The Law Offices of Darwin F Johnson Explains when Workers' Compensation Cases Cannot Be Reopened

Atlanta, GA -- (SBWIRE) -- 04/15/2020 -- For workers compensation plaintiffs in Georgia, the road to a settlement can be long and confusing. Sometimes, it can be difficult to know if a long-running case is closed or dormant. These two designations are very different and it is important to know how to tell the difference. Once a case is officially closed, reopening it is nearly impossible. There are several reasons for a workers' compensation case involving a catastrophic work accident to be closed, and several specific reasons it can be reopened once it is closed.

Workers' compensation cases that have been settled and submitted in Georgia can generally not be reopened. If a case is approved, it means that the State Board of Workers' Compensation has reviewed and approved the case and settlement. In some instances, cases can be officially considered closed before the plaintiff starts receiving compensation.

If an employer or insurers fails to pay the agreed-upon settlement within 20 days, they are typically penalized 20% of the total compensation. Civil penalties can be awarded to employees who are not paid on time, but once closed, a case can only be formally reopened if there is proof of fraud by the employer or insurer.

Another thing for plaintiffs to consider is the statute of limitations in their case. In Georgia workers' compensation cases, the statute of limitations is expired if, it has been 1 year since a case ended and the employer has not paid, the plaintiff does file a notice of claim within one year of their last medical treatment, two years have gone by since the plaintiff received indemnity benefits and no claim has been filed.

These caveats can be confusing for an injured worker to navigate without the right counsel. Anyone who has a pending workers' compensation case involving a neck or spinal injury and hasn't received full compensation should visit https://www.darwinfjohnson.com/ for more information.

The Law Offices of Darwin F. Johnson Explain How Salary Affects Disability Compensation in Georgia

Atlanta, GA -- (SBWIRE) -- 04/14/2020 -- Medical bills are only part of compensation for injured workers in Georgia. For those who are left unable to work because of neck or spinal injury, daily expenses become a priority and a concern. Many people file claims because the medical bills for their treatment become too much to manage, and this is important too, as medical bills for serious care in Georgia can be extremely high even when the patient is insured. Companies should pay medical benefits to cover the cost of any treatment, equipment, or medication that injured workers need for their injuries.

The second major component of workers' compensation in Georgia is disability benefits. Sometimes referred to as replacement wages, these benefits are crucial for injured workers who may not be able to cover their regular living costs without them. There are a number of factors that affect how much an injured employee will receive in disability benefits.

Regular salary is a major component of this, although an injured worker should not expect to be paid their normal compensation while they are out on disability. In Georgia, the law states that injured workers should be paid two thirds of their normal weekly wage. The length of time they can collect these benefits depends on the severity of their injury as determined by a doctor. Partially disabled workers should expect less, fully disabled workers should be able to collect benefits for either 400 weeks or until they recover (whichever comes first).

Anyone in Atlanta who has been injured in a catastrophic work accident and is interested in knowing more about their rights is encouraged to visit https://www.darwinfjohnson.com/ for more information and guidance from friendly experts.

The Law Offices of Darwin F. Johnson Explains How Doctors in Georgia Assess Permanent Disability Impairment Ratings

Atlanta, GA -- (SBWIRE) -- 04/14/2020 -- Determining the severity of impairment caused by a catastrophic workplace injury is of paramount importance when the court is awarding compensation to injured workers. When an employer agrees to pay for healthcare, they are going to want to make sure that the severity of the injury is accurately measured. Workers with permanent injuries (ones from which a full recovery is impossible) are typically awarded more in disability benefits than temporary ones.

Once an injury is determined to be permanent, a doctor must determine how severe the impairment is by examining and assigning it a percentage. Doctors in Georgia must follow very specific guidelines from the American Medical Association when assessing impairment, and their decisions affect cases in a number of critical ways.

Doctors assign an impairment percentage to an injury based on the severity of the disability it causes to the body as a whole or to one specific part of it. That number will be used to determine the number of disability benefits the plaintiff will receive. For example, a patient with 10% permanent impairment to their whole body will receive 30 weeks of permanent partial disability pay. Injury to specific sections of the body or extremities pay out less relative to the impairment percentage

For workers who have disabled by an injury sustained on the job, the road to compensation is long and can be difficult to navigate. The counsel of an experienced and trustworthy spinal or neck injury lawyer can go a long way for an injured worker.
The Law Offices of Darwin F. Johnson Explains What Employees Should Do if They Are Exposed to the Coronavirus at Work

Atlanta, GA -- (SBWIRE) -- 03/24/2020 -- More Coronavirus cases are reported daily, and the total number of confirmed cases worldwide is now over 100,000. People who work in service industries with high public contact are more likely to be exposed to the virus, but also have a stronger case for workers' compensation if they contract it at work. As the outbreak spreads, more people will be exposed, and in many cases, the exposure will occur in the workplace. The Atlanta workers' compensation attorneys at the Law Offices of Darwin F. Johnson explain what employees should do if they have been exposed.

Workers in services industries like transportation, hospitality, education, restaurants, and retail are all involved in significant public contact while at work. For employees with jobs involving more contact than the general population, it may be easier to prove "industrial causation." This essentially means that being in the workplace makes the risk of contracting the virus significantly higher than working in an office or from home, and that the employer is liable to pay any costs associated with treating the illness.

Based on the precedent set during the swine flu outbreak of 2009 and the Valley fever outbreak of 2016, employers should expect claims to increase as a result of the virus. Hospital bills were a common reason for claims being filed by sick employees who were exposed at work. Based on the fact that about 1,000 Americans have tested positive for the illness so far, there may be a surge of workers' comp claims alleging industrial causation, especially as the number of cases continues to rise.

Anyone working in a service industry who believes they were exposed to coronavirus at work and is looking for an Athens, GA work lawyer is encouraged to reach out to The Law Offices of Darwin F.
The Law Offices of Darwin F. Johnson Advise on the Importance of Protective Equipment in the Workplace

Atlanta, GA -- (SBWIRE) -- 08/28/2019 -- Every seven seconds, someone is injured at work in the USA. Although this statistic is quite staggering, many of these injuries could be prevented. As the most reputable workers' comp attorney in Atlanta, The Law Offices of Darwin F. Johnson have advised on the importance of protective equipment in the workplace.

Workers provided with Personal Protective Equipment (PPE) are not liable for their injuries in the majority of claims. This is as long as they are wearing their PPE at the time an accident occurs. If a worker decides not to wear their PPE, the liability for their workers' compensation claim becomes more of a gray area. In the worst-case scenarios, workers can be found partially responsible for their injuries in court.

Another reason that PPE is advised is that it can help workers avoid disease and damage from long-term exposure to chemicals. For instance, 3,000 Americans are diagnosed with mesothelioma every year. This rare form of cancer can be avoided as long as ample protection is supplied and worn when working amongst asbestos fibers and other hazardous construction materials. Workers should take full advantage of today's medical knowledge to safeguard their long-term health and wellbeing.

Workers are urged to think of PPE as a support system for the work required in their job. The equipment is provided to encourage safety and minimize risk. Weight belts offer support for heavy lifting, and safety glasses protect the eyes; these could both prevent life-changing injuries in thousands of workers every day.

The Law Offices of Darwin F. Johnson Warns That Work Injuries Increase During the Summer Months

Atlanta, GA -- (SBWIRE) -- 08/28/2019 -- The Bureau of Labor Statistics has stated that workplace injuries are more prevalent across the summer months of June, July, and August. As the leading workers' compensation lawyer in Atlanta, The Law Offices of Darwin F. Johnson has advised that employers must be extra vigilant around safety, especially during these months of the year.

A common cause of workplace injuries during summer is car accidents since there are more cars on the road. Drivers are encouraged to be aware that other motorists are more likely to be distracted during the summer months. Another leading cause of summer workplace injury is heat stress. This is particularly prevalent among landscapers, groundskeepers, and construction workers. Those working these kinds of jobs can quickly become dehydrated, burned, or suffer from heatstroke.

Falls, slips, and trips are still some of the most commonly occurring causes of workplace accidents across all industries. During the summer months, workers may be required to work longer shifts, creating more opportunities for these types of accidents to occur.

Employers are urged to take several safety precautions in the summertime to protect their employees. These include educating employees about the risks that they may be exposed to as temperatures rise, providing a water station and cool down area, and increasing ventilation. Additionally, employers can encourage workers to take breaks frequently, establish an injury prevention program, and provide workers with appropriate Personal Protective Equipment (PPE).

The Law Offices of Darwin F. Johnson Explain Whether Metal Health Claims Are Covered Under Workers' Compensation

Atlanta, GA -- (SBWIRE) -- 08/28/2019 -- When people think about getting injured at work, most of them imagine a slip or a fall, or perhaps an injury from lifting something too heavy. It's rare that mental health and emotional trauma immediately spring to mind. As the most reputable workman comp attorney in Atlanta, The Law Offices of Darwin F. Johnson has explained that Atlanta's compensation laws apply to both mental and physical injuries sustained while working.

Workers across the state of Atlanta who suffer from a mental health issue or condition as a result of their job are fully entitled to compensation for time off to treat their injury and pay for their medical bills. Mental health injuries are medical conditions that can make it impossible for an employee to carry out their day-to-day job. Many people suffer from stress and anxiety at work from time to time. However, this stress rarely equates to a level that causes disability and makes it impossible to work.

For some employees, a particularly stressful work environment or a bad experience at work can result in a diagnosis of impaired mental health. This diagnosis will be the basis for a workers' compensation claim if it states that such an impairment impedes their ability to function daily. An example of this may be an employee that is forced to consistently work long hours, leading to a detrimental impact on their mental health.

Other examples of situations where workers may be eligible for workers compensation due to mental health issues include working in high-stress environments. Law Enforcement Officers, military veterans, and emergency services workers are all susceptible to this type of stress during their careers.

The Law Offices of Darwin F. Johnson Advises on Crane Safety Tips

Atlanta, GA -- (SBWIRE) -- 08/28/2019 -- On average, accidents involving cranes on construction sites cause 42 deaths a year in the USA. Since 1997, almost 1000 workers have lost their lives due to injuries caused while using or working around these machines. As the best workers' comp attorneys in Atlanta, The Law Offices of Darwin F. Johnson have advised on crane safety tips to help to keep these fatal accidents at bay.

By implementing crane safety procedures on construction worksites, lives can be saved, and serious injuries prevented. Cranes that are placed on top of high buildings run the risk of injuring pedestrians below if they accidentally tip over. There are several safety concerns when it comes to crane use, including complete knowledge of how much the crane can carry. If an operator tries to lift a weight that is above the crane's limits, it can create a tipping hazard.

The team at The Law Offices of Darwin F. Johnson recommend having safety checklists in place on any construction site that uses cranes. These checklists help to remind operators of key safety steps and operating procedures. These lists should be durable, colorful, and visible on site. They should include bullet points of all the safety procedures associated with the cranes and other pieces of heavy machinery on the worksite.

Workers are further encouraged to ensure their cranes are as close as possible to the load that they are lifting. This helps to minimize the potential for the crane to tip the load, or the weight to fall upon an unexpected area. To further prevent tipping, workers are also urged to make sure that stabilizers are fully deployed. Most accidents occur when operators fail to use stabilizers, or they are not adequately grounded.

The Law Offices of Darwin F. Johnson Discuss the Risks to Aluminum Workers

Atlanta, GA -- (SBWIRE) -- 08/28/2019 -- A recent study has found that employees that work in factories producing aluminum could face significant risks of mild cognitive impairment (MCI). The condition is a transitional stage between the normal aging process and Alzheimer's disease. As the leading workers' compensation lawyer in Atlanta, The Law Offices of Darwin F. Johnson have advised on the symptoms of this condition.

During the final stage of aluminum production, electrolysis occurs. As this process takes place, factory workers are often exposed to aluminum oxide dust. When this dust is inhaled, it allows aluminum to enter the brain. Over time, this aluminum continues to accumulate. The study revealed an association between the diagnosis of MCI and high plasma aluminum concentrations.

Workers who experience cognitive impairment may experience problems with problem solving, memory, language, and reasoning. Those who contract MCI mall also progress into a stage of dementia. According to the Alzheimer's Association, those with MCI have a significantly increased risk of developing Alzheimer's. At present, Alzheimer's is a continuous and incurable disease. 5.8 million American's are currently living with some form of the condition.

Many workers know that they have the right to file a workers' compensation claim if they have a work-related accident. However, exposure to aluminum and other dangerous substances in the workplace can cause irreversible health problems that can take years to surface. For those that have a question about a health condition or illness that could be work-related, visit The Law Offices of Darwin F.
The Law Offices of Darwin F. Johnson Advise on Functional Capacity Exams

Atlanta, GA -- (SBWIRE) -- 08/05/2019 -- Functional Capacity Exams (Or FCEs) are used to determine the physical abilities and permanent work restrictions of injured workers. As the leading workers' comp attorney serving Atlanta, The Law Offices of Darwin F. Johnson has advised on these examinations. FCEs are typically administered by physical therapists and consist of several tests that determine whether or not a claimant is exaggerating physical limitations related to their work-related injury.

FCE's serve two purposes: They can identify the exact physical capabilities of an injured worker and allow a physical therapist to decide what work restrictions are needed to offer recommendations to a treating physician. They can also enable physical therapists to determine impairment ratings so that the treating physician can approve them.

FCEs should not be performed until an injured worker has reached MMI (Maximum Medical Improvement). MMI means that a worker that has been injured has recovered as much as they are going to from their work-related injury. Impairment ratings are invalid until a worker has reached their MMI. Additionally, physical restrictions can't be considered permanent until the injured worker receives their MMI.

Once an FCE is completed, the report will be typed up officially by the examiner's office. After this, a workers' compensation doctor must approve the exam as well as the restrictions set forth. Upon approval, a copy of the report can be obtained by the claimant.

The Law Offices of Darwin F. Johnson Advise on Workers' Compensation Deposition Hearings

Atlanta, GA -- (SBWIRE) -- 08/05/2019 -- In workers' compensation claims, there are many instances when an employer's insurance company will want to conduct a deposition with a claimant. Depositions are oral question-and-answer sessions that are recorded under oath as if in a courtroom. As a premier workers' compensation lawyer in Atlanta, The Law Offices of Darwin F. Johnson have advised on workers' compensation deposition hearings.

In the majority of work injury depositions, an attorney representing the insurance company of business will question the worker making a workers' compensation claim. Before interviewing, the legal team assisting the claimant will advise on the questions that are likely to be asked during the deposition. An experienced attorney will offer practical suggestions to help claimants answer in the best possible way to help guarantee the success of a claim.

Depositions can be mentally exhausting; therefore, preparation is paramount to increase the chances of success and reduce nerves and stress throughout the process. Claimants are advised to request breaks if necessary throughout the deposition proceedings.

Once a deposition has finished, claimants have the right to review the transcript to determine whether the court reporter's transcription is factually correct. At this time, claimants have the opportunity to annotate the document's margins with any corrections to the text. Claimants wanting to receive a copy of the transcription can typically purchase one for around $150.00, depending on the length of the document.

The Law Offices of Darwin F. Johnson Promote Workers' Compensation for Police

Atlanta, GA -- (SBWIRE) -- 08/05/2019 -- Law enforcement is a particularly dangerous profession with regard to the chances of sustaining a work-related injury. Assault-related injury rates increased by 10% annually between 2003 and 2011. The leading causes of these injuries were assaults and violent acts, accounting for 36% of all incidents. As the most prominent workman comp attorney in Atlanta, The Law Offices of Darwin F. Johnson are promoting workers' compensation for law enforcement officers.

Law enforcement officers are covered for both accidental injuries that arise out of and during the course of their employment and occupational diseases. These occupational diseases could arise from the hazards of their profession and include hearing loss, heart disease, and hypertension. Atlanta law presumes that hypertension or heart disease developed from stressful situations and conditions faced during an officer's employment.

The presumption is based on factual medical evidence that law enforcement officers, due to their many responsibilities and pressures, have an increased risk of hypertension and heart disease in comparison to the general public. When choosing a workers compensation lawyer in Atlanta, it's essential to work with a reputable firm with experience representing the police to maximize the chances of receiving fair compensation.

The Law Offices of Darwin F. Johnson Explain the Importance of the First Week of Meeting a Workers' Comp Attorney

Atlanta, GA -- (SBWIRE) -- 08/05/2019 -- There are several crucial steps that injured employees must take within the first week of meeting with a workers' comp attorney to maximize their chances of compensation. As a reputable work injury lawyer in Atlanta, the team of legal professionals at The Law Offices of Darwin F. Johnson are explaining the necessary actions and processes that must take place during this period.

First, employees must report their injuries to their employer and seek medical treatment as soon as possible. When discussing the injury with a medical professional, an accurate account of how the injury occurred must be given. There should be no communications with the employee's insurance company unless they are sure that they will not be seeking legal counsel.

If employees decide to work with an attorney, it's crucial that they choose a trustworthy legal team with experience and a solid reputation for workers' compensation representation. A workers' compensation claim must be filed as soon as possible, and a doctor must be chosen for any follow-up care. It's also useful for injured workers to decide whether or not they will be speaking to the nurse assigned by the insurance company looking into their case.

Failure to follow these processes could make it difficult to win a case as the insurance company involved could deny a claim. Everything that an injured worker does in the first days after sustaining a work-related injury has a direct effect on what will happen when they are in front of a commissioner. Even if an insurance company pays benefits at the start of a workers' compensation claim, at the point that a disagreement occurs, claimants will struggle to organize a hearing in front of the Workers' Compensation Commission if an application was not appropriately filed previously.

The Law Offices of Darwin F. Johnson Advise on the Differences Between Family Medical Leave and Workers' Compensation

Atlanta, GA -- (SBWIRE) -- 08/05/2019 -- In addition to workers' compensation payments, certain employees are entitled to federal protections under the Family Medical Leave Act (FMLA). As a reputable workers' comp attorney in Atlanta, The Law Offices of Darwin F. Johnson are advising on the differences between these two types of remuneration.

Workers' compensation entitles employees to the payment of either partial or total disability benefits while they are out of work as well as payment of reasonable treatment for any compensable work-related injury. FMLA is unpaid leave; it guarantees that employees can return to the same or equivalent employment position as long as they return to work within twelve weeks.

Therefore, any workers that suffer a severe injury or health condition while working may be entitled to payment through workers' compensation, while their position is held open by FMLA. FMLA requires all covered employers to continue paying health insurance as if their employees were still working. However, this will not cover the medical expenses incurred as a result of any work-related accident.

This isn't usually a problem since workers' compensation offers employees the right to request payment of any reasonable medical treatment for the rest of their lives, as long as the issue is related to the workplace accident. For example, if somebody injures their shoulder at work, and this injury eventually requires a shoulder replacement, workers' compensation gives the injured party the right to request payment for any medical expenses and recovery costs.

The Law Offices of Darwin F. Johnson Discusses if Interns Can Receive Workers' Comp

Atlanta, GA -- (SBWIRE) -- 07/09/2019 -- One of the most frequent questions that workers compensation lawyers in Atlanta receive is "Are interns covered under workers' compensation insurance?". Although employees are generally entitled to this type of insurance, for interns, it depends on several key factors. As the most reputable workers' comp attorneys in Atlanta, The Law Offices of Darwin F. Johnson is answering this question.

Their team has revealed that there are two main factors that courts will take into consideration when determining whether an intern is eligible to collect benefits for an injury that has occurred at work. First, is the internship a paid position? If so, they will likely be entitled to receive workers' compensation. If they are not being paid, then they are typically not entitled to coverage.

Unpaid interns may be eligible for benefits if the duties that they perform are similar to those of a paid employee, or if they have taken the place of somebody on the payroll who has recently left or had their contract terminated. Also, if an internship is considered to be 'casual' then even if the intern is being paid, they may not be eligible for workers' compensation benefits. This is because, in the eyes of the law, casual workers follow sporadic schedules, with the courts favoring workers whose duties have been formally planned.

The workman comp attorneys in Atlanta based at The Law Offices of Darwin F. Johnson also advise that interns must follow the same process as paid employees when they file a workers' compensation claim. This means that they must inform their employer of their injury within 120 days, in writing, detailing where, when, and how the accident occurred. If the employers deny the claim, interns have three years from the date of their injury to file an appeal.

The Law Offices of Darwin F. Johnson Advises on the Importance of Safety for Welders

Atlanta, GA -- (SBWIRE) -- 07/09/2019 -- Welding can be a highly hazardous occupation that places workers at risk of death or severe injury. Therefore, workplace safety is a critical component of employment within this industry. As welding regularly exposes workers to immediate and longer-term health and safety hazards, the Atlanta-based work injury lawyers at The Law Offices of Darwin F. Johnson has offered valuable safety advice for welders.

Their team has said that welding workers are entitled to a safe workplace that complies in full with occupational health and safety standards, trains workers on the safe use of equipment, and supplies safety equipment for employers. Work injuries can have significant long-term psychological and physical effects as a result of welding accidents.

Electric shocks are one of the most common dangers in welding as the equipment is powered from an electrical source. Any voltage can impose a risk of injury or death by electric shock, with higher voltages increasing the severity of the injuries that may be sustained.

Prolonged exposure to welding gases can lead to respiratory illness or injuries such as breathing impairments and some forms of cancer. However, by utilizing proper ventilation and exhaust systems, these fumes can be significantly minimized. Welding operators should ask their lawyers about the limits of permissible exposure in their given work environment.

With welding arc temperatures sometimes reaching up to 10,000 degrees Fahrenheit, fire and explosions are another health and safety risk. Welding risks can be minimized if employers adhere to all recommended safety standards and use personal protective equipment at all times. Any workers that suffer an injury while welding should be eligible to receive workers' compensation.

The Law Offices of Darwin F. Johnson Speaks on Workers at Risk for Radiation Exposure

Atlanta, GA -- (SBWIRE) -- 07/09/2019 -- Recent studies have found that workers exposed to small doses of ionizing radiation are at risk of developing and dying from cardiovascular diseases over time. Prolonged radiation exposure has also been associated with neurological problems and congenital genetic disabilities. As the leading worker's comp attorneys in Atlanta, The Law Offices of Darwin F. Johnson have offered their expert advice.

Their team revealed that around half the radiation that people are exposed to in their lives comes from nature, as it's present in rocks, types of soil, and the atmosphere. The other 50% comes from man-made sources such as medical treatments, tests, and nuclear power plants.

Researchers have used a recent study as evidence that exposure to radiation can be linked to non-cancerous health outcomes such as high blood pressure from prolonged exposure to even small doses of radiation, leading to hypertension in some cases. The number of people exposed to radiation while undergoing routine medical diagnostic procedures has increased in recent years.

The Atlanta based team of workers compensation lawyers at The Law Offices of Darwin F. Johnson encourages healthcare workers to follow strict radiological procedures and stay well within established dose limits when participating in radiological tests. Failure to do this could rapidly increase their risk of developing several diseases and conditions that can prove deadly.

Workers are reminded that the chances of developing cancer vary from person to person. The variables include the source and amount of radiation exposure, the number of exposures over time, the age at exposure, and other factors such as diet, alcohol intake, and whether or not an individual smokes.
The Law Offices of Darwin F. Johnson Advises on the Increase of Elevator Injuries in the Construction Industry

Atlanta, GA -- (SBWIRE) -- 07/09/2019 -- A recent study has revealed that the construction industry experiences more fatal and nonfatal elevator-related injuries than any other major industry. Between 2011 and 2016, incidents relating to elevators caused 2,410 severe injuries and 145 deaths among construction workers. As the leading worker's comp attorneys in Atlanta, The Law Offices of Darwin F. Johnson has expanded on the findings of this study.

The work injury lawyers at The Law Offices of Darwin F. Johnson said that although the injury rates involving elevators declined over time, the number of fatalities increased in recent years. Of these fatalities, over one-third occurred when the victim was performing tasks that involved assembling or dismantling duties. The majority of all elevator-related deaths were caused by falls to a lower level.

The firm added that elevator maintenance workers had the highest risk of fatal injuries out of all construction occupations. Younger workers have a higher risk of experiencing both fatal and nonfatal injuries compared to their older colleagues.

Out of the general public, over 25,000 people were treated at hospitals as a result of escalator-related injuries in 2017; this is a 30% increase in comparison to the previous decade. The work injury lawyers in Atlanta at The Law Offices of Darwin F. Johnson are urging all construction workers that deal with elevators to exercise additional caution at work.

The Law Offices of Darwin F. Johnson Observes National Safety Month by Advising on Common Workplace Injuries

Atlanta, GA -- (SBWIRE) -- 07/09/2019 -- June is National Safety Month, designed to highlight areas surrounding some of the leading causes of fatalities and injuries within the workplace. As Atlanta's leading workers' compensation lawyers, the team at The Law Offices of Darwin F. Johnson has advised on the most common workplace injuries sustained each year.

Their team advises that slips, trips, and falls account for over 30% of all personal injuries sustained in the workplace, making them a leading cause of workers' compensation claims. Damages incurred from these accidents include broken bones, head and back injuries, lacerations and cuts, sprains and pulled muscles. The leading causes of these accidents are wet or oily surfaces, loose rugs or mats, and uneven surfaces.

Another leading cause of workplace injury is unguarded or unsafe machinery. Body parts can get caught in or struck by exposed moving parts or objects expelled by machines that aren't fitted with protective guards. This can lead to crushed limbs, blindness, severed fingers, and even death.

Transportation and vehicle-related accidents are the third most prevalent cause of injury within working environments. These accidents include being hit or run over by a vehicle, falling from a vehicle, being struck by objects that fall from a vehicle, and being crushed by a vehicle that has overturned. These type of accidents cause the most fatalities in the agriculture industry but can be just as catastrophic in manufacturing environments.

Anyone that has received an injury at work is encouraged to call the most reputable workers' compensation lawyers in Atlanta at The Law Offices of Darwin F.
The Law Offices of Darwin F. Johnson Explains the Consequences of Filing a False Workers' Comp Claim

Atlanta, GA -- (SBWIRE) -- 06/26/2019 -- Any claimants caught pursuing false workers compensation claims within the state of Georgia could face both civil and criminal penalties. The reputable Atlanta workers compensation lawyers at Darwin F. Johnson advise that if found guilty, fraudulent claimants can face civil fines of up to $10,000 and criminal charges of twelve months behind bars.

One in ten businesses are said to be worried that an employee will try and claim a fake injury sustained in the workplace. Newer employees are up to three times more likely to be injured on the job compared to longer serving staff, with appropriate safety and compliance programs helping to keep workplace injury claims at a minimum for many businesses.

Severe penalties can be issued to all parties involved in the misrepresentation of a workers' compensation case. This includes lawyers, coworkers, medical staff, and friends of employees that deliberately falsify information. Both faking an injury and presenting an injury sustained outside work as being work-related are punishable offenses. The same goes for lying about treatment and taking extended periods of absence after an injury has healed.

The same civil and criminal penalties are in place for disgruntled employers who refuse to pay genuine workers compensation claims. If they are found guilty of this negligence, they are open to fines and imprisonment, so transparency is essential to all parties when it comes to injuries sustained in the workplace.
The Law Offices of Darwin F. Johnson Advises on the Decision Between Workers' Compensation and a Lawsuit

Atlanta, GA -- (SBWIRE) -- 06/19/2019 -- Every year, thousands of workers sustain injuries while in the workplace or performing work-related duties. When a significant injury is sustained, individuals will have to decide whether to pursue workers compensation or to file a lawsuit to cover their damages. As a leading workman comp attorney in Atlanta, The Law Offices of Darwin F. Johnson has offered advice on some points to consider before taking action to receive compensation.

Firstly, if somebody is allocated workers' compensation for their injuries, they will not be able to sue. This is because workers compensation is there to pay dividends on any amount a claimant may receive in court. Another critical point to consider is that workers compensation is a form of insurance. Therefore, any claimants hoping to receive ongoing health and medical care may go through difficulty with their employer. This means that a lawsuit may be beneficial in getting claimants' rights recognized.

The significant difference between a personal injury lawsuit and a workers compensation claim is that in a successful lawsuit, an employee is entitled to recover all damages that they have sustained. Workers' compensation stops claimants from being eligible to claim for pain and suffering, meaning that both careful consideration and legal advice are recommended before pursuing either of these proceedings.

Workers' compensation will cover income and medical care but will often be capped at a certain level. For long term injuries and disabilities, or if workers compensation does not fully cover living and medical costs, claimants are advised to consider suing. For any queries regarding workers' compensation or lawsuits, call the most reputable workers' comp attorney in Atlanta at 404-692-6482 now or visit https://www.darwinfjohnson.com/ today.

The Law Offices of Darwin F. Johnson Explain What Justifies Reopening a Workers' Comp Claim

Atlanta, GA -- (SBWIRE) -- 06/18/2019 -- Reopening a workers' compensation claim is a process that must be started within five years of sustaining a workplace injury due to the statute of limitations. Claims are re-opened when injuries worsen, claims have been unsuccessful, or benefits have been overpaid. The Law Offices of Darwin F. Johnson are the leading Atlanta workers compensation lawyers and are now advising on what justifies the re-opening of a workers compensation claim.

Workers can reopen a claim if they notice errors or evidence of fraud in their previous settlement or claims process. Another justified reason for coming back to a claim is if a claimants' condition worsens or the previous compensation claim did not sufficiently address the injuries sustained and subsequent treatment needed to improve or cure those injuries.

Although workers can reopen their claims, so can insurance companies if they believe that claimants have been overcompensated and they want to reclaim compensation. If this happens, it's recommended that claimants seek legal advice, especially if they think that the amount of remuneration received was valid and just enough to cover their injuries.

Claimants are reminded that receiving a notification via post or email of potential errors on claims from insurers does not make them guilty. It's merely the action of a business looking to improve its profit margins in many cases.

The Law Offices of Darwin F. Johnson Advises on the Importance of Documenting All Work Injuries

Atlanta, GA -- (SBWIRE) -- 06/18/2019 -- With workplace injuries occurring roughly every seven seconds, the Law Offices of Darwin F. Johnson have stressed the urgency of workplace injury documentation. As the leading worker's comp attorney in Atlanta, the professional legal team has made it clear that many claimants place great emphasis on the significant injuries received as a consequence of their accident. However, it's vital that even minor cuts and bruises are documented in full to prove any subsequent injuries to a commissioner or insurance company further down the line.

Accurate documentation is paramount because many injuries can be interconnected, and some can take days or weeks to develop. For instance, when somebody falls and protects themselves by throwing their hands out in front of them, this impact could cause severe injuries to the back, neck, and shoulders. If there is no documentation to prove any cause for such injuries, it will make it harder to receive compensation in full for all damages sustained.

It's not uncommon for the team at Darwin F. Johnson to review emergency room reports only to find that the wrong body parts have been documented concerning the injuries sustained. For this reason, it's recommended that claimants pay particular attention when filling out their accident reports, workers compensation claim forms, and additional documentation that is given when attending any medical offices after their accidents have taken place.

Claimants are reminded to tell medical professionals about every single ailment that they experience after a workplace accident, leaving nothing out. Anyone who has suffered an accident at work and would like to speak to a work injury lawyer in Atlanta, can call 404-692-6482 now or visit https://www.darwinfjohnson.com/ to contact The Law Offices of Darwin F.
The Law Offices of Darwin F. Johnson Advises on PTSD and Workers' Compensation

Atlanta, GA -- (SBWIRE) -- 06/18/2019 -- In the United States, one in thirteen people will develop PTSD at some point during their lifetime. Unfortunately, this can be due to a traumatic event in the workplace, prolonged periods of work-related stress, or repeated exposure to dangerous situations. As the leading workers' compensation lawyers in Atlanta, the Law Offices of Darwin F. Johnson work with people with PTSD to ensure that they are fully compensated for their conditions by their employers.

For PTSD to be covered by workers' compensation, symptoms must start following a traumatic event and last for a month or more. Any signs that last less than four weeks are diagnosed as an acute stress disorder. Sustaining a severe injury while at work can have a considerable impact on both the physical and psychological health of the person involved. Luckily, Georgia's workers' compensation laws mean that many psychological conditions are covered if they are associated with a physical injury sustained on the job.

PTSD is more commonly associated with high-stress professions such as firefighting, policing, or ambulance staff. However, it is not uncommon to see symptoms of PTSD in people working within any occupation that carries danger or high-stress levels. Although PTSD can't be officially diagnosed until a month after a traumatic event, the team at The Law Offices of Darwin F. Johnson recommends reaching out to employers at the earliest signs of stress, anxiety, and depression following an incident.

It's crucial for anyone suffering from symptoms of PTSD to keep full documentation of their condition. It's also advisable to seek medical assistance, as all of this paperwork and professional verification will work to verify cases seeking workers compensation. In all instances, it will have to be proven that the PTSD is a direct result of a work-based injury or abnormal condition at work.

Those seeking advice from the leading Atlanta workers' compensation lawyers are encouraged to call 404-692-6482 now or visit The Law Offices of Darwin F.
The Law Offices of Darwin F. Johnson Explains Claim Leakage

Atlanta, GA -- (SBWIRE) -- 05/09/2019 -- As a leading workers' comp attorney serving Atlanta and surrounding areas, The Law Offices of Darwin F. Johnson works tirelessly to avoid claim leakage or keep the numbers to a minimum. Now, their team of financial law professionals is proud to explain the concept of claim leakage for their clients.

Claims leakage is defined as the gap between the optimal and actual settlement of a claim. This is calculated from the payment of the claim according to the policy, correctly offsetting the loss. Claim leakage is an essential concept for insurers because their industry is based around costs and assets balanced with liabilities.

A significant source of claim leakage is process inefficiency. When an organization takes its time to settle a claim, or when multiple parties are involved, the carrier ends up paying for their lack of performance. This payment is leakage, and it's frustrating and damaging for carriers and legal offices alike. In fact, claim leakage is monitored and minimized by specialized software that streamlines processes in accordance with the policy conditions and business rules.

In many cases, claims leakage can be avoided with the use of sound logic, complete records, and reliable data. However, there are practical limitations to this, such as the cost of determining an accurate claim balancing with the cost of the claim. The experts at Darwin F. Johnson are the best work injury lawyers in Atlanta. They work hard to avoid any claims leakage so that their clients get the best possible outcomes to their legal finance problems.
