Bethlehem Rottweiler Attack Victim Files Suit

Perkasie, PA -- (SBWIRE) -- 08/29/2019 -- On August 28, 2019, Lehigh Valley dog attack lawyer, Thomas J. Newell, filed a dog bite lawsuit in the Northampton County Court of Common Pleas versus the owners of an adult Rottweiler. In Svanda v. Soto, C-48-CV-2019-7945, Attorney Newell pled a 7 Count, 24 page Complaint which averred a long history of violation by the Defendants of both the PA Dog Law and The Rabies Prevention and Control in Domestic Animals and Wildlife Act.

September 7, 2017 Rottweiler Attack
The legal pleading alleges that a Bethlehem, PA woman was walking her tiny Shih Tzu mix on a leash at the intersection of 11th Street and Turner Street when the Defendants' large adult Rottweiler ran off of its property without a leash, muzzle or any human supervision. The Rottweiler launched an unprovoked attack causing numerous injuries to both the woman and her family pet. She was bitten on both hands resulting in permanent scarring and disfigurement. She also sustained injuries to her neck and back. Her mental health specialist diagnosed the woman as suffering from Post Traumatic Stress Disorder.

Prior Violations of the PA Dog Law
The Bethlehem dog bite attorney detailed numerous allegations of prior acts of aggressive behavior/vicious propensities by this Rottweiler. In the spring of 2017, the Rottweiler got loose and ran off of its property without a leash, muzzle or human control. It pursued a young woman and her dog on Turner Street in Bethlehem. The attack was only stopped when Minor-Defendant, Xavier Soto, retrieved the Rottweiler. An identical situation took place in March of 2017 when the Rottweiler left the Sotos' home and pursued an individual standing on a neighbor's driveway at 2012 11th Street in Bethlehem.

Criminal Convictions
Defendant Carlos Soto was charged by the Commonwealth of Pennsylvania with multiple violations of the PA Dog Law:
* Section 305 - Failure to Confine
* Section 502-A - Harboring a Dangerous Dog
* Section 502(d) - Failing to Muzzle a Dangerous Dog
He was also cited for violating The Rabies Prevention and Control in Domestic Animals and Wildlife Act by failing to have the Rottweiler current with its rabies vaccination.

On October 17, 2017, Defendant Carlos Soto was found guilty by Magisterial District Justice Patricia Broscius of all charges. He appealed the conviction to the Northampton County Court of Common Pleas. On February 12, 2018, a trial de novo was held and the Defendant was again convicted on all counts.

PA Dog Bite Attorney Finalizes $201,000 Berks County Settlement

Perkasie, PA -- (SBWIRE) -- 11/11/2015 -- On November 5, 2015, PA dog bite lawyer, Thomas J. Newell, filed a Verification of Annuity Funding with the Berks County Orphans' Court in Reading, PA. This document concluded the legal proceedings for Berks County Court of Common Pleas Case #84401 and finalized the $201,000.00 PA dog bite settlement.

The Pennsylvania dog attack lawyer had filed a nine-page Petition for Minor's Compromise with the Berks County Orphans' Court. This legal document outlined the facts of a May 21, 2013, dog attack in Fleetwood, PA. The defendants owned a pit bull/boxer mix that attacked an 11-year-old Oley, PA resident. The Petition described how the Berks County, PA dog bite victim was rushed to St. Joseph's Hospital in Reading.

Doctors performed surgery to close a 6-centimeter laceration to the young girl's nose. The lawyer for dog bites in PA attached to his Petition copies of a surgeon's operative report, as well as a follow-up visit to a plastic surgeon 1½ years after the Berks County dog attack.

Attorney Newell commented: "I am happy to have obtained this settlement without having to file a PA dog bite lawsuit. This eliminated the possibility of the young girl being deposed or explaining the details of the dog attack in open court at trial in Reading. The structured settlement annuity approved by Judge Schmehl will substantially help with her future college expenses."

PA Dog Attack Lawyer Garners Legal Precedent

Perkasie, PA -- (SBWIRE) -- 08/01/2014 -- A 6 page judicial decision in favor of a dog bite victim's rights was filed on case #2013-CV-11100 in the Dauphin County Court of Common Pleas. Pennsylvania dog attack lawyer, Thomas J. Newell, had successfully argued that the PA Dog Law permitted strict liability claims for all PA dog bite victims seeking to be reimbursed for their medical expenses.

DOG ATTACK FACTS

In his Complaint filed on December 19, 2013, Attorney Newell alleged that his client had been attacked by 3 boxers on 11/21/12. She was delivering a Federal Express package when the pack of dogs surrounded her and bit her several times on her lower torso.

LEGAL PROCEEDING

The defense attorney filed Preliminary Objections on 1/13/14 and Oral Argument took place on May 16, 2014 in front of Judge William T. Tully. Attorney Newell successfully argued that Section 459-502(b)(1) of the PA Dog Law imposed strict liability on the part of dog owners whose pets attacked humans.

LEGAL PRECEDENT

To the best of Attorney Newell's knowledge, this is the first decision in Pennsylvania that mandates strict liability on a dog owner in a civil case for personal injuries.

PA Dog Bite Attorney Obtains Groundbreaking Court Decision

Perkasie, PA -- (SBWIRE) -- 07/10/2014 -- In July of 2014, PA dog bite attorney, Thomas J. Newell obtained a legal decision that has opened up new avenues of recovery for Pennsylvania dog bite victims. On 12/19/13, Attorney Newell filed a 27 page Complaint in the Dauphin County Court of Common Pleas indexed to #2013-CV-11100.

LEGAL BACKGROUND

This legal document identified an attack by three unleashed boxers on a York County resident in Millersburg, PA. Attorney Newell's Complaint requested damages based upon eight separate legal theories. On 1/13/14, defense counsel filed Preliminary Objections averring that 5 of the 8 legal claims should be dismissed by the court. Oral Argument was held before Judge William T. Tully on 5/16/14.

COURT DECISION

On July 1, 2014, Judge Tully's six-page Memorandum Opinion and Order was filed of record in Harrisburg, PA. The judge denied and dismissed four of the defendant's five objections. The Pennsylvania dog attack lawyer may now present to a Dauphin County jury seven legal theories of recovery for the injured Federal Express delivery person.

LEGAL PRECEDENT - PUNITIVE DAMAGES

This dog bite Complaint avers that the boxers had previously pursued another FedEx delivery person. Judge Tully agreed with Attorney Newell that a punitive damage claim existed for his client based upon "prior vicious propensities." It is noteworthy that there were no actual prior physical attacks/specific injuries before this attack.

A second punitive damage claim was also analyzed as legally valid based upon the fact that the dog owner was convicted by a District Justice of failing to confine his boxers. As noted in the Complaint, he was warned by the District Justice to restrain his dogs, even when they are on his driveway. Despite the District Justice's admonition, the Complaint averred that the defendant's dogs continued to be unrestrained and, in fact, later pursued another Federal Express worker.

LEGAL PRECEDENT - RECOVERY OF MEDICAL BILLS

Judge Tully agreed with the PA dog bite lawyer that his client could make a strict liability claim for recovery of her medical bills. The defense had alleged that the victim needed to prove negligence or negligence per se in order to obtain reimbursement for her medical expenses.

ATTORNEY NEWELL'S COMMENTS

"I am unaware of any prior court decisions allowing a dog bite victim to pursue punitive damages via multiple legal theories. Equally important is my belief that this is the first Pennsylvania legal opinion that allows a dog bite victim to pursue a punitive damage claim without proof of any prior or subsequent physical attack upon another person or animal."

"This legal decision, in my opinion, opens up new avenues of economic recovery for innocent dog bite victims and, places greater accountability on those dog owners who a jury would find to be reckless."

"Additionally, permitting a Pennsylvania dog bite victim to pursue a strict liability claim for the recovery of medical bill expenses may cause homeowners insurance companies to be more forthcoming in making medical bill payments prior to litigation so that the dog bite victim may obtain all necessary medical care."

As identified in Report #20140405389 from the Harrisburg Police Department, on 4/27/14 the victim requested permission from a property owner in the 1700 block of North Street to enter her home. There was a foul smell in his basement and he was searching for a potential sewer leak in the property adjacent to his.

Unfortunately, the defendant failed to safely secure her dogs and they attacked the victim, biting his right arm. The Police Report identified one dog as a 2 year-old male pit bull and the other as a 10 year-old female pit bull. The dogs were not properly licensed and the dog owner received citations.

PA Dog Bite Attorney: How Victims Representing Themselves Lessen the Value of Their Cases

Perkasie, PA -- (SBWIRE) -- 05/09/2014 -- On April 30, 2014, PA dog bite lawyer, Thomas J. Newell, spoke with a potential Pennsylvania dog bite client. Unfortunately, the victim had represented himself since the November 2012 dog attack. Because of the many mistakes the victim made, as well as the upcoming 2 year Statute of Limitations, Attorney Newell declined to accept the PA dog bite case.

Common mistakes made by victims serving as their own legal counsel:

1. They don't know what they don't know.

2. Failure to timely and completely obtain necessary evidence.

3. Failure to time and correctly photograph the scene of the attack and all phases of the injury healing process.

4. Failure to follow the legal procedures set forth in the PA Right-to-Know Act to obtain state generated documents.

5. Lack of appropriate medical care/documentation.

6. Providing the defense with a recorded interview pre-litigation.

7. Providing the defense with a signed general medical release form granting them medical record access far beyond what is permitted by PA law.

8. Failing to timely and correctly put a local or state governmental entity on notice of a personal injury claim.

Attorney Newell provides a free consultation to all PA dog bite victims. It is a wise decision to call him as soon as possible after a dog bite in order to fully understand the legal rights.
Attorney Newell had this to say about the owner: "It's disappointing that the dog owner could not control her pit bull and confine it as required by the PA Dog Law." The young victim told Attorney Newell that the owner did not help him at all during the attack and that he had to eventually regain control of the pit bull for her.
