The Fit for Work service is being rolled out through 2015 to accompany existing occupational health support for employers and employees throughout the UK. For periods of extended sickness, employers or GPs can now refer employees for a Fit for Work assessment if they have been absent for four weeks or longer. <br />
<br />
The key aim of the service is to provide qualified advice and recommendations to employers, employees and GPs. Barriers to an employee&apos;s return to work would be assessed and a Return to Work Plan tailored specifically for the employee by an occupational health professional. This must be accepted by employers in the same way as a fit note, removing the need for repeat GP visits. The service is free and composed of a health and work advice service, accessible online and via telephone. Also there is an occupational health assessment service which includes the Return to Work Plan for employees who are likely to be off work sick for four weeks or more. <br />
<br />
SMEs may have limited in-house occupational health expertise and should find the service particularly beneficial. In addition, larger business may use the service to complement existing provision to minimise the impact of long-term sickness absence in the workplace. <br />
<br />
The need for the service was identified when David Frost CBE and Dame Carol Black carried out a review and published their findings in &apos;Health at Work – an independent review of sickness absence&apos;. It was highlighted that lack of access to occupational health services was one of the largest barriers for employees to return to work. <br />

Barry Beavis was fined £85 for over-staying 56 minutes on a two hour free stay car park. Mr Beavis challenged ParkingEye, claiming that the charge was excessive and disproportionate.<br />

The car park in question was at a Chelmsford retail park which is in the middle of a busy city centre. Mr Beavis&apos; solicitor argued that car parking fines should be set at levels so as to not make huge profits but to deter over stayers. <br />
<br />
Seven Supreme Court justices considered the case and concluded the charge did not breach the &apos;Unfair Terms in Consumer Contracts Regulations&apos; and was entirely lawful. According to the Court of Appeal, Mr Beavis had &apos;entered into a contract&apos; with the London-based parking firm when he drove into the car park. <br />

Mr Beavis argued he was pursuing the case for millions of other motorists who are regularly stung by parking tickets from private firms. The case has revealed that there are no boundaries when it comes to parking fine charges and that "Such is the nature of an unregulated industry scrambling to get as much money as it can from drivers," according to AA president Edmund King when talking to thisismoney.co.uk. <br />

The ruling comes after two women, Alison Sharland, 48 and Varsha Gohil, 50, argued that their husbands, who are millionaires, misled the family courts about how much they were worth. Sharland&apos;s case had come under criticism as she had originally accepted £10.35m 3 years ago. Talking to The Guardian, Sharland said she had pursued her case so that other women and partners were "not faced with a situation where their spouse tells lies, which potentially affects the outcome and interferes with achieving a just and fair settlement."<br />

The ruling gives more leeway for wives to appeal against the agreements made during the divorce if they have reason to believe their ex-partners have lied about their assets and how much they&apos;re worth. It has been stressed the case was pursued because of this reason and not for monetary gain. <br />

Speaking to the Guardian, Gohil said: "There are absolutely no winners in divorce and more than a thought has to be given to the children of families locked in this type of litigation. The price they pay is a very heavy one. The emotional strain of it is huge on everyone, the drain in financial resources is enormous and none of it serves the family."<br />

The Act amended areas such as Tenancy Deposit Protection requirements and the Section 21Notice – the property owner&apos;s right to evict tenants at the end of their Assured Shorthold Tenancy (AST). <br />

The Deregulation Act 2015 now involves additional requirements of compliance which people need to be aware of. This applies especially to landlords who will be required to comply with other legislation before a valid section 21 Notice is served. <br />

This other legislation crucially involves two areas – the condition of the property and whether an Energy Performance Certificate (EPC) has been provided.  These now can be influencing factors regarding a decision. Firstly, legislation involving he properties condition is in place to help to prevent against &apos;retaliatory evictions&apos; whilst having an EPC Certificate in place requires the energy efficiency of the property to be considered. <br />

Ultimately, these added clauses to Section 21 are stricter regulations for the condition of the property before being able to invoke a Section 21 notice; for example, if a tenant has delivered a written complaints about the property that have been ignored or inadequately dealt with by the proprietor.The proprietor must also have provided an Energy Performance Certificate (EPC) prior to the tenants signing an agreement - the potential tenants should be aware of the energy efficiency of the property as part of the decision process, not once they are already settled.<br />

A recent unfair dismissal claim is to be brought back in front of a tribunal as the EATshow concern at the potential for hidden age-discrimination redundancies which would allow  companies to avoid large pension costs.<br />
<br />
The case in question, Sturmey v Weymouth and Portland Borough Council saw Mrs. Sturmey – who worked for Portland Borough Council – dismissed a few days before her 55th birthday. The reason she was given for being made redundant was a &apos;restructure&apos; in the team; however the EAT has sent the case back for a re-hearing after believing Mrs. Sturmey&apos;s dismissal was age-discriminatory, designed to save the council a significant expenditure as she would have been entitled to an immediate pension at the age of 55. <br />
<br />
The Tribunal at first instance concluded that anyone in Sturmey&apos;s position would likely face dismissal too, regardless of age. They had also commented that saving council and taxpayers&apos; money was reason enough for the redundancy in any event. <br />
<br />
The EAT disagreed and sent the claim for re-hearing on the grounds that the Tribunal had not considered evidence regarding the timing of the dismissal, which did tend to support the age discrimination claim. In addition, the Tribunal had relied on case law rather than draw its own conclusions based on the evidence presented. <br />
<br />

      <title>Unfair Dismissal Claims: The Legal Team Comments</title>

      <description><![CDATA[<div class="newsleft"><div class="newsbody"><p>Doncaster, England -- (<a rel="nofollow" href="http://www.sbwire.com/">SBWIRE</a>) -- 05/27/2015 --  The Employment Appeals Tribunal (EAT) is keeping a watchful eye on potential unfair dismissal cases where  people are close to retirement – thus pension-entitlement age. <br />

A recent unfair dismissal claim is to be brought back in front of a tribunal as the EAT show concern at the potential for hidden age-discrimination redundancies which would allow  companies to avoid large pension costs. <br />
<br />
The case in question, Sturmey v Weymouth and Portland Borough Council saw Mrs. Sturmey – who worked for Portland Borough Council – dismissed a few days before her 55th birthday. The reason she was given for being made redundant was a "restructure" in the team; however the EAT has sent the case back for a re-hearing after believing Mrs. Sturmey&apos;s dismissal was age-discriminatory, designed to save the council a significant expenditure as she would have been entitled to an immediate pension at the age of 55 .  <br />

The Tribunal at first instance concluded that anyone in Sturmey&apos;s position would likely face dismissal too, regardless of age. They had also commented that saving council and taxpayers&apos; money was reason enough for the redundancy in any event. <br />
<br />
The EAT disagreed and sent the claim for re-hearing on the grounds that the Tribunal had not considered evidence regarding the timing of the dismissal, which did tend to support the age discrimination claim. In addition, the Tribunal had relied on case law rather than draw its own conclusions based on the evidence presented.   <br />

The Legal Team, which  specialise in Employment Law, has reflected on the EAT&apos;s decision: "Dismissals and redundancies are always going to be a point of contention with employees; but in cases where a person feels discrimination has cost them their job, they should have the right to contest the case. <br />

"Whether in this example Mrs. Sturmey really was a victim of age discrimination or the timing of the dismissal was mere coincidence is for a new Tribunal to decide. However, cases of unlawful redundancy do occur, and in a situation where you have been loyal to a company for many years to be deprived of your pension entitlement is very unfair."  <br />

      <title>The Deregulation Act Enforces Changes That Will Affect Letting Laws Country-Wide</title>

      <description><![CDATA[<div class="newsleft"><div class="newsbody"><p>Doncaster, England -- (<a rel="nofollow" href="http://www.sbwire.com/">SBWIRE</a>) -- 05/18/2015 --  The Deregulation Act 2015 received Royal Assent on 26th March 2015 and will change various aspects of renting for Landlords and Letting Agents alike.<br />

The Act has amended areas such as Tenancy Deposit Protection requirements and the Section 21Notice – the property owner&apos;s right to evict tenants at the end of their Assured Shorthold Tenancy (AST). <br />
<br />
If a deposit laid for an AST before 6th April 2007 is still in holding as part of a statutory periodic tenancy – which again started before 6th April 2007 – the proprietor does not have to comply with the Tenancy Deposit Scheme. The deposit does have to have TDS protection in this situation if the proprietor wants to issue a Section 21 Notice. The deposit must also have protection if originally laid down before 6th April 2007 but the statutory periodic tenancy commenced after this date. <br />
<br />
The added clauses to Section 21 include stricter regulations for the condition of the property before being able to invoke a Section 21 notice; for example, if a tenant has delivered a written complaints about the property that have been ignored or inadequately dealt with by the proprietor, it protects the tenants against &apos;retaliatory evictions&apos;. The proprietor must also have provided an Energy Performance Certificate (EPC) prior to the tenants signing an agreement - the potential tenants should be aware of the energy efficiency of the property as part of the decision process, not once they are already settled.<br />

The Legal Team has commented on these changes "It is equally important for both landlords and tenants to be aware of the laws and rights surrounding letting agreements before entering into a contract. Whilst the changes have provided an amount of protection for tenants against non-compliant landlords, it can also catch accommodating landlords out on formalities if they have housed the same tenants for a long period of time. <br />

"The changes can trip up proprietors and cause problems with closing contracts and deposit returns amongst other things; this can be avoided with awareness of the correct laws and formalities. The idea behind the change is to speed up the divorce process and increase efficiency.Designated specialists at the centres will be dealing solely with routine divorce applications;this willin turn free up time in the courts for other cases to be given more time and attention.<br />

The centres will be located across England: Durham, Doncaster, Harrogate, Bradford, Liverpool, Nottingham, Stoke, Southampton and Bury St. Edmunds, and in Wales at Neath, Newport and Wrexham. Divorce work will be transferred to the centres in a phased approach, to be completed by October 2015.<br />

In order to ensure procedures are dealt with correctly, district judges will oversee work at the centres and handle any disputed divorces, annulments and legal separation applications; legal advisors can not make decisions about financial remedy cases, again district judges will handle this work.<br />

Whilst the first two weeks of leave after the birth must continue to be taken by the mother, the rest of the leave can be shared between the mother and father. This means that up to 50 weeks of leave, with 37 of these weeks being paid, can now be interchanged between both parents.<br />
<br />
Previously, the father would have only been allowed two weeks of paid paternity leave after the child was born. However, the changes allow both the responsibility and the bonding process to be shared, rather than being heavily weighted towards the mother. The change also sees the discontinuation of Additional Paternity Pay and Leave, which allowed the father to take paid leave from work if the mother returned to work before the end of her maternity leave. <br />
<br />
Changes have also been made to adoption leave, which sees adoptive parents eligible for the equivalent of maternity pay, the right to share parental leave and up to five paid appointments with adoption agencies. <br />
<br />
Similarly, surrogate parents – who were previously entitled to no statutory pay or leave – have now been granted the same privileges as those who have had children naturally or through adoption; this means the main named guardian is allowed standard statutory leave and pay, and  bothparents are again able to share the leave between them.<br />
<br />

Parents who adopt or use a surrogate birthing mother in order to have a child should receive the same rights as people who have been able to have children naturally; these people are obviously desperate to be parents, and should not be penalised because they cannot do so naturally.<br />
