Siemens Transforms How Hand Injuries at Work Are Addressed: The Accident Team Comments

Doncaster, England -- (SBWIRE) -- 01/08/2016 -- Recent news has drawn attention to the importance of addressing hand injuries in the workplace more effectively; with Siemens factories bringing in a 'Zero Harm' policy. In many areas of employment, the hands are used intensively - especially in manufacturing industries – and this can result in injury, especially due to stress and strain. The involvement of big businesses in aiming to reduce workplace injuries, with a particular focus on hands, is growing. This emphasizes the importance of safety being upheld as well as those affected by inconsistent standards coming forward, as suggested by personal injury experts such as The Accident Team. Addressing hand injuries through legal support as well as prevention is set to be a significant focus over the coming months.

Whatever the mode of work, employers have a responsibility to minimise risk of injury. A successful example, addressing hand injury directly, is an initiative in Siemens factories. Siemens is a recognised technology manufacturer, and has recently added to the benefits of its 'Zero Harm' working policy through providing improved equipment to protect the hands of employees.

The Zero Harm approach from Siemens is considered an inspiration to other workplaces. It aims for zero harm to employees, customers and the environment; upholding ethical practices and regularly reviewing its conduct. Recently focusing on hands – as manufacturing work is particularly 'hands-on' – the company took steps to improve the safety gloves given to staff. Providing appropriate safety equipment for employees is a legal right and Siemens give a key example of a business fulfilling this to the best extent; opting for a more durable, flexible glove. The results have been profound, with the business reporting a reduction of hand injuries since 2014 by 47%.

Other measures taken by Siemens include the encouragement of a workplace culture where every employee has the opportunity to speak out on issues of safety and challenge any risky behaviour. This involvement of employees actively within health and safety processes could be seen as an important progressive attitude. Keen to comment on the news was The Accident Team, experts in personal injury law. A spokesperson had this to say:

"Hand injuries can be common in the workplace and therefore to see businesses taking active steps to minimise this, along with the promotion of an engaging health and safety culture in the workplace, is highly positive. This certainly should be an aspiration for workplaces going forward into 2016."

Kirkby Sonae Factory Fined £220,000 for Accidental Deaths

Doncaster, England -- (SBWIRE) -- 12/24/2015 -- Sonae Industria (UK) and Valmet Ltd (formerly Metso Ltd) have been brought to justice following the accidental deaths of two employees at the factory in Kirkby, Merseyside. Liverpool Crown Court heard that Mr Elmer, 27 and Mr Bibby, 25 were carrying out maintenance on plant machinery on 7th December 2010, when the conveyor belt unexpectedly began to operate, pulling the men in. The untimely deaths could have been avoided had there been adequate procedures in place to ensure the safety of the employees and contractors on the site.

The Health and Safety Executive (HSE) carried out an investigation and found numerous failings at the factory, including a lack of training on how to isolate the power supply of dangerous machinery and failing to train and check the compliance of risk assessment procedures. Red flags were raised in 2013 when Valmet Ltd was prosecuted for failure to comply with Health and Safety regulations pertaining to risk assessment policy and procedure. They also failed to ensure adequate information and training for employees.

A spokesperson for the Accident Team said "This is such a tragedy and could have been avoided, had the correct risk assessments been made. The Health and Safety at Work Act has been enforced now for a number of years to ensure the safety of employees in all types of work. We hope that in light of this accident, companies will take a serious and considered approach to complying with Health & Safety procedures and strive to protect employees from potential danger."

Brake Launches Campaign for Road Safety Week

Doncaster, England -- (SBWIRE) -- 12/21/2015 -- The campaign for Road Safety Week this month has already started. Brake, a road safety charity who works with communities and organisations across the UK, strives to stop the devastating loss of lives on UK roads each day and campaigns to make roads and streets safer for motorists and pedestrians alike, particularly children.

The charity's campaign "Drive Less, Live More" encourages people to re-consider the use of their car and if it is really necessary. Driving may be convenient, but there are 5 deaths and 60 serious injuries on UK roads each day which can often be avoided. The campaign provides many statistics, which aim to make people stop and think about how and why they use their car and if they can, avoid driving.

A perhaps surprising statistic is that a fifth of cars on the road during the morning rush hour are for the school run, yet the average journey for a trip to primary school is 1.5 miles. With four in every ten car journeys shorter than 2 miles, Brake wants to encourage people to walk, cycle or take public transport during Road Safety Week, from 23rd – 29th November.

The Accident Team sees many accidents where pedestrians and drivers are seriously injured and it's often due to a drivers lack of attention or negligence. A spokesperson for the company said: "Road Safety Week is an important step in educating children and adults about the dangers of the roads, which so many people seem to be oblivious to. If more drivers and pedestrians exercised a little more care on the roads, many of the accidents could be prevented. At The Accident Team, we deal with an increasing number of road accidents and our solicitors are highly successful in recovering compensation for clients."

Man Left Blinded in One Eye After Accident at Work

Doncaster, England -- (SBWIRE) -- 11/30/2015 -- A Lancashire firm has been investigated by the Health and Safety Executive (HSE) following an incident which left an employee with serious facial injuries and blind in one eye.

The employee, Duane Scholes, was assisting the works manager and design engineer in pressure testing a hydraulic cylinder, when he was hit in the face by a pressurised hose after a connector failed.

Mr Scholes was airlifted to the Royal Preston Hospital, were he received emergency treatment. His injuries included a broken jaw and multiple facial lacerations, which were so severe that a six hour operation was needed to reconstruct the right side of his face.

The case was heard at Preston Crown Court following the incident, which happened in January 2014. The Clitheroe based company, Lodematic Components Ltd was prosecuted by the HSE after admitting a breach of Section 2(1) of the Health and Safety at Work Act 1974. They were fined £35,000 and were ordered to pay prosecution costs of £7,835.

HSE inspector Bradley Wigglesworth said the company had "…failed to assess the risks or provide a safe system of work for pressure testing hydraulic cylinders." It was found that there was no segregating or safeguarding and the test connectors which failed were not subject to maintenance or inspection. He also said "If these measures had been in place at the time of the incident, then the employee's life changing injuries could have been avoided."

About The Accident Team
The Accident Team provides specialist accident solicitors who deliver legal advice and assistance in instances like this, where people sustain injuries at work. A spokesperson for the company said: "These injuries have had a serious impact on a young mans life, and are entirely due to negligence on the part of the employer. Ignoring health and safety procedures will, no doubt, eventually lead to someone suffering an injury that could have been avoided. In such circumstances, the employee is entitled to pursue compensation for the injuries, even if they return to work for the same employer."

Baxter's Fined After Accident at Factory

Doncaster, England -- (SBWIRE) -- 10/26/2015 -- One of Britain's largest food manufacturers, Baxter's has been fined after worker Jodie Cormack was severely injured while working on a production line.

Famous for making soups, pies, condiments and sauces, the company admitted fault after an investigation by the Health and Safety Executive (HSE) found the health and safety procedures were not substantial enough in the events leading up to the incident.

Mr Cormack became trapped after he tripped and fell into an auger machine while clearing potatoes from a conveyor belt which he had climbed onto. The company was unaware that climbing on to the conveyor had become common practice and the incident brought to light Baxter's poor risk assessments at the Fochabers factory. Baxters also failed to provide adequate training, supervision, information and instruction which was imperative for the safety of workers who manned the production line.

It took more than an hour to free Mr Cormack from the machine before he could be flown to Raigmore Hospital via air ambulance where he received emergency treatment. Mr Cormack was left with a prosthetic leg after surgeons had to remove part of his right foot and amputated below the knee on his left leg.

Baxters Food Group was fined £60,000 after they admitted breaching the Health and Safety at Work Act 1974. After the hearing, speaking to the Herald Scotland, HSE inspector Penny Falconer said: "This tragic incident was entirely avoidable. Augers are known to be the cause of serious accidents when limbs are drawn in. Baxter's Food Group should have been aware of the risks involved in clearing the conveyor and the precautions that needed to be taken to prevent access to the auger."

Pothole Problems: Councils Receive Claims for Compensation

Doncaster, England -- (SBWIRE) -- 10/20/2015 -- Approaching winter the roads can quickly become dangerous for motorists and cyclists alike. Deterioration of roads across the UK account for a considerable amount of accidents on council owned land.

According to potholes.co.uk authorities currently pay out more than £30 million in compensation due to poor road conditions. In recent figures released by First4lawyers, Manchester was ranked second on a list of UK cities with the highest number of accident claims filed against local councils.

Manchester City Council received 3,524 complaints about potholes in the year 2013/14. The combined figures for Councils across the UK are astounding.

Fillthathole.co.uk is a website set up by CTC (the national cycling charity) which offers an easy way to report potholes in your local area. With communities taking action and councils being notified, the risk from potholes can be reduced. Cyclists especially are affected by potholes, and are usually the first to spot them.

Recently 48-year-old Chris Clay told the Derby Telegraph "I was cycling, then all of a sudden, I went flying." He had no idea what caused his accident but was left with pain more than just minor injuries. Like many, Clay has a financial right to seek damages as the accident wasn't his fault. However with Fillthathole.co.uk in operation all year round, it is accidents like these that can be avoided as councils are notified by the charity and are usually quick to act.

If you have ever had an accident because of the poor conditions of roads in your area, The Accident Team can offer a free consultation with a no win, no fee, no risk guarantee. Under the Highways Act 1980, it is possible to pursue a successful claim.

A spokesperson for the team said: "At this time of year more and more people do seek legal advice regarding claims for accidents resulting from potholes and general deterioration of road surfaces. Accident compensation claims caused by negligent councils are something we can help with. Local authorities have an obligation to ensure roads are maintained to a satisfactory standard; where this obligation has not been met, we can look at the options to pursue a claim."

Your Unsafe Home May Not Be Your Fault: The Accident Team Comments

Doncaster, England -- (SBWIRE) -- 09/23/2015 -- According to a survey of housing tenants by the firm AXA Business Insurance, up to 71% of landlords have not yet installed carbon monoxide detection alarms in their properties. These are potentially shocking statistics, implying that the vast majority tenants could be in a position of enhanced risk in their own homes.

A good carbon monoxide alarm is so important, as the gas is extremely difficult to detect otherwise, being colourless, odourless and tasteless. It is extremely dangerous in high concentrations, circumstances which fortunately occur rarely in UK homes. However, in the case of a faulty boiler or plumbing leak, for example, carbon monoxide can be released. When inhaled it can quickly cause drowsiness, respiratory problems and can even lead to death due to its poisonous properties. The risk is considered particularly high in homes heated by solid fuel. With a number of UK fatalities and serious injuries every year as a result of carbon monoxide, the need for homes to have the appropriate methods of prevention and detection is thus essential.

Tenants have a right to be properly protected whether from carbon monoxide or other dangers in the home. The survey of 500 tenants by AXA Business Insurance also revealed that 54% of those interviewed did not have a fire alarm installed yet in their property and 43% had not received a gas safety check though their landlord.

The Accident Team, a group of personal injury experts, was quick to comment on the issue and offer support:

"The survey highlights how common it is for tenants to have inadequate health and safety provisions. All tenants should feel safe in their home. Many have excellent relationships with their landlords. Many landlords wish to do the right thing for their tenants but may not fully aware of their responsibilities. The law provides protection for tenants which some landlords are unable or unwilling to provide. If you are in landlord managed accommodation and believe that you are in a position of risk or have been in injured in circumstances which were not your fault then you are entitled to legal support. Here at The Accident Team we offer comprehensive advice to help those affected."

Holiday Accident Numbers Hit a High: The Accident Team Comments

Doncaster, England -- (SBWIRE) -- 09/17/2015 -- According to recent research released by Post Office Travel Insurance, during this year so far 38% of travellers have suffered an injury or harm whilst on holiday. Most people would be surprised that such a significant proportion of holiday-makers are affected. Of course many of the injuries are relatively minor. The most common afflictions include insect/animal bites (25% of those affected), people suffering from food poisoning (14%) and extreme sunburn (8%), but even some of these injuries may be more serious. The absolutely essential step in all these cases of injury is to seek appropriate medical attention.

Some holiday-makers may have sustained injury as a result of sheer accident. However, some people are involved in holiday accidents which may well have been preventable. People can be injured because of the negligence of another person or organisation meant to be responsible for their safety. For example on package holidays, holidaymakers may have been given poorly-maintained accommodation or equipment which has led to them being hurt. In cases such as this, the holiday provider or tour operator could be to blame, not the individual.

When holiday accidents or injuries are not the fault of the traveller, the individuals may be able to make a claim and may require legal support. The Accident Team is a professional body of legal experts, dedicated to obtaining justice for those affected by injury, including accidents sustained whilst on holiday. A spokesperson had this to say:

"A holiday is a time when people deserve to relax, a time to which they may have been looking forward for a year or even longer. Being affected by injury when on holiday can be more upsetting and traumatic than at other times. In cases where an injury was not your fault and you wish to claim, having good legal support is essential. Holiday injury claims, especially those incurred overseas, can be complex. If you have been injured on holiday and want a quality legal service, we are committed to extending our expertise to you. We can help you achieve compensation appropriate to the trauma sustained and recover expenses such as medical costs. "

Clinical Negligence Becoming an Increasing Concern for the NHS

Doncaster, England -- (SBWIRE) -- 09/03/2015 -- A recent report by a prominent British newspaper, The Daily Telegraph, suggests that clinical negligence is becoming an increasing concern for the NHS. Whilst the financial costs are high, the human cost is even more significant for those who have found themselves the victim of negligent medical care. The report seeks to stress the importance of stringent health and safety measures in medical practice to ensure patients are protected at all times. Furthermore, it suggests that patients should be entitled to increased compensation where the damage is long-term or irreversible.

The implications of the report could be that there will be increased scrutiny of medical practices. There may also be an increased effort by lawyers to secure better rates of compensation for their clients, and more people feeling comfortable about asserting their rights in this area.

The Accident Team includes solicitors who are accredited as being leaders in the field of clinical negligence, and have extensive experience in handling complex medical negligence cases. Upon hearing the latest report, a spokesperson said: "What should be remembered here is that these cases often involve people who have suffered life changing injuries, through those responsible for their care not meeting accepted standards".

For some time now, lawyers and action groups have argued that if the NHS admitted liability at a much earlier stage, instead of dragging its feet, then the costs would be significantly lower, in both financial and emotional terms.

In these situations we would advise people to seek professional legal advice at the earliest opportunity. It is crucial that you know your rights and can obtain appropriate redress where things have gone wrong. Lawsuits following negligent medical treatment help to maintain standards and save others from suffering the same ordeal.

1 in 5 Taking Hay Fever Medication Involved in Accidents Due to Drowsiness

Doncaster, England -- (SBWIRE) -- 08/21/2015 -- A new report released by Kwik-Fit Insurance has revealed that more than one in five drivers taking hay fever medication (out of 2002 interviewed) had been involved in an accident, due to the side effects of the drug. A further 16 per cent said they had experienced side effects, but had not had an accident. Up to half of the people surveyed, said that hay fever medication made them drowsy, with some even stating that it had led to blurred vision or 'impaired thinking'.

Throughout the summer, hay fever and allergies become difficult for many members of the public, and this news will come as a shock and a warning to many. The implications could be huge, as roads and motorways are also filled at this time of year with people going on excursions with their family or friends. The survey concluded by suggesting that drivers should take note of high pollen counts as much as they would of wet roads or high winds.

About The Accident Team
The Accident Team are legal experts in the field of accidents and injuries. They are also regular observers and commentators on industry news and were eager to comment on the latest survey results. A spokesperson said, "It is certainly worrying that such a high proportion of people have been involved in car accidents due to the effects of medication, which drivers are often taking as routine, when it comes to their allergies. We support the advice of the survey and suggest that drivers take note of high pollen counts and prepare accordingly if they feel that the side effects of their medication could mean they would not be fit to drive. Drivers likely to be affected by the medication should not put themselves at risk, as they inevitably put other innocent road users at risk too. Unfortunately, accidents do seem to be a part of life, but where they can be prevented they should be. Anyone involved in an accident of this sort should consider their legal options, if they believe they weren't at fault. The right legal support can alleviate some of the irritation and upheaval which can come from being in an unexpected accident. Our friendly team is always on hand to give you advice on this matter.'

Fatal Injuries in the Workplace Increase: The Accident Team Comments

Doncaster, England -- (SBWIRE) -- 07/23/2015 -- According to recent statistics released by the Health and Safety Executive (HSE), between April 2014 and March 2015, 142 people were fatally injured at work. This is an increase when compared to the all time low last year of 136 fatalities.

The statistics suggest that unsafe working environments are still an issue – and need to be addressed. An employer has a legal obligation to fulfil all health and safety requirements and ensure that the security of employees is maintained. These obligations include providing the correct training, carrying out risk assessments and providing the correct tools and safety equipment to minimise the risk of injury.

Common workplace hazards include poorly maintained surfaces, faulty or defective equipment, makeshift tools and improperly guarded machinery. The figures are primarily gathered via RIDDOR (The Reporting of Injuries, Diseases and Dangerous Occurrences Regulations). They include self-employed people, but do not include deaths from fatal diseases, such as asbestos or occupation related cancers.

About The Accident Team
The Accident Team is a group of personal injury lawyers, who are highly experienced in dealing with fatal injuries in the workplace. They are also frequent commentators on industry news and were quick to reflect upon the HSE figures.

A spokesperson, said: "Although there has only been a small increase, any increase at all is disappointing – these figures represent the loss of real lives, real people with families. Workplace regulations are there for a reason and that is simply to preserve safety.

The law is particularly unfair regarding fatal accident claims, they can be complex and need to be handled by experienced lawyers.

Of course, no amount of compensation can ease the pain of losing someone, but getting to the truth of what happened can offer some comfort and making a claim can help maintain some level of financial stability if the deceased had dependents."

60 Per Cent of All Fatal Traffic Accidents Occur on Country Roads: The Accident Team Comments

Doncaster, England -- (SBWIRE) -- 07/20/2015 -- Figures published by Think!, the government's road safety information body, reveal that accidents on country roads account for 60 per cent of all road fatalities, and claim the lives of three people each day.

Sharp bends and often inadequate lighting on many country roads makes them more dangerous to drive on than motorways; according to the report, 11 times more people are killed on country roads than on the motorways.

This news highlights the importance of driving with much more care and attention in the countryside, as dangers are likely to catch drivers off guard on the the quiet country lanes. Think! advise drivers to slow down, particularly before taking sharp bends and try to read the road ahead by remaining vigilant.

These figures support an earlier survey carried out by road safety campaign group, Brake which found that one in four men and one in six women admitted to overtaking on rural roads when they could not be certain that it was safe to do so.

About The Accident Team
The Accident Team specialise in handling claims arising from road accidents, and have handled cases for clients throughout the UK. As regular commenters on industry news, a spokesperson had this to say: "These reports highlight that constructive action needs to be taken to reduce the number of accidents on our country lanes and prevent further deaths. Speeding and overtaking blindly, not only puts the drivers at risk, but also the people around them. We fully support the work of campaign groups and agree that improving driver awareness is an important step towards making the roads safer for us all.

Anyone unfortunate enough to be injured in a road traffic accident should be able to obtain the legal support they need. At The Accident Team, we ensure our services are accessible to everyone and make sure that our clients have the support they need to handle the situation.

Couple Sue Tour Operator After Falling Ill on Holiday

London, England -- (SBWIRE) -- 07/06/2015 -- A couple are suing their tour operator after falling ill during a luxury holiday in Cuba. The wife fell sick with a severe gastric illness that required repeated trips to the hospital, leaving them unable to enjoy their special treat. The couple believe the holiday provider is responsible, due to not maintaining the venue properly – with unsanitary conditions potentially aggravating the woman's complaint and in turn putting the couple's health and safety at risk. Sadly the wife is still suffering from the effects of the illness.

The news comes at the start of the holiday season, and could be considered shocking to some. Unfortunately, this is not an isolated incident and statistics published by the Foreign and Commonwealth Office (FCO) show that it assisted 19,000 people in 2013, whilst they were on holiday.

The result of the couple's action is eagerly awaited by holiday-makers, travel agents and tour operators alike as it could lead to a substantial increase in claims. It is also expected that this will lead to holiday providers having to accept far more responsibility for the health and safety of travellers.

About The Accident Team
The Accident Team is a group of highly experienced accident and injury lawyers: leaders in their field. The team often helps those who have become ill or injured whilst abroad. Regularly commentating on industry news, a spokesperson for the group said: "It is essential that holiday agencies are held to account where they are liable for any harm to their customers, including damage to their person or property. Of course it is unjust that these sorts of incidents spoil people's holidays, as in many circumstances, they are preventable. Yet people affected should not have to suffer in silence and should be properly compensated. We would always advise holiday-makers to seek legal advice if they have suffered illness or injury whilst abroad, especially if they feel that someone else is responsible. They may be able to claim compensation."

The Accident Team Comments on the Recent Figures Released About Accidents in the Workplace

London, England -- (SBWIRE) -- 05/05/2015 -- In recent research by the European Agency for Safety and Health at Work (EU-OSHA), it was highlighted that employees between the ages of 18 and 24 are at least 50% more likely to suffer an injury at work than people 25 and over. They are also more prone to suffering from occupational illnesses.

EU-OSHA commented that the discrepancies in injuries between younger and older workers are likely to do with both mental and physical immaturity, as well as lack of the necessary experience and being less likely to foresee and prevent dangers.

"Employers, educators, health and safety professionals, policy makers, and young workers themselves - we all have a responsibility to help keep young people safe and healthy,"EU-OSHA commented.

The report also emphasizes the importance of ensuring workers – particularly those in a more physical role –being given the necessary training and skills before they take on tasks they have never undertaken before.

The importance of ensuring an open work environment where people felt able to raise concerns about potential problems was also highlighted.

Diane Parker, a member of The Accident Team, a group of legal professionals that specialize in workplace injuries, reflected on the report: "Employers are legally obliged to ensure that all their employees, regardless of age, have the necessary skills and training to carry out their job. This report will hopefully encourage employers to be more mindful of their younger employees.

"Correctly trained workers are more able to pre-empt and better protect themselves against dangers in the workplace. It is unfortunate that workplace accidents do still happen and they can have a lasting effect on the person, and their family. It's important to bring these cases to light, so that the issues are addressed and the injured are able to claim the compensation they need to get their life back on track."
