Goldstein Bachman and Newman Revamps Divorce Consultation Process

Goldstein Bachman and Newman overhauls divorce process from beginning

Old Bridge, NJ -- (SBWIRE) -- 06/04/2014 -- Goldstein Bachman and Newman (www.goldsteinbachman.com/middlesex-county-divorce-lawyers) understands divorce is a stressful time in a person's life and that he or she may be dealing with pressing financial issues, leaving little money for the hiring of an attorney. The firm now offers a free initial consultation to help those wishing to dissolve a marriage so one can meet with an attorney and determine if he or she feels comfortable with this person and the offered legal representation.

"This is just one way in which the attorneys at Goldstein Bachman and Newman (goldsteinbachman.com) feel they can help reduce the stress associated with divorce. Contact us today to set up this consultation as no one should have to stay in a marriage where they are unhappy," Howard Bachman declares.

New Jersey understands the high toll divorce takes on a person, physically, mentally, and emotionally, and requires all parties divorcing in the state take part in an Early Settlement Panel. A neutral arbitrator talks to each spouse, hearing their arguments, before making one or more recommendations on financial matters related to the divorce. In addition to the Early Settlement Panel, divorcing couples often choose to take part in a collaborative divorce or divorce mediation.

"Goldstein Bachman and Newman strives to reduce the financial burdens associated with dissolving the partnership, yet the attorneys also work to reduce the emotional toll the divorce places on all involved, especially any children of the marriage. Each option offers its own advantages, and both parties need to agree to fully take part for the best results," Bachman explains.

A collaborative divorce involves two parties and their attorneys agreeing to resolve their disputes without the need for appearing in court. This private process works for many as it can be adjusted to meet the unique needs and schedules of the divorcing spouses. With this process, spouses share costs for any experts or specialists called in. As Bachman points out, most find the process is not only more cost-efficient than going to court, it also takes less time.

Divorce mediation, unlike the Early Settlement Panel, tackles all issues associated with the divorce, such as child visitation and custody, and this isn't a formal procedure handled through the court. A private mediator comes in to work with the spouses in an effort to find acceptable compromises for all disputed issues in the divorce.

"Consider all options when determining how best to handle a divorce. Thanks to the many options now available, couples often find the process to be less stressful than they imagined. The free consultation offered through Goldstein Bachman and Newman remains the best place to discover the options offered and which is best for any particular couple's situation," Bachman announces.

Goldman Bachman and Newman Reveals Three Firm Attorneys Participate in ESP Panels

Goldman Bachman and Newman litigates all portions of divorce case

Old Bridge, NJ -- (SBWIRE) -- 05/27/2014 -- New Jersey differs from many states in that it requires divorcing parties participate in a process known as the early settlement program to avoid a court appearance. This alternative dispute resolution procedure strives to help parties reach an equitable agreement when it comes to disputed matters quickly and efficiently. Doing so halts the litigation process and reduces the costs associated with divorce proceedings while easing the emotional burden of all involved.

"Goldstein Bachman and Newman understands the early settlement program (http://www.goldsteinbachman.com/practice-areas/) and what it entails. When one goes before a panel of two court appointed lawyers, he or she needs an attorney to advocate their position and protect their rights. The panel hears both sides and renders their opinions. What makes Goldstein Bachman and Newman uniquely qualified to assist clients is three attorneys from the firm currently work on these panels regularly, a sign they are extremely proficient in the matrimonial law field," Howard Bachman of Goldstein Bachman and Newman (goldsteinbachman.com) explains.

The Early Settlement Panel (ESP) deals with certain financial issues arising within a divorce, including alimony, child support, attorney fees, and property division. As many cases involve custody and visitation issues, the attorney may recommend various other mediation programs to revolve these and other matters of the divorce.

"Attorneys at Goldstein Bachman and Newman regularly handle cases involving collaborative divorce, high net worth divorces, domestic violence, college expenses after divorce, and more. Many couples fail to recognize the importance of divorce tax planning, and the attorneys at Goldstein Bachman and Newman can be of assistance here also," Bachman continues.

Couples in the midst of a divorce need to understand how assets received during the equitable distribution process affect their taxes. An experienced attorney outlines the benefits of transferring assets in some situations and offering them for sale in others. In addition, he or she details how income tax is affected by alimony and child support obligations and how to minimize estate taxes levied later in life by careful planning during the divorce process.

"Divorce affects one's life for many years to come. Mistakes made during this stressful time tend to come with severe consequences. To prevent this from happening, one should always retain the services of experienced counsel as the right attorney works to protect his or her client's rights while ensuring they get what they deserve," Bachman states.

Goldstein, Bachman and Newman Launches Awareness Campaign for Child Support Rights

Law firm combats dwindling court order compliance by promoting recovery options

Old Bridge, NJ -- (SBWIRE) -- 04/16/2014 -- Nationwide legal reports reveal an estimated 12 million child support orders currently exist across the country, representing only 33 percent of the number there should be. Of those in existence, approximately half remain outstanding, leaving 6 million children and their custodial parents in the lurch. In light of these figures, family law attorney Howard Bachman of Goldstein, Bachman and Newman has launched a campaign to educate those in the Middlesex County area regarding their rights and the laws pertaining to child support.

Said Bachman, "State laws dictate children should not suffer financially because their parents are divorced, and the amount of support they should receive is calculated based on a number of circumstances. Support is awarded to ensure children benefit from both parents' income, so they never lack the basic necessities. Though the law is clear, there are many misconceptions in respect to child support. The statistics are also a bit misleading, but only slightly so."

Delving deeper into this matter uncovers factors supporting Bachman's statements. Common belief dictates a court order ensures receipt of child support; on the contrary, the court order is only the first step in the process. Though the non-custodial parent is ultimately responsible for making these payments, many circumstances come into play. Should the obligated parent be lose his or her job, the court order may be temporarily delayed. The same holds true of incarceration.

Also contrasting widespread expectations, bench warrants for delinquent child support payments are not infallible. Regardless of how dire the need is for support or the amount in arrears, a warrant does not necessarily guarantee payment. Warrants are only effective in the state in which they are issued. If the obligated parent lives across state lines, or moves to another state after the court order is issued, he or she can not be followed by a warrant.

Regarding the statistics, Bachman noted many of the families currently receiving child support are entitled to more than they collect. In some cases, they are owed for past delinquent payments while others are awaiting back payment from before the order took effect. Filing errors also account for a portion of those falling into this category. Those filing for child support are met with a complex series of considerations, which are outlined on the firm's website, www.goldsteinbachman.com/choose-a-knowledgeable-child-custody-and-support-lawyer-in-middlesex-county. Overlooked details may have a negative impact on the amount awarded. The 67 percent with no order in effect have, for myriad reasons, not filed a request for relief.

Bachman concluded, "Children who aren't receiving child support, or who aren't receiving enough, often lack medical care, and some are deprived of even the most basic of necessities because the custodial parent's income simply isn't enough to cover these needs. This leads to a higher risk of health problems and increases the chances they will develop depression or behavioral problems. We can guide parents through the process of determining appropriate child support amounts. For those who are facing problems with collecting what they are owed, we can advise them on measures to reverse the situation."
