The U.S. Department of Labor's (DOL's) Occupational Safety and Health Administration's (OSHA's) Wichita Area Office announced that it has cited the food processing facility of Reser's Fine Foods, Topeka, Kansas, for 13 serious safety and health violations. OSHA opened an investigation at the company after receiving a complaint about an ammonia refrigerant leak.

Ammonia is typically used in the refrigeration process in food production facilities. Inspectors found that about eight pounds of ammonia were released March 3, 2015, from a compressor seal leak at the facility. Emergency evacuation procedures were initiated. One employee was taken to a local medical facility for observation but was able to return to work later that day.
Examples include: Sterling Seating's in Northern New Jersey was fined $196K for failure to provide a safe work environment for their employees. On Target Staffing LLC, a staffing company that provided laborers for Sterling was also cited by OSHA for failure to properly train employees and identify hazards. Plant workers were repeatedly exposed to safety and health hazards led OSHA to conduct a full investigation into the alleged hazards.

OSHA issued 25 repeat, 15 serious and two other-than-serious safety and health citations to Sterling Seating. On Target Staffing received one repeat and two serious health citations. OSHA initiated an inspection after receiving a complaint alleging unsafe working conditions at Sterling's plant. Inspectors observed hazards to temporary workers, resulting in a separate inspection of the staffing company.

US Compliance Corp Reports How to Avoid Environmental Liability

Excelsior, MN -- (SBWIRE) -- 09/03/2015 -- Environmental Health Safety Compliance News, sponsored by U.S. Compliance Corp, reported that Charles Driggars authored a feature article in Alabama.com regarding Avoiding Environmental Liability. Driggers noted there is virtually no business today that does not, to some degree, have the potential for liability under the myriad environmental laws; for many businesses, this potential is a daily concern. News stories concerning the indictments for environmental violations of individuals long known as respected members of the community are not uncommon and are a stark reminder of the serious, even potentially criminal, consequences that can arise from alleged noncompliance with environmental regulations. Frighteningly enough, this risk applies to responsible individuals who do their best to do their jobs; the complexity of environmental laws and the difficulty of their applicability in the "real world" make even the best-intentioned employer or employee at risk for such actions.

The engine that fuels this country's economic power (and standard of living) consists in large part of chemical plants, manufacturing operations, and agricultural businesses to whom laws protecting the environment are not an abstract "good" but are instead a regulatory minefield in which noncompliance can mean, at a minimum, lost time and money in dealing with regulatory enforcement actions.

Alfa Laval Faces 500,000 Dollars in OSHA Fines for Oklahoma Safety Violations

Excelsior, MN -- (SBWIRE) -- 08/20/2015 -- Alfa Laval, Inc. faces $477,900 in penalties after OSHA inspections discovered dozens of serious workplace safety violations, five of which were identified in previous inspections. Federal investigators found five repeated and 45 serious violations on a range of health and safety issues at the company's Broken Arrow, OK facility, including inadequate protection of workers from machinery, a lack of respiratory equipment and training for hazardous chemicals. Alfa Laval employs about 220 people.

Alfa Laval also had no procedure to prevent machines from starting during maintenance or service, and failed to maintain written fire protection and emergency management plans. OSHA levied a $218,500 penalty for the repeated violations that it cited the employer in 2010 and 2011, and an additional $259,400 for serious violations. OSHA has placed the company in its Severe Violator Enforcement Program.

"Alfa Laval has no excuse for repeatedly exposing workers to dangerous conditions," said David Bates, OSHA's area director in Oklahoma City. "A continued failure by the company to make needed changes to its safety program may well result in severe injuries or worse."

A global provider of heat transfer, centrifugal separation and fluid handling products, Alfa Laval employs about 18,000 employees at locations in Sweden, Denmark, India, China, the U.S., and France. The company serves industries that produce food and beverages, chemicals and petrochemicals, pharmaceuticals, starch, sugar, and ethanol. Alfa Laval's products are also used in power plants, aboard ships, oil and gas exploration, in the mechanical engineering industry, in the mining industry and for wastewater treatment, as well as for comfort climate and refrigeration applications. It reported annual sales of $4.2 billion in 2014.

Lack of Foot Protection Carries a 308,435 Dollar Fine for NJ Logistics Firm

Excelsior, MN -- (SBWIRE) -- 08/17/2015 -- Josh Cable, staff writer for EHS Today reported Cal/OSHA issued $308,435 in penalties to National Distribution Center LP (doing business as NFI) for failing to provide employees with foot protection at its Mira Loma, CA facility.

The agency cited the Cherry Hill, NJ-based logistics, warehousing and distribution firm for the same violation in 2012, and alleges that NFI failed to address the situation. "Prevention is vital to limiting accidents in warehouses where hazards are magnified by the size of the facility and number of employees," said Christine Baker, director of the California Department of Industrial Relations. "Unfortunately, the employer in this case did not follow through on an agreement to provide protection."

The Mira Loma facility is a cross-docking operation - a logistics procedure in which goods are unloaded quickly from inbound transportation docks and moved to outbound docks without storing them. At 599,340 square feet, the Mira Loma cross dock is one of the largest in the country, with 450 employees on-site. One serious citation alleges that NFI employees were exposed to foot injuries because they did not have appropriate protection when working near the facility's dozens of forklifts. Cal/OSHA also cited NFI to replace worn and faded painted stripes that delineate pedestrian aisles and forklift aisles, because the forklifts were observed driving through the pedestrian aisles to reach the dock doors.

Privately held manufacturing firms must attain and sustain environmental, health, and safety compliance. Manufacturers rely heavily on employees to make the business productive and profitable. Lost workdays due to sickness or injury quickly diminish profits; employees want to know manufacturers care about their health and safety. U.S. Compliance Corp helps manufacturers avoid non-compliance lawsuits and fines by partnering and creating a customized program, practical to implement, easy to follow, and preventing workers' comp claims or costly citations.

Manufacturers with $25M-$250M in annual revenue have the same requirements to keep up with the latest government regulations. U.S. Compliance Corp has over 25 years of experience keeping more than 1,000 customers across the U.S. and Canada compliant with OSHA and environmental laws. Manufacturers must keep innovating, making better and dynamic products, while U.S. Compliance Corp keeps track of the changing regulations. Outsourcing this vital function to experts ensures manufacturers stay on top of the requirements and provide implementation and documentation of safety and compliance programs.

According to US Compliance Corp OSHA Fines Sawmill $56,000 Due to Avoidable Amputation

Excelsior, MN -- (SBWIRE) -- 08/13/2015 -- According to U.S. Compliance Corp's newsletter, machine guards may have prevented arm amputation suffered by worker at Cordele, GA, sawmill Griffin Lumber & Hardware. The company ignored hazards and received a willful violation. According to OSHA, a job should be a source of personal accomplishment and pride, not the cause of disability and unemployment.

A 29-year-old temporary worker suffered at a local sawmill operated by Griffin Lumber & Hardware. The man's left arm was amputated when his jacket was caught in the drive shaft of a conveyor belt early in 2015. OSHA's inspectors found that workers at the Cordele-based business risked amputations and the dangers associated with unguarded sprocket wheels and chains on a conveyor belt.

The severely injured worker was employed by Labor Finders, a staffing agency that provides Griffin Lumber with temporary workers. Griffin Lumber was responsible for daily supervision, training, and direction of the temporary workers. OSHA concluded an inspection with Labor Finders and issued no citations to the staffing agency. "Griffin management admitted to inspectors that the unguarded parts had been that way for a long time," said Robert Vazzi, OSHA's area director in Savannah, GA. "This terrible incident proves the company can no longer ignore worker safety and must address all safety hazards immediately."

OSHA announced an initiative to improve workplace safety and health for temporary workers, who are at increased risk of work-related injury and illness. The initiative includes outreach, training, and enforcement to ensure that temporary workers are protected on-the-job. OSHA and the National Institute for Occupational Safety and Health (NIOSH) have also issued a "Recommended Practices" publication that focuses on ensuring temporary workers receive the same training and protection as permanent employees. OSHA has also created a National Emphasis Program on Amputations.

US Compliance Corp Reports OSHA Proposes $126K in Fines for Case Farms Chicken Processing

Excelsior, MN -- (SBWIRE) -- 08/11/2015 -- According to a recent US Compliance Corp newsletter, less than two years after agreeing to address safety violations in a settlement agreement with OSHA, Case Farms Processing Inc. exposed workers to the same dangerous machinery hazards at its Winesburg, OH, facility. OSHA found one willful, four repeated, one serious and one other-than-serious violation at the facility during two follow-up inspections, which cited the company for 23 safety violations in 2011. OSHA initiated the follow-up inspections to verify that previously cited hazards had been corrected at the facility. The chicken producing and processing company faces penalties of $126,500.

"Case Farms Processing continues to demonstrate that the safety and health of its workers is not a corporate priority," said Deborah Zubaty, area director of OSHA's Columbus, OH office. "This inspection demonstrates that the company has failed to meet the goals outlined in the 2013 agreement. This is a disheartening setback for worker safety at this company."

OSHA's inspection found that machinery lacked proper safety mechanisms and workers faced amputation hazards while operating saws and grinders. Additionally, sanitation workers were not included in company audits concerning machines starting up during service and maintenance. The company also failed to maintain an accurate log of worker injuries and illnesses. Machine hazards are one of the most frequently cited OSHA standards.

US Compliance Corp EHS Expertise and Diversity Makes the Difference for Small Manufacturing Firms

Excelsior, MN -- (SBWIRE) -- 08/06/2015 -- U.S. Compliance Corp advisors have such diverse backgrounds and bring different perspectives to handling issues. Some advisors learned safety and health in the classroom and others learned it out in the field at previous jobs. Part of our job is to visit a variety of industries, so we get extensive exposure on the job as well. During monthly staff meetings, we talk about current events and upcoming deadlines. We are also provided with resources or training materials on communicating those changes to our clients.

Ellen Nesbitt, M.S. is the Environmental, Health, & Safety Advisor for U.S. Compliance Corp, based in the Illinois office. Nesbitt provides quality EHS services at various customers in Nevada, Kentucky, Indiana, Missouri, and locally in Chicago. Nesbitt is responsible for developing site-specific training within various industrial settings and has been instrumental in developing environmental, health, and safety programs for numerous manufacturing firms.

Nesbitt recently shared that one of the top compliance challenges is getting everyone's buy-in to safety. Employees that have worked at the same job for several years may not be open to change or do not want to see the hazards that exist in the workplace. Several "mom and pop" business owners are not interested safety because they think it slows down productivity.

Smaller firms are challenged by learning how to use new technologies. There are new apps and devices coming out (such as headphones that claim to offer the same protection as ear plugs, using an iPhone app to measure sound levels); this may or may not be conductive to compliance.

A third-challenge, noted Nesbitt, is staying on top of changing regulations, such as the recent changes to the Hazard Communication standard and NFPA 70E.
