HK nationals will have access to new temporary and permanent immigration pathways to Canada.

2020 has finally concluded. The effects of COVID-19 on immigration have been undeniable. The IRCC has not processed and approved many permanent residency applications as COVID shutdowns have impacted processing speeds and prevented applicants from meeting basic requirements like obtaining police clearance and completing biometric requirements.

Due to these circumstances, the IRCC announced plans to increase the number of new immigrants Canada will welcome between 2021 and 2023. Roughly two weeks later, on November 12, 2020, they announced this initiative would include new immigration pathways for Hong Kong, including two important strategies for both temporary and permanent immigration to Canada.

Work Permit
One of the new pathways open will be for citizens who have completed post-secondary education in Canada or abroad within the last five years. Valid for up to three years, the closest comparable category that already exists is the Post-Graduation Work Permit (PGWP), which is only available to students who complete a postsecondary educational credential in Canada.

This new work permit category will give applicants the ability to apply for a Canadian work permit even if they have not previously studied in Canada. Like the PGWP, applicants will receive open work permits, which means that they can work for any employer in Canada in any occupation for up to three years.

Permanent Residence
For permanent residence, two new pathways will be opening, although few details are known at this stage. What is known is that one pathway will be open to applicants with at least one year of experience, and the other will be open to applicants who have graduated from a post-secondary school in Canada.

As 2021 draws closer, it's likely new programs will be announced to assist other groups of potential immigrants. For example, IRCC may consider issuing work permits to individuals in Canada who had to stop working due to COVID-19 and lost valuable time on existing or now expired permits to count towards obtaining Canadian work experience.

Another potential option the IRCC may consider is temporarily lowering the minimum entry criteria under existing permanent residency pathways, including those falling under Express Entry. This would directly assist applicants who were on their way to qualifying for permanent residency before the COVID-19 pandemic.

Fargo could lead as the first US city to use approval voting and let voters choose all the candidates they want on their ballot.

Fargo, ND -- (ReleaseWire) -- 08/28/2018 -- A local grassroots organization, Reform Fargo, has received official approval after submitting signatures for an approval voting ballot initiative. Fargo voters will see approval voting on their ballot this November as Measure 1. The initiative changes the voting method for Fargo's city-wide elections to approval voting, which lets voters choose (not rank) all the candidates they wish on their ballot. Most votes still wins. Cass County Auditor Mike Montplaisir and North Dakota Deputy Secretary of State Jim Silrum have both confirmed that approval voting requires no special software. It also adapts to current ballot design.

Reform Fargo's founder, Jed Limke, reached out to The Center for Election Science (CES) for advice following Fargo creating an elections task force to improve its voting method. CES is a nonprofit that studies and advances better voting methods. Feedback from CES and input from Fargo residents at ten public meetings led to the task force recommending approval voting. Despite a clear recommendation from the task force and requests from citizens during public meetings, the commission spent the next ten months refusing to place approval voting on the ballot. Following the commission's refusal, Jed Limke set up Reform Fargo to run approval voting as a ballot initiative and began working more closely with CES.

With vote splitting between candidates in Fargo elections, it's become obvious how bad current elections are. Former Fargo Mayor Bruce Furness said, "Our current voting method is the least constructive method of voting and the most common." In 2015, Fargo had a six-way election for a single commissioner seat. Vote splitting was so bad that the winner received just under 22% of the vote.

"Our current choose-one-candidate voting method discourages good people from running. But when they do run, the voting method is so incompetent that it gives results that—in some scenarios—may as well just be random. That's because of vote splitting, inexpressive ballots, and incentivizing voters to prioritize 'viability" over their own interests. We need our elections to be competitive. But competitive elections can't happen when our current voting method self-destructs with the mildest of competition," said CES Executive Director, Aaron Hamlin.

In addition to being simple (choose all the candidates you wish), approval voting has strengths that give it support across the political spectrum. This explains why the ballot initiative sponsoring committee had supporters from within both major parties and local third parties, including Libertarian. According to CES, approval voting favors consensus candidates while it also gives a more accurate reflection of support for third-parties and independents.

Hamlin said, "Approval voting holds a nice balance of favoring candidates that strike the tune of the people while also making sure new voices are heard. That balance is good because we need thought from all sides to move forward. Like a market, democracy necessitates free entry of ideas so everyone has a chance to succeed or fail. Coloradans Abused by Federal Justice System Seek Support from Out-of-State Congressmen After Being Rejected by Senator Bennet

Arguello engaged in misconduct resulting in the wrongful imprisonment of five (originally six) technology executives from Colorado Springs known as the "IRP6", he repeatedly stonewalled them, even telling dozens of African-Americans on one occasion that they were not his constituents.

Family, friends and parishioners from the IRP6's church, many of whom were African-Americans, say they were hurt and disappointed when, after holding a March 15, 2013 protest at the Denver federal courthouse, they went to Senator Bennet's office for help and he wouldn't come outside to talk to them. Instead, Senator Bennet sent his chief of staff outside to tell them they were not his constituents.

The IRP6 case (District of Colo. no. 09-cr-00266-CMA) concerns five (4 black, one white) wrongly-convicted and imprisoned software executives of the IRP Solutions Corporation who developed "Case Investigative Life Cycle (CILC)" criminal investigations software that was targeted by the Department of Homeland Security and DOJ to modernize the FBI and Immigration and Customs Enforcement case management system after 9/11. In an effort to gain business from DHS and the NYPD who showed great interest in CILC and praised its capabilities, the IRP execs, agreed to make modifications to CILC (pronounced "silk") and contracted the services of staffing companies who reviewed the potential of the CILC software, conducted credit checks and agreed to provide temporary labor to IRP Solutions to help with the modifications. After a year and a half of demonstrations, modifications and a $100 million-dollar quote provided to DHS at their request, the FBI raided IRP Solutions with a search warrant affidavit that falsely stated that IRP Solutions was a "purported" software development company and spent 11 hours imaging every computer in their building. Sarokin, who retired from the 3rd U.S. Circuit Court of Appeals immersed himself into the facts of the case and reviewed trial records after a critical portion of the transcript mysteriously disappeared where Judge Arguello was alleged to have intentionally violated the defendants' constitutional rights. Judge Sarokin was so troubled by the injustice and how the case was mishandled, he sent letters to the DOJ and blogged about the case on the Huffington Post where he is a contributor.

In his Huffington Post blog, Sarokin said that trial transcripts show that Judge Arguello, indeed, had violated the IRP6 defendants 5th Amendment rights. Sarokin became convinced that the men were innocent, and that race may have played a part in their conviction. "What amazed me about the case," Sarokin told the Post, "was the theory of the government, that this program they were developing was a scam. "All the proof in the case goes the other way."

Gorsuch Opinion Proves His 10th Circuit Peers Disregarded Law and Constitution

Today, A Just Cause presents an opinion by Supreme Court nominee Neil Gorsuch where he reversed and remanded a criminal case on the same legal grounds his 10th Circuit peers, trial judge Christine M. Arguello, U.S. Attorney John Walsh and federal prosecutor Matthew T. Kirsch, disregarded to uphold the wrongful conviction in the IRP6 case (Dist. Colo. no. 09-cr-00266-CMA), which is the subject of a judicial complaint (http://bit.ly/2ba9827) and a letter (http://bit.ly/2b06Rpm) to Chief Justice of the U.S. Supreme Court, John Roberts.

In the 2014 10th Circuit case (No. 13-1363), Gorsuch found that when both the federal prosecutor and trial judge misstates the law, it warrants reversal. Gorsuch stated the following in his opinion:

"The transcript of the hearing shows the government misstating the law. The transcript then shows the court signaling its agreement with the government's mistaken view of the law. After that, however, the transcript never shows the government or the district court disavowing the error...But even if the government isn't willing to correct the error it invited, this court retains power to do so under its authority to address plain but unpreserved errors...But we can think of few things that affect an individual's substantial rights or the public's perception of the fairness and integrity of the judicial process more than a reasonable probability an individual will linger longer in prison than the law demands because of an obvious judicial mistake."

In the IRP6 case, trial transcripts show Kirsch intentionally misstated the law, specifically Rule 16(b)(1)(C) of the Federal Rules of Criminal Procedure, which states: "The defendant must, at the government's request, give to the government a written summary of any testimony that the defendant intends to use...at trial, IF (and only if) -- the defendant requests disclosure of the government and the government complies." Congressional judiciary committees make it clear in their Rule 16(b)(1)(C) advisory notes that the disclosure of expert summaries are "defense triggered" and stress that defendants are not required to turn over written summaries unless they first make a request for written summaries of government experts and the government provides them to the defense. However, Kirsch, absent any "defense triggered" requests from the IRP6 defendants, argued to Judge Arguello that he was still entitled to defense expert witness summaries and asked Judge Arguello to exclude defense experts from testifying for failing to comply with Rule 16. Judge Arguello agreed with the government's misstatement of Rule 16, issued a ruling based using the government's false representation,s and improperly excluded the expert witnesses in violation the IRP6's 6th Amendment constitutional right to present witnesses in their favor. Shockingly, when the case was appealed to the 10th Circuit, three of Gorsuch's colleagues (Judges Bobby Baldock, Harris Hartz & Jerome Holmes) used the same Rule 16 misrepresentations in their August 2014 opinion (10th Cir. case no. 11-1487), concluding that Judge Arguello didn't abuse her discretion or violate the IRP6's 6th Amendment rights when she misstated the law and wrongly excluded the expert witnesses. Judges are presumed to know the law and it is completely unreasonable to conclude that Kirsch, Judge Arguello and the highly-experienced and reputed 10th Circuit judges Baldock, Hartz and Holmes did not know or understand Rule 16(b)(1)(C) or their requirement to reverse the conviction. The only rational conclusion is that these officials acted intentionally and maliciously to violate the law and the constitutional rights of the IRP6.

It is telling and worth mentioning that Judge Holmes, in writing the 10th Circuit opinion, didn't cite the entire Rule 16(b)(1(C) statute but only the first half that benefits the government's argument, stating that the defendant "must, at the government's request, give to the government a written summary of any testimony that the defendant intends to use...at trial." Judge Holmes conveniently eliminated the second half of the statute that cites the "defense triggered" condition upon which the government was entitled to receive the summaries, specifically that: "IF -- the defendant [first] requests disclosure of the government and the government complies" then the government is entitled to receive written summaries of defense experts.

The judicial complaint also discusses a gross 5th Amendment violation which has to be one of the worst constitutional transgressions in American history. The 5th Amendment of the U.S. Constitution states that "no person...shall be compelled in any criminal case to be a witness against himself..." but in the IRP case Judge Arguello threatened to terminate the pro se defendants defense if they did not agree to testify after a subpoenaed law enforcement witness failed to appear. Fearing their defense and their lives were in jeopardy, the pro se defendants huddled together and decided who would first testify and took the stand against their will. During cross-examination, the frustrated defendants interrupted Kirsch in front of the jury and complained to the judge they were forced to testify. Judge Arguello denied threatening the defendants but when the IRP6 requested the transcript, Judge Arguello refused, saying she could not remember what her "exact phrasing" was and speculated that her statements were not recorded because the court reporter's headphones may have fell off or the defendants were speaking too far from the microphone. Kirsch and his co-prosecutor, Suneeta Hazra, were present at the sidebar and heard Judge Arguello's statements but remained silent to benefit from Judge Arguello's coercion. The judicial complaint cites unambiguous 10th Circuit and Supreme Court law that required a reversal of the conviction which was ignored by the 10th Circuit panel, who, without the sidebar transcript, absurdly asserted the defendants voluntarily testified -- an unimaginable conclusion starkly contradicted by trial transcripts even without the missing sidebar portion -- contradictions discussed by former federal appeals judge H. None of the 10th Circuit judges, Judge Arguello or Kirsch has disavowed their mistake or taken responsibility for their violations of the law and the Constitution that resulted in the defendants not receiving a fair trial, not receiving a fair appeal and being wrongly imprisoned. Judge Andrew Hurwitz of the 9th U.S. Circuit Court of Appeals says it is not uncommon for federal judges to avoid taking responsibility for their mistakes or admit wrongdoing. "To err is human, but "to make a mistake and stubbornly refuse to acknowledge it -- that's judicial," Hurwitz said in the June 9, 2014 Arizona Law Review. "Federal judges and prosecutors have been turned into infallible Gods by the mainstream media and many legislators who are so awestruck by their unbridled power are unwilling or scared to criticize or hold them accountable, even when there is undeniable proof they violated the constitutional rights of individual citizens," says Banks.

The February 8, 2017 Bloomberg Criminal Law Reporter (Vol. 100, No. 18, pp. 392-393) reported that Judge Gorsuch says he is willing to follow the law when he doesn't like the outcome and insists that courts "adhere strictly to the text of federal statutes" which his 10th Circuit peers failed to do in the IRP6 case. If Judge Gorsuch is to be the next Supreme Court justice, he should have the integrity, fidelity and commitment to the Constitution and rule of law to speak out and correct injustice wherever he sees it, even when it involves judicial colleagues within his own circuit.

We're seeing some of this in the week since the election, with not only group demonstrations against Donald Trump but a rise in individual verbal and physical attacks that seem motivated directly by the election's outcome.

That said, tribalism also has its advantages. With such commonality of purpose and belief, these tribes can be very passionate, enthusiastic and creative and compelling. They produce leaders like Trump, who are willing to takes risks, to challenge what has gone before, and to inspire others to do the same. And if that energy can be harnessed and not allowed to run amok, I think we actually have the potential to meet our challenging global future.

The election is over, but the challenges facing us are far from it. Eight years of sweeping economic fundamentals under a rug of bailouts and quantitative easing has left us in a fragile, volatile and dangerous position. Individuals, corporations and nations are overleveraged, with almost nothing left in the toolbox to deal with the next crisis. To stand up and deal with these problems we have to acknowledge an uncomfortable truth. Our tribes, those groups that support our views and beliefs, that hold us up in times of uncertainty, that fight for us when we need fighting for—those tribes are social constructs. No single tribe can fix the problems facing our country, and no one can rely on their tribe to fix their individual problems.

As is so often the case, my advice in this time of change boils down to this: gather your own information, listen to many viewpoints, and in the end make your own decisions. It seems deceit, dishonesty, and disgusting personal failings are the primary mover in this election, for both candidates, and more and more people I talk to are answering "no one" when I ask who they're going to vote for on Tuesday, November 8th, a crying shame when our country desperately needs us to participate in the processes of governance. With sexual allegations on the one hand and the dump of thousands of humiliating emails on the other, it's as if we Americans are being held hostage to a poorly written TV show, watching the race for the highest office in our land become a race to the bottom.

I suppose it shouldn't be a surprise that this election, the first ever to feature a female major party candidate for President, has become in major part a contest to see whether Donald Trump or Bill Clinton is the most odious man on the stage, never mind the fact that Bill Clinton is not actually on the stage. The Democrats are now railing against the hypocrisy of the Republicans in the same way the Republicans decried Democrats' hypocrisy in the 1990s. Is this the conversation we want to be having as the struggle to the narrative occurs between two sides that no sane person would choose if there was any alternative.

And then, of course, hackers broke into Clinton campaign email servers and have started posting thousands of emails, many of which are downright embarrassing to both Hillary Clinton and her campaign. The same hackers that began challenging government surveillance and illegal wartime activities have turned their attention to the political realm, and they are using the transparency site WikiLeaks, founded in 2006, to post their finds. I do believe there is a principled argument for this sort of radical transparency: as Julian Assange said ten years ago, "The more secretive or unjust an organization is, the more leaks induce fear and paranoia in its leadership." Over and over again the Clinton campaign emails reveal the "private position vs. public position" conflict brought out in the second debate. Her private disdain for same-sex marriage, contrasting sharply with her public support, must cause the LGBT community to pause, for instance Her portrayal of herself to Wall Street as extremely supportive of free trade and open borders when she repeatedly claims to be skeptical of both on the campaign trail also reveals an essential disconnect. Add to that other leaked emails indicating collusion between the Clinton Foundation and the State Department, and the steady drip-drip-drip of bad news for Hillary is increasingly become a torrent.

In all, it just seems that no matter who wins this election, America loses. November 8th can't come soon enough as an end to the international embarrassment that is this election, and I'm not the only one in the financial world to say it. Even Merrill Lynch said last week, "Despite the descent of politics, the subjects having little bearing on financial markets, its stench nonetheless permeates everything." Honestly, I think that says it all.

Whether it happens in time for the actual election, I believe that the driving force in American politics for years to come is going to be the pocketbook, and these very issues could still drive Trump to a win. Fundamentals have too long been ignored: a poor and unstable economy; a lack of consumer liquidity; employment and income savaged by many elements, particularly poor-quality trade agreements, shifting wealth off shore. The financial system is no longer a free market system in anything but name, operating outside of reasonable norms and controls. Secretary Clinton is promising continued and even expanded versions of government programs of recent years, and we know we can't afford that. Trump is promising a change, but it doesn't feel likely that he'll be in a position to deliver on that promise.

Whichever wins, I believe the US financial markets and the dollar are going to go through some form of near-term turmoil. As much as you would think this would cause a flight to gold, I'm not seeing that yet. It almost smells like the Federal Reserve, as they did in September 2011, is suppressing the price so it appears that our economy and markets and political system are stronger than they actually are. Back in September 2011, gold topped out and then dropped 400 to 500 points. This year, gold is up about 17 percent year to date and silver up 25 percent. Perhaps the Fed has decided that's simply enough?

This is the main reason why very few investors truly expect a downturn in US stock markets. They believe the Fed has their back, and in the last eight years, the Fed has controlled the stock and bond markets and the practice of buying the dip has worked brilliantly, and it will probably continue to work in the near term unless the members of the Fed's Board of Governors change, which is only likely to happen if Donald Trump does get elected. For now, it seems the powers that be will keep markets aloft so that Clinton gets elected.

But nothing lasts forever, and every bubble eventually bursts, no matter who is inflating it. The breadth of the equity market is collapsing in recent weeks, which rarely ends well for stocks. In general, the indexes follow breadth. Bloomberg has said that these divergences, measured by comparing the S&P 500 and the number of constituent tradings above their fifty day moving average, have been rare since 1990 and generally been bad for investors. In the seven instances that occurred before this year, all but two actually portended further losses. December 1990, February 2000, and October 2008 are notable examples. After 2008, equities ended up erasing half their value over the next two years. It should be clear that our markets have no connection with reality. Earnings and revenues have dropped substantially widely across the S&P and Dow constituent stocks, and even the Russell 2000.

On Black Monday in 1987, the Dow fell 508 points. Then, that was a 22.61 percent drop. The 1929 crash was a 24.55 percent drop. There are analysts that feel we could be heading for a similar event, given the collapsing breadth of the market and our increasingly weak and unstable fundamentals. In today's market, that could be as much as 4000 points. So, regardless of how you vote, look to your pocketbook, your investments, your future. Do what you can to protect them, and be ready for when the dominoes begin to tumble.
