      <title>New California Rules Set for Determining Employee Versus Contractor</title>

      <description><![CDATA[<div class="newsleft"><div class="newsbody"><p class="subheadline">A recent decision has changed California ruling for employers regarding whether a worker is a contractor or an employee.</p><p>Palm Springs, CA -- (<a rel="nofollow" href="http://www.sbwire.com/">SBWIRE</a>) -- 05/17/2018 --  In a decision likely to make it much harder for businesses to classify workers as contractors, the California Supreme Court has set aside a multi-factor standard, which California courts used for 30 years to determine whether a worker was an independent contractor or an employee under the state&apos;s various Wage Orders.<br />
<br />
From now on businesses must use a three-factor, or ABC, test when making that determination, based on the Court&apos;s ruling on April 30 in Dynamex Operations West v. Superior Court of Los Angeles County.<br />

How the New California Ruling Works<br />
<br />
The test presumes the worker is an employee and not an independent contractor unless each of three conditions is satisfied:<br />
<br />
(1) The worker is free from direction and control in the performance of the service, both under the contract of hire and in fact; and<br />
<br />
(2) The worker&apos;s services must be performed either (i) outside the usual course of the employer&apos;s business or (ii) outside all the employer&apos;s places of business; and<br />
<br />
(3) The worker must be customarily engaged in an independently established trade, occupation, profession, or business of the same nature as the service being provided.<br />

Previous Ruling<br />
<br />
Until this decision, California courts relied on a 1989 case, S. G. Borello &amp; Sons, Inc. v. Department of Industrial Relations, citing factors such as the potential contractor&apos;s investment in tools, the method of payment, the degree of permanence of the relationship, and the intention regarding the relationship when assessing whether a contractor or employment relationship existed.<br />
<br />
California joins a handful of other states in having these so-called "worker friendly" ABC tests in their wage and hour laws, including New Mexico, Connecticut, Illinois, New Jersey and Massachusetts.<br />

At issue in the case was whether "BuzzBox" was confusingly similar to "BuzzBallz" in the ready-to-drink cocktail market. In the verdict, the jury answered no. It found that "BuzzBox" was not confusingly similar and that there was no trademark infringement in the use of the term "BuzzBox." The jury found that BuzzBox&apos;s graphic image was likely to cause confusion with BuzzBallz&apos; logo, but awarded zero dollars because there was no evidence of damages. The jury returned a defense verdict for Bendistillery on all claims.<br />

As a result, BuzzBox may continue to use its trademark in connection with its ready-to-drink cocktail products. Rod Vandenbos, BuzzBox&apos;s president and founder, was thrilled with the verdict. According to court documents, the Defendant, N.F., is an anesthesiologist who met and started dating the Plaintiff in early 2012. The Plaintiff alleged that she asked N.F. if he was infected with any sexually-transmitted infections and he specifically denied any infections. Shortly after engaging in sexual intercourse, the Plaintiff experienced an initial outbreak of genital herpes. The Defendant continued to deny any knowledge that he was infected. Since her initial outbreak, the Plaintiff has continued to experience recurrent, chronic outbreaks of genital herpes and has been diagnosed with post-herpetic neuralgia; a painful nerve condition resulting from damage caused by the herpes virus. At trial, the evidence showed that Defendant knew he had been infected for over 30 years but he claimed to have told the Plaintiff that he was infected before they engaged in sexual intercourse.<br />
<br />
After only three hours of deliberations, the jury found the Defendant liable for: assault, fraudulent concealment, and fraudulent misrepresentation. The jury awarded $665,022 in compensatory damages and $1,000,000 in punitive damages. "We are, of course, extremely pleased with the jury&apos;s verdict," said Mr. Murphy. Adding, "As a doctor, he had a greater responsibility to protect others and take precautions not to transmit an infection he had been aware of for more than 30 years." Mr. Murphy also explained that, "the jury did not believe him when he said he disclosed to her before they engaged in sexual intercourse that he was infected. His story was simply not believable." <br />
<br />
The verdict in the Texas case represents the largest verdict in that state for the transmission of an STD. Mr. Murphy is the leading trial attorney in this personal injury field. He has obtained the largest jury verdicts for transmission of genital herpes in California and now in Texas, and this is the third verdict in excess of a million dollars he has obtained in the last six years.
