addition to his weekly benefits.

In another case in which an insurance company tried to reduce by two years the benefits requested by a client, a judge extended her period of compensation after an appeal. Queens Workers' Compensation lawyer, Robert Golan, PC, won both of these cases.

Tip # 3: Reopening a Workers' Compensation Claim

The process of reopening a claim is altogether different than filing an appeal. However, it is still be possible under certain circumstances. The most common reasons for reopening a case include the following:

- The injury or condition has worsened or returned
- The original claim has been justified by new evidence
- The award was found to be unfair or inadequate
- The unfair treatment resulted from some legal or administrative error
- The unfair treatment was found to have resulted from fraudulence
- The alternate job duties to which the worker was assigned are no longer available

The process of reopening a case and the time limitations available for such action also vary between states, although the period can be as short as three years and as long as seven years. The deadline is based on the date that the claim was denied rather than the date of the injury. Some cases will be considered closed when the final payment is issued and a release is signed.

Injured workers who wish to reopen a case should apply with the Workers' Compensation commission in their area and request the appropriate forms. They will also have to provide the proper supporting documentation. Whether it involves an appeal or the reopening of a case, a consultation with a Queens work injury compensation lawyer can help ensure the protection of your rights as an American worker.
