Although ineffective assistance of counsel is a widespread problem that plagues the American Criminal Justice System, it has until recently been ignored by the courts and the government. Despite the watchful eye of neighbors, surveillance tactics by police, the use of cameras and other defenses against porch pirates, package theft can be difficult to prove.<br />

Chief Justice Debra Stephens issued the emergency order, which postpones hearings for out-of-custody defendants in the state. In addition to postponing hearings, the emergency order also provides for the release of certain defendants. More specifically, jail inmates who are especially vulnerable to coronavirus may be eligible for release. The emergency order allows trial court judges to suspend court rules to address health concerns arising out of the pandemic. The emergency order took immediate effect. Prior to the emergency order, criminal jury trials in parts of Washington State had been postponed until April 24, 2020.<br />

That suspension affected people facing criminal charges in King County, Snohomish County, and Pierce County. However, many other counties in the state did not order similar criminal jury trial suspensions. Accordingly, many commentators saw the emergency order as a necessity. The emergency order also has a provision for its extension beyond April 24 if necessary. According to the emergency order, the requirement that all courts close became necessary.<br />

Although courts postponed hearings and trials in some counties, other courts in Washington State carried on. The emergency order ensures consistency across the state in an attempt to combat the public health crisis of COVID-19. Indeed, many courtrooms in Seattle and across the state are small. As such, appropriate social distancing cannot occur within them. Attorneys, judges, and other court employees voiced concerns about the coronavirus spreading due to courtroom interactions. In addition to out-of-custody defendants, criminal hearings for in-custody defendants have also been postponed.<br />

Accordingly, judges will still hear motions for pretrial release and bail modifications. Prior to the emergency order, criminal jury trials in parts of Washington State had been postponed until April 24, 2020. That suspension affected people facing criminal charges in King County, Snohomish County, and Pierce County. The emergency order also has a provision for its extension beyond April 24 if necessary.<br />

Title VII of the Civil Rights Act of 1964 prohibits discrimination on the basis of race, sex, religion, and other categories. The Age Discrimination in Employment Act (ADEA) prohibits discrimination on the basis of age. It provides specific protections for employees and job applications aged 40 and older. The Illinois General Assembly passed the law last June in connection with other laws related to sexual harassment. The law is similar to other laws passed in New York and California in response to the #MeToo movement. Legislators want to prevent workplace situations in which employees were not allowed to discuss their harassment allegations once their case was settled. Given that the WTA is now in effect, employment law changes will need to occur for new hires and for exiting employees.<br />

Under the new law, employers who are making new hires need to understand the limits of non-disclosure agreements. Employers cannot create employment agreements that include clauses or covenants designed to prevent an employee from disclosing harassment at work. More significantly, employers cannot include clauses or covenants that have the effect of preventing an employee from making disclosures. To be clear, employers do not have to intend to prevent an employee from reporting discrimination with a non-disclosure agreement. However, if an agreement or clause has that effect, it is unlawful under the WTC. Accordingly, the WTC aims to support current or former employees who want to come forward with discrimination or harassment claims. The enactment of the WTC coincides with greater employee protections under the Illinois Human Rights Act (IHRA).<br />

The WTC takes additional steps beyond prohibiting certain types of agreements, clauses, and covenants in employment contracts. Indeed, it also prohibits employers from compelling arbitration for discrimination issues and other particular disputes. To be sure, the WTC says that mandatory arbitration may not be compelled in Illinois. In addition, the WTC provides protections for employees presented with settlement agreements. To ensure that employees can properly consider a settlement offer, the WTC requires specific time windows for acceptance and revocation. All employees must have 21 days to consider a settlement agreement. In addition, all employees must have 7 days to revoke a settlement agreement after signing it.<br />

It&apos;s clear that placing the responsibility in the hands of the Bureau of Prisons (BOP) was a mistake that has resulted in a financial conflict of interest.<br />

As congress intended The FSA awards eligible, non-violent, inmates with earned time credits. These credits can be used to provide the inmate more halfway house time or home confinement, ultimately increasing the transitional period between the confines of prison and the demands of being a productive member of a community. Earned time credits do not reduce a prisoner&apos;s sentence, but instead allows eligible prisoners to serve their sentences outside prison walls. Thus, transferring the cost of confinement from the taxpayers, to the individual inmates who are, upon release, eligible to join the American working class.<br />
<br />
Unfortunately, the early release of eligible inmates translates into a loss of gross revenue for the BOP. In a recent notice issued by the Department Of Justice ( published in the Federal Register/ vol. 84, no. 223/ Tuesday, November 19, 2019) the BOP said: "Title 28 of the Code of Federal Regulations, part 505, allows for assessment of a fee to cover the average cost of incarceration for Federal inmates. We calculate the Cost Of Incarceration Fee (COIF) by dividing the number representing the Bureau of Prisons (Bureau) facilities monetary obligation (excluding activation costs) by the number of inmate-days incurred for the fiscal year, and then by multiplying the quotient by the number of days in the fiscal year. A recent population report, published by Texas attorney Jeremy Gordon, shows that the BOP currently holds 174,963 inmates, over 60% of which are non-violent offenders, 40% (or an estimated 69,985 inmates) of which are FSA eligible. Multiplying the number of eligible inmates by the Bureau&apos;s own COIF, of $102.60 per day, shows a daily gross revenue of an estimated $7,180,461.00 paid to the bureau for delaying the benefits of the First Step Act to inmates who are otherwise qualified to be released. <br />

"The BOP has a long history of acting in ways that result in lengthier and less productive terms of incarceration despite the obvious will of congress," David E. Patton, executive director of the nonprofit Federal Defenders of New York, recently quoted in the Washington Post. "For decades it has not provided enough vocational, educational, mental health, and substance abuse programming despite abundant need and lengthy wait lists." Patton pointed to DOJ wait lists that indicate that tens of thousands of inmates go without prison work assignments, vocational and educational training and drug treatment.<br />

The Washington Post reported, in early January 2020, that near half of BOP inmates complete no programs, more than half go without needed drug treatment, more than 80% have not taken technical or vocational courses, and over 90% have no prison industry employment.<br />

In the past year, since the enactment of The First Step Act, the BOP has offered no new qualifying programs to its inmate population. And the BOP has refused to consider or offer new programs and productive activities provided by outside sources. There is a difference between morally guilty and legally guilty, he explained. Moral guilt is irrelevant in criminal cases. Legal guilt is all that matters. "Guilty" or "not guilty" is not related to what the defendant did, but rather to what the state can prove he did.<br />

This proof must be beyond a reasonable doubt. That&apos;s the highest standard of evidence in American law. The Pattern Jury Instructions have a generic definition of reasonable doubt which is not very helpful. So, defense lawyers often press for an additional clause: "If, from such consideration, you have an abiding belief in the truth of the charge, you are satisfied beyond a reasonable doubt."<br />

Prosecutors present their side of the story first. Immediately after that, almost all jurors would immediately vote "guilty" without hesitating. Proof of an abiding character means that, even after jurors hear the other side of the story, they have the same firm belief in the defendant&apos;s guilt.<br />

All this assumes the stop and arrest were legal. If officers lacked reasonable suspicion for the stop or probable cause for the arrest, the case cannot move forward. DUI is a good example. It&apos;s not illegal to weave in a single lane of traffic. So, such weaving cannot be reasonable suspicion. The entrapment defense might apply in these situations as well. But it is not easy to establish. Contrary to popular myth, police officers can freely impersonate underage girls online. They can even provide photos.<br />

For the entrapment defense to hold up in court, the defendant must prove s/he had no predisposition to commit the crime. If officers approached Tim when he was in a sex chat room, he obviously had some predisposition to commit the crime. If officers sent Tim a Facebook message, entrapment might be a possibility.<br />
<br />
It is also very important to humanize the client in these situations. So, trials are usually a good option, especially because prosecutors rarely offer good deals in these cases. If the evidence is overwhelming, a slow plea might be an option.
